I am an attorney from New York City, NY who regularly used a courier service in Vienna, Virginia for Court filings at a specific court located in Falls Church, Virginia (called the Board of Immigration Appeals). The name of this courier business is NOVA Delivery Inc. ("NOVA"). They accept legal filings from attorneys and for a fee of $50 advertise that they can hand deliver said filings with the above-referenced Court. On October 18, 2022 I emailed some legal documents to NOVA for filing. This document was a time-sensitive notice of appeal for a person who was ordered deported by an Immigration Court and was now challenging this order. This document was crucial in preserving this person's rights to appeal. I sent the document over as a simple pdf file via email, and asked NOVA to confirm receipt of my email. Within an hour I received confirmation from NOVA by email stating that they have received my filing and that they would file it with the Court the following day (as we were corresponding outside of regular business hours). Short time thereafter, when it became apparent that the filing deadline was missed for this document, I made contact with NOVA both via email and on the phone. After much deliberation and arguing, this company took the position that they did not receive my document and therefore could not have delivered it to the Court. This assertion is completely ridiculous and misleading thanks - in part - to today's technology and the simple fact that our email threat clearly documents the fact that I sent the document to them for filing, and that they confirmed receiving it. As a consumer who hired this company to provide a service, I felt like they were blatantly lying and were purposely trying to deceive me. They clearly acknowledged my request for their service and confirmed that they would do what they are advertising. This company is deceiving its clients and they are not doing the job they claim to be doing.
