      I was provided a quote to clear an area of land on my property by ***************************** Corporation. The work was never 100% completed. Through text, the owner agreed that the work was not complete and that they would be back out to complete the work (screenshots attached). They then stopped responding to text messages and calls, and never completed the work - despite being paid for the work. The quote (attached) clearly states that they were to "completely clear, cut, and remove all trees and stumps". The stumps were never fully removed. It was never properly graded and was left very "rough" and rather unusable. They are 15+ stumps left in my yard (photos attached). Approx. cost to get stumps removed and properly graded - $1,000. Along with that, there was damage to signage and a horse shoe pit on my property that was acknowledged but never repaired or costs settled (photos attached). Damages of approx. $300. I don't want them working on my property anymore at this point and ask for a refund of $1,300 for work not completed and damages caused.

      In response to the complaint mailed to New Market Grounds Corporation:
      ******************************* was provided with a quote for services in March of 2021. After discussions, **************** agreed to the scope of the work to be completed at a cost of $6,500.00. The work was completed and a final walk-through was conducted with the owner of New Market Grounds Corporation. **************** pointed out areas of concern during the walk-through. Our crew returned and hand-cut all marked areas. At that point, there was no more work to be performed. Concluding the final walk-through and acknowledgment per **************** that the work was completed to his satisfaction, **************** submitted his final payment to New Market Grounds Corporation for services rendered. **************** acknowledged by submitting his final payment concluding the final walk-through, that the work was satisfactory. **************** is not entitled to a refund - full or partial - for any work conducted by New Market Grounds Corporation. Our company disputes the validity of this client's claims.

      I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The walk-through referenced occurred on 4/8/21 (see attached photo of texts confirming meeting) when I was told that the work was complete. During that walk, I pointed out several areas where the scope of work was not completed (see attached photos, of scope still not completed as of 2/4/22). The owner agreed that the work was not complete on 4/8/21 and agreed to come back at a later date to finish the work. Final payment was made during that meeting on 4/8/21 on the basis that the work would be completed in the next several days. 

      When the owner left my property on 4/8/21 he left much of his crew's equipment behind. His crew returned sometime in early May and picked up the equipment, cut some loose roots, but did not remove any of the left behind stumps reviewed with the owner on the 4/8/21 walk.

      I text the owner on 5/25/21 to let him know that his crew picked up their equipment but did not complete the work we reviewed during our walk-through. He acknowledged this and said he was working on coming back out to complete the work. He then stopped returning all texts and calls and never returned to complete his original scope that had been paid for.

      The attached photos were taken on 2/4/22 and show that the work is still not complete. The orange marking is even still visible, identifying stumps that were to be removed. These are just three examples. There are 10+ stumps that were not removed.

      The attached text message screenshots also show the communication and acknowledgement of remaining work that was never completed.

      Their claims that the work is complete is completely untrue. Previously supplied photos and text messages have already proven this. The work is STILL not complete to this day and could be easily verified by anyone willing to take a look in person. I've also attached more photos (taken on 8/15/22) showing stumps that were never removed. While its clear they are unwilling to acknowledge the facts presented, I hope this can at least be a warning to future potential customers that this company will continually lie and provide false claims, while never fulfilling their contract.

      They provided no new information in this latest response. The work is still, to this day, incomplete and they refuse to acknowledge that despite the proof I have already shared numerous times. At this point, I at least hope this complaint remains public so that other potential customers can see how unprofessional and misleading they can be.
