      Dear Dispute Resolution Team,

Thank you for your email due to **** ******'s Complaint. Please see below the explanation of the story: (Note: We worked in two different jobs at her house and we have 2 different Invoices. I will explain both of the situations)

First of all, this customer contacted me for Island work. We had some issues since beginning as she was always threatening me with no payment. We agreed that she will pay half of the amount as a deposit before we start the work. The total amount of that work was $2700. - The deposit was $1500. One day when we scheduled the installation of the stone, early in the morning I received a notification that she disputed the amount she paid to us as a deposit. But she never informed me about it and even though she disputed the amount and didn't inform me about it she was still scheduling with me the installation date. I received the notification about her money dispute very late. Called her asking why she did it, she said that she didn't trust me. So the question is, "If you don't trust us, why do you still continue working and arranging installation dates?" This is disrespect to labour and pre-use of the trust of the company and its workers. Disputing the deposit means that I paid for her Island stone from my own pocket. This is not fair. I offered her to stop working with us if she didn't trust me, but she and her husband insisted on working and later on she made the deposit payment and we worked on her countertop and finished the work.

After finishing this work she asked me to do the countertop job on the other side of the kitchen plus painting the cabinets, moving lights and the tile.
So my second question, if she didn't like our work, why did she offer other jobs at her house after we finished the countertop?
I agreed to do all these and again she started threatening us that she wouldn't pay. I still don't know how we worked under this pressure. She was changing her mind all the time about the cabinet colors. She claimed that we didn't finish painting cabinets, countertop work, floor and lights, that's totally a lie!

We finished her countertop, painting cabinets and doing tiles. What we didn't do is hanging the doors of the cabinets after painting. The reason we didn't do it is as below:

--Our guy was doing the painting and then she came and told him to leave the house and wait for her outside because she was going to pick her kids up from school and take them to some activities. Our specialist had to wait outside for more than 40 minutes. If this isn't a disrespect then what is it? I want to mention that **** ******'s house - the job site is 2 hours away from us and the painting guy had to reserve an ****** to finish this job. He waited for her outside and then left. When I called her to ask why she did it, she said that she didn't trust anyone and wouldn't let the painting guy stay in her house while she was away and she wouldn't also cancel the activities of her kids because of this work. So as I understood she didn't respect us, our work, our time but she wanted us to work for her! We said that we need to arrange another time to hang the painted doors and she spoke in a bad manner and said that we had to finish it and she wouldn't pay us the rest of the money. The amount we agreed for this second job was : $4500. She paid us $3000. After finishing she had to pay us $1500.
She said that she won't pay us and we said that we won't come for work to her house anymore. Actually the issue is that we did all her work, except hanging the painted doors and lights and these jobs were inside this last amount of $1500. Who would work knowing that the customer won't pay you for your work and materials that you use there?  We finished working with this lady in May. After 3 months - in August one morning I woke up and saw that she disputed the $3000 she paid us for countertop and painting the cabinets. So it means we worked at her house, did countertop jobs, tile, and painted cabinets just for free. And why did she dispute the money after 3 months but not before that? Doesn't it seem suspicious? What is her aim?

I will be very glad if you take into consideration all these moments, pressure and stress she gave us while working and after finishing the work at her house. We work with different customers and always do our best so that they will remain happy after work. We also did our best  for this customer despite the disrespect she showed us and now she disputed the money.

This is so unfair! Please take into consideration the 3 months period, the amount she disputed already 2 times and all the threats about payment and the labour at that house, disrespect to labour and workers at her house. She put me into a hard situation every time she disputed the money for the work we finished. I have a team, family, contractors  and responsibilities in front of them, and every time this type of behaviour by **** ****** puts me and my business in a hard situation.

Please contact me via email or phone number : (************ for this case anytime.

      Thank you!

      Best,

      Esgandar A*******

       Complaint: ********

I am rejecting this response because:
      Good morning,

Must humbly and respectfully I am writing this letter to provide justification on the claim of $3000 made on May 25th 2022.

The kitchen and garage is the key place where our kids and we spent most of the time. Our kitchen is out of service for a month, they always schedule and not showup. It’s extremely frustrating by looking and waking up each morning to half-painted cabinets in our kitchen and garage. Sawdust footprints in everywhere hallway, garage, stairs etc. My 7-year-old son is allergic to dust which bother us the most. We tried our best to work it out and find the resolution but not, the contractors keep telling I will do it tomorrow. We postponed so many family-friend scheduled visit and kid’s games because of the contractor. Our VA law permit us to Sue anyone “if you have proofed the person or company did not fulfill the duties of the agreed contract”. They didn’t complete the work as per agreed upon, they didn’t meet reasonable standards and they are also considered negligent (i.e., posing safety hazards to your family). We told and make aware of that to contractor and also told them we will report them to Business Bureau, Facebook Page, Angie's List, online review sites, and state's contractor's licensing board or commission. I don’t think they do care of “Customer Satisfactions”. A s requested, we have compiled some documentation and pictures to support the claim.
      ·       Kitchen Cabinet Painting: Incomplete see the pictures.
      ·       Kitchen Countertop: Never installed, keep telling we will be there.
      ·       Remove Floor Tile and Replace: Incomplete, not done properly
      ·       Moving Silliness electronic lights: Never done
I have mailed this document to the  Credit Card Company. But they mention that they can refund only after  company refund, I won’t get it, why. Company is not refunding. i also have a first project invocie where he charged me for sink replacement 200$, I let it go.

I recently notice all my color of the cabinet is coming out too. let me know where do I send you all those picture, i cannot send in email. He had given me so hard time. I have removed hardwood for whole house using different company after this project, but dint get any problem . This Zara company is the worst, they don't show up on time, they don't finished the work. I don't recommend to any. I do have more pictures of my mess kitchen where I suffered waiting for them to finish work. let me know where do i send them.

Hope this will help and support for you all to investigate on behalf of us. Please let us know if you need any additional information’s.

      Sincerely,

      Regards,

      **** ******
