Sold my *** to Subaru on 4/01/23. I was told it would take a week for me to get my check. I called in on Thursday April 6th to check on the status because the vehicle was listed for sale. I was then told they listed the car to secure potiental buyers. I was told Id have a check in 2-3 weeks now. On 4/14/23 I received notice from ***** (my lien holder) stating they had released my lien and requested DMV send the title out. The letter was dated for 4/07/23. 4/14/23 I called CMA and spoke with the same sales rep who stated they had not gotten the title but had sold my car. I was told Id need to call back when the sales manager was in. I called 4/15/23 and spoke with the sales manager who did not care that I was upset my car had been sold and I had not been paid. *** (sales manager) told me I needed to be patient and wait and that this person could legally drive my car with no title for up to 30days and there was nothing I could do about it. I was also hung up on when I got upset at the fact that I have not been compensated and the vehicle has now been sold and now ***** says I may be paid in another week or two. This is unacceptable, I now have no vehicle and compensation for the vehicle I sold.Business response

We agreed to purchase a 2022 Subaru *** from ************************* on Saturday 4/15/23. We sent electronic payment to her lienholder on 4/17/2023.************************* was told ,she would get her equity balance check once title was received from her lienholder. She also was informed on numerous occasions this process could take a week or up to 30 days in some instances. She signed all required documents to transfer her ownership to us. Once we took procession and agreed to payoff her vehicle--which we did next business day. The vehicle is no longer hers. Acting as a licensed State of Virginia dealer we are allowed and is common practice to resale a vehicle as "TITLE ATTACHED" which in layman terms means we are selling the vehicle awaiting the title to arrive from a lender or out of state DMV.The title arrived to us via USPS on 4/15.We issued at check the next business day to ************************* on 4/17.She picked up the check and cashed it clearing our account on 4/17. ************************* made several threating demanding calls during this process. Which had been fully explained to her. She rants regarding our sale of the *** but doesn`t seem to understand the vehicle was ours once we entered into the sale agreement and payed off her vehicle.
I have attached a copy of the electronic payoff ,refund check in which she cashed on 4/17 showing her endorsement.We have no idea why she is claiming to be owed anything.
We considered this matter resolved.
