As of 5/16/2023 my vehicle was sent to the body shop for repairs. Once the repairs are done, my finance company(CNAC) will not sign off on the insurance check because I will not agree to put new parts on the vehicle because it was sold to me without new parts. At this time they are holding my car and the insurance check issued to me. I will not put new parts on the vehicle as it was sold to me with damage to the bumper(approx. 2 inches of the top left corner of bumper on passenger side was already not attached, also the paint under the front vehicle tag was already peeling). I feel as they are trying to make the insurance company pay for replacement parts because they are paying for it and they didn't put on replacement parts before selling me the vehicle. I would like the company held liable for fraudulent information and unethical practices with the customer(Me). I fixed the retainer clip and replaced the headlight as what was damaged and they are making more items just so the other persons insurance company can pay for it. Also the body shop has already done the work and CNAC finance company ****** ***** ** ******* *************** doesn't want to pay them for the work they've done. they are applying alot of shady practices. All involved is the General manager for ****** ***** ** ******* location, ****** ***** -account rep, also ******** - Account mgr. I was informed by the insurance company that it was my decision where to get the repairs done and if the repairs are done and CNAC/JD Byrider is not following those guidelines.Business response

Thank you for sending this customer issue. I have looked into the situation. Ms. ******* vehicle was damage by another party, and she went to ******** **** *** to get an estimate for the repairs. The insurance company wrote Ms. ***** & CNAC a check for $2009.06. Ms. ***** subsequently did not take the vehicle back to ******** **** **** for the repairs. She went to ******* **** ****** shop and told them to fix a couple of things. This amount totaled $$969.34. When ********* **** ****** came to our location to have us sign off on the work we refused, because the automobile was not put in the same condition it was before and there was no way there was $2009.06 worth of work done. We contacted ******* **** ****** and they said they just did what Ms. ***** asked them to do. They did not know it was an insurance claim until they saw the check left in the vehicle. We told ******* **** ****** we would not have a problem signing off on the check if they complete the work from the original estimate. I have included both the original estimate from ******** and the work completed by ********. As you can see there is work that needs to be done. Thank you for your time.Customer response

I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. I reject the response because the estimate is just that an estimate not stating a requirement. The items in the estimate was by request of mine not what shop said was required. I don't agree that I have to pay for nor should the other parties insurance pay for items that were damaged at time of purchase( passenger side bumper top left corner was already detached about 2 in and the paint on the front of the bumper was already coming off). Damages to the headlight and the retainer clip that was damaged was corrected anything else being requested is a request of the finance company and not are required item for the car to be running and back to how I received it. We financed a car through this company and we had paid on time for the time we had it. The car was involved in an accident and the insurances claimed it as totaled. The insurance paid above the normal value of car to this company and we contacted the company to about getting into a new vehicle and we were told they would put us in a new vehicle and just throw the remaining small balance on that loan. We go into do all the paper to do this and they said they didn’t tell us that and we would have to get their investigator to look at car and price it from them. This was while our insurance company had already approved and was sending them a check. Needless to say we decided to look elsewhere for a vehicle and found one and told cnac that we would still pay them our payments till the total was paid. They said ok, then I receive a report from my credit monitoring company and they had marked the load as bad debt and closed it. This dramatically dropped my credit score to a all time low for me and I feel was very wrong and out of spite for not going with them again. I do not report on anyway as I think it can be dealt with better but this company has not been honest with us and they have taken a business matter and made it personal in my opinion.Business response

In the case of ***** *******, Complaint Number: ********, we have investigated this matter with the full cooperation of the franchise-owned CNAC. Mr. ******* is dissatisfied with the handling and reporting of his CNAC account. Mr. ***** ******* and Ms. ******* ******* purchased a 2013 Kia Optima on December 15, 2021 from the franchise-owned Byrider. On July 26, 2022, Ms. ******* contacted the franchise-owned CNAC and informed them that the vehicle had been totaled in an accident and that **** ********* company was handling the claim. She expressed an interest in being placed in another vehicle and was advised of what would be required to achieve that. Ultimately, Mr. and Ms. ******* did not proceed with purchasing another vehicle. Per standard procedure, the account was charged off. In a gesture of goodwill, the franchise-owned CNAC will make the account active again so that Mr. ******* can resume paying on the account. The tradeline will no longer report as a charge off account, but rather an active one that reports current and future payment activity. If Mr. ******* has any questions or concerns, he is encouraged to contact the franchise-owned CNAC to discuss this matter.Customer response

I have Paid 11,468$ to JD for a ‘07 Pontiac I only Have about 6,00 left to pay which is about 6 more months of payment after having the car since 2020 . Being that we were in a pandemic and everything about the cost of living is going up I was Unable to make my payment I have Never been more than 1 payment behind but after I put All this money into a car they repossessed my car last night only owing them 1 payment of 175. The office was closed when I got Off so I tried to make a payment online and it did not go through it never works online but I at least wanted them to see I attempted To make a payment . Now they’re saying it’s no way I can Get my car back even though I have The money to pay them to get it back . I’ve never seen any kind of business handled this way I was Not even a month behind I make payments every 2 weeks I dont Want anything but handed to me I said That I have The money to pay to get it back . I just Feel after 2 years and 11,000$ put into a car they could be a little more considerate it’s not like I just started making payments I will Pay the towing fee or whatever else needs to be paidBusiness response

In the case of ****** *******, Complaint Number: ********, we have investigated this matter with the full cooperation of the franchise-owned CNAC.Ms. ******* purchased a 2007 Pontiac G6 on February 22, 2020 from the Franchise-owned Byrider on ****** ***** **** ** ******** ********.Ms. ******* is currently over 20 days late and in default of her retail installment contract. She has a documented history of making late payments, and after extensive efforts were made to set up payment arrangements, the Franchise-owned CNAC made the difficult decision to repossess the vehicle. The vehicle was repossessed on June 21, 2022, and the necessary letters were sent on June 22, 2022. Previously, Ms. *******’s vehicle was repossessed in January 2022. The franchise-owned CNAC’s policy states that if a customer’s vehicle is repossessed twice, the vehicle will not be returned unless the account is paid in full. Ms *******’s current balance is $6,663.69 with a $275 repossession fee owed. While the franchise-owned CNAC sympathizes with Ms. *******’s situation, the vehicle cannot be returned to her until the account is paid in full.
