RE:  2014 Mack GU713 Tri-Axle Dump Truck, VIN#: *****************.  I.D.#"  ********.  ****** ****** * ****** ********* ***With reference to your consumer complaint form dated May 04, 2022 and received by email in our office, we answer as follows:  Our salesman, ***** Milam has all of the text and phone calls.  He has answered all calls from Mr. ***** or had to call him back,if he was on another call.  The tires were fine when the hauler left our establishment.  There are times the hauler will let some airout of the tires to make sure the truck is not over height.  They only had to add air to the tire.  The truck was a used 2014 MackTri-Axle Dump Truck with 309,198 miles on it.  We do not sell new trucks.Mr. ***** called months later after using the truck every day since purchase on November 16, 2021.  There are going to be smallproblems such as a coolant line leaking, as well as an oil leak after thousands of miles.  We do not sell new trucks and do not statewe do.  We fix all problems we see and pass Virginia state inspection. We have no way of knowing if this truck has been maintained and how many miles driven since purchased close to five months ago.He signed the attached Bill of Sale stating he understood this was a used truck.  Under remarks it states "I understand that this truckis being sold "As Is" with all faults and is not covered by any dealer warranty.  I understand that the dealer is not required to make anyrepairs, after I buy this truck I have to pay for any repairs this truck will need."   It was signed at the bottom with the customer's signature. There were no oral or written warranties given.  Our terms and conditions are stated on the Bill of Sale.  Should you require additionalinformation, please give me a call at ***** *********Very truly yours,Edmond T. I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. *The whole reason for this complaint is because ***** just ignored my concerns 11-20-2021. Truck delivered When truck was 20 minutes from the house the truck driver and called and said; we need to meet at a nearby by gas station because the truck was empty. We paid for it to be delivered to the home address ( the truck driver and ***** knew this before it was delivered) but ok when it was unloaded the drop axle was broken and some tires was flat Monday morning my wife called and ***** stayed I sell trucks I don’t gas them up ( if someone put $50,000.00 down how hard was it to put $200.00-$400.00 in the tank ( that’s good customer service) but to say I don’t gas up trucks but your commission was cashed That cost1. $350.0011-22-2021 Got to the 1st job site and was flagged due the tailgate was broken 2. $350.0011-24-2021 Got to another job site and maybe 4 hours into shift coolant line busted 3. Tow fee $516.00 4. Repairs and parts $2000.0012-20-2021 Got to another job and oil leakCrank shaft cover and seal$2400.00And every since it’s been a down hill battle You can see all the work and repairs have cost me I’m living off my credit cards and can’t afford my monthly household bills because my truck isn’t running  Regards, ****** *****

We bought a Caterpillat 615C Motor Scraper in December for $40,000. The salesman, ***** sold the machine with the understanding that it was in running condition and was inspected by their shop. When the machine arrived, it would not run properly. The main fuel transfer pump was inoperable, and the rear lift pump was barely working and was hard wired so the engine would turn on. We’ve spent over $1,500 in order to get the machine to run properly. I’ve called Milam repeatedly and they refuse to return calls/messages.

Attached is the invoice that the customer signed. The machine was sold as is.  This is an 1985 year model machine. The customer received the machine in early January.  Around 7-10 days after machine was delivered customer called ***** and said the filter was stopped up on the machine.  This can happen during transportation because the fuel in the machine moves around.  This machine went from ** ** *****.  It was running and operating before transit to *****. Once we were notified about the fuel filter issue we advised the customer to change the filters on the machine.  To be honest, we did not understand why the customer waited 7-10 days to mention about the fuel filters being stopped up.  Then after 6-8 weeks later he called the owner Eddie Milam and spoke with him about the machine.  Eddie advised the customer that the machine was purchase AS-IS according to the invoice signed and attached. It is untrue that no one would respond to him because there have been several people in the business that has talked with the customer.  Once again, please read the terms and conditions of the invoice that the customer signed.

I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The delivery of this machine was delayed because ***** the salesman informed me that it needed to go through the shop for an inspection and service to get filters & fluids changed.   When it arrived, it had not been serviced and was not operable.  The filters were dated in 2015 with marker to identify the last time they were changed.  The rear fuel filter and priming fuel pump were clogged with dirt that could not have happened by hauling.  It is a sealed system.  We contacted Milam Equipment many times and got no support or effort on their part to correct the situation.  I understand it’s an old machine, but we were assured it was in operating condition.  It was not.  We’ve spent $4,000 in parts & labor to get it in running condition.   Regards, ******* *****
