      I contacted JMencia Landscaping LLC on July 28, 2022 for a quote to install a stamped concrete patio, retaining walls and exterior stairs. My son had used this company for a concrete patio a few weeks before. I researched the company on ****; it had good ratings and was **** certified as licensed and insured. JMencia inspected my property on August 29, 2022 and provided a quote on September 2nd. I agreed with the quote and on September 15th, JMencia built exterior stairs, retaining walls and planters. JMencia subcontracted the patio to Mencia Concrete LLC, owned by his brother, to install the stamped concrete patio. The stamped concrete patio was installed on 10/18 and was not at the correct grade or slope resulting in water puddles along the foundation after a rain. I hired a license inspector to inspect the patio and was told the stairs JMencia had built the previous month and the patio he subcontracted to his brother did not meet code. The inspector stated that all stairs should have equal rise and if more than three stairs should also have a handrail. It further stated that the patio slope and grade were improper. Both the patio and the stairs were rated by the inspector as poor construction. The report is attached. When informed of this issue and provided with the inspectors report on 11/01 I was told by JMencia "you can add the railing". I responded that this does not address the unequal rise issue. I have not heard from JMencia since although I have tried multiple times to settle this.

      I wanted to reach out directly as I don't have a simple answer. I have regularly text/emailed the contractor to ask for resolution to this issue since 10/29. On 11/25 the contractor, ***********************, finally called me to state that his brother ********************* whom he had subcontracted the patio project to would be contacting me with a date in which he would remove the patio. **** texted on 11/28 to state he would remove the patio on 11/30 or 12/3 but he did not show up either day and has not answered texts for a new date and time in which he will remove the improperly sloped patio. In addition, ***********************, of JMencia Landscaping for which this complaint is filed still refuses to tear out and correct the steps that he built in September that do not meet code. He offered a refund of $700 in order to have the work completed by someone else. His brother, *********************, was to bring the refund of $700 when he came to tear out the patio but this did not happen.

      I have since messaged him again for a date to resolve this issue but he has not responded to my messages therefore I don't know how to answer the question >>> Our policy in this case is to close the complaint as No response, which will be reflected in the business's BBB Reliability Report.  Before we do this, however, we request your verification that the business has not addressed this complaint with you directly. 

      The correct answer is yes they did finally respond with an offer of resolution but they did not actually show up to perform that resolution and are now once again not responding to messages therefore the complaint is still not resolved and I would very much appreciate if the BBB could reflect the issue as unresolved.
