      Eric with Weisman Enterprises LLC was supposed to level out my yard and install a pool at my house. I have been dealing with him since June and I still do not have a pool. He has done nothing but give me the run around. I am now fighting to get my $5000 deposit back because he claims he doesn’t have the money to give back. I am working with the fraud department at my bank to hopefully get this money back. I told him if that doesn’t work, I will have to go to court. He says “Okay. You are welcome to go to court, but it still won't change me not having it. Hopefully the bank will figure it out.”

      Customer signed a contract to have a pool put in and paid a $5,000 deposit. Materials were ordered. She had an issue acquiring the building permit which caused delays.  She then informed me that she wanted to cancel the project all together and wanted her deposit back. Unfortunately as the materials had been ordered and the project was voluntarily canceled by the customer, the deposit cannot be refunded.

[The contract does not state that the deposit was not refundable. The business also never communicated about materials being received or a date that the project would be started or completed after I received my building permit on July 13th. August 21st came around and still nothing received about a date to start or that materials were received. This is the reason I decided i wanted to cancel.] Regards, ****** ******

      So because of the delay in getting the building permit, I had to put your job on the back burner meaning I scheduled other customers ahead of you. I am still willing and able to build your pool but at this point you cannot just cancel the contract and ask for a refund.

      I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. [This was never told to me at all through text messages. The permit was ready on July 13th. I was put off for a month. A set date was never provided. It became August 21st and still no set date. I was never told that the pool arrived after it was shipped out. There were days that would pass with no update. A normal response would’ve been what you put in this prior message. Instead, you told me that you don’t have the money. It’s the end of summer now. That’s okay. We will go to court. You can’t not give me my money back with no work being done and nothing in the contract of the money being non-refundable.] Regards, ****** ******

      During July, 2023 and August, 2023 Weisman Enterprises agreed to replace my 36 year old brick sidewalk with new brick and materials for $8400 and haul away trash and debris associated with construction. To date I have paid $6300. They were to complete the project in a workman like manor. On or about August 20 that the job site and my adjacent asphalt driveway was still not clean and the sidewalk didn’t look any better than my old sidewalk. Mr Weisman said that it might be better if we we part ways. Come to find out no one involved on this project including Eric Weisman the company owner has never laid brick. Sounds unethical at the very least to accept a project if you don’t know what you’re doing. After consulting brick mason they used concrete instead of mortar to lay the brick.

      First off, we used type S mortar mix for this project, not concrete as the customer states. Secondly, I was in the process of hiring a cleaning company to clean off the excess mortar when I was advised by the client that he did not want to pay the remaining $2,100 of the contract regardless, at which point I concluded it would be best if we parted ways as opposed to take him to court for the balance.

I had asked that he install the bricks with a grapevine joint which he didn’t. With improper installation of the brick and no mortar in the joints, water will collect and loosen the bricks during freezing conditions. I have had a brick mason and he concluded that the shoddy workmanship indicates that the people didn’t know what they were doing. Since the brick was laid incorrectly the sidewalk would not last too long.He has offered to go to court with me to testify on my behalf.

      I informed the customer that overuse of muriatic acid could cause the mortar to dissolve from within the joints but he insisted I do it anyway.I still have not been paid in accordance to the contract.

      I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Please insert the following to the latest response from Mr Weisman: First of all there is no room for mortar because most of the bricks are too close to have any mortar in them. Additionally the guy that used the acid didn’t know how to use it. If used properly it simply cleans the brick surface only. All he did make the sidewalk look worse and killed some plantings near the walk. More problems with the workmanship he provided include: 1)bricks laid incorrectly and not level. 2)improper joints. 3)mortar sloped on the house wall and my asphalt driveway. 4)debris still remains in the mulch bed next to the walk. 5)I requested that the bricks be laid with a grapevine joint which wasn’t done. The contractor offered to have someone to clean the mess he left but I was concerned that someone else would get involved with this project that didn’t know what they were doing adding that if I was still not satisfied I would have to pay for the cleaning expense. Mr Weisman has yet to answer the question of why would he take on a job that he and his employees didn’t know how to do.He actually told me that he and his employees had never laid brick. Thank you, ****** ******
