      Hello, I ordered a load of driveway grade slag material from Phoenix. This is material similar to pea gravel. Phoenix recommended a hauler to, ******* ********, to deliver the material. The material was picked up by ******* ******** from Phoenix Services and delivered on Wednesday April the 22nd. Upon delivery I noticed there was junk slag mixed in with the materials. That day I hand pulled 4 bags worth of the dangerous material off the road that was exposed on the top. This included nails, screws, coil springs, brake pad parts, etc. At that point I reached out to Phoenix to figure out what happened and how to correct it. ******* ******** assured me their truck was clean when the picked up the materials from Phoenix and that the dangerous materials came from Phoenix. The next day a landscaping company was at my house to do some work. When they left their trailer got two flat tires due to the materials with a nail still in one of the tires when they pulled over. The cost for the replacements was $473.85 from *** ****** ******* with the receipt attached here. After that happened I used my tractor and blade to clear the materials. During this I continued to pull more material as well. This took several hours to safely clear all the materials to prevent additional flat tires on the tractor and the material is still lining the outside of the road. This also caused me to lose the base layer of good material that was on the road. I then got a nail in my tire that was removed and patched. The tire then started to leak air again and had to replace it. Phoenix Services LLC did not take accountability for the damages nor the time and expenses to fix the issue. They offered another load of driveway materials but I would have to pay for hauling. Two tires at $473.85 A patched tire for $20 then replaced early 6 hours of personal time hand pulling materials 2 of those hours of tractor time and diesel. Loss of materials. Estimated $ 1178.85 in damages

      Mr. ******* did not buy the product directly from Phoenix Services but rather from ******* Trucking. Upon review of Mr. ********* complaint, it was determined that the material in question could not have come from Phoenix Services as it is not found in slag or even on our property.

      I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Phoenix recommended I use ******* ******** for the delivery and purchase of the materials. After the incident I also reached out to ******* ******** as well. Both ******* and Phoenix are pointing the finger at each other for who is at fault. It would appear fair for both companies to discuss this, figure out ownership, and come up with an appropriate resolution. Regards, **** *******
