      This company came to my residence in October 2020. They presented a free roof inspection with the opportunity to file for storm damage if repairs were needed. The inspections showed I did have damage that should be covered by my insurance. I decided to move forward with the project and was told it should be finished before winter weather issues. I gave them a check for my deductible ($2500) and my insurance check ( unendorsed). I was told they would not start my project without ALL monies upfront. I was not willing to endorse payment on my insurance check until the work was done.OR, as a compromise, I was willing to endorse on the start date. I was not comfortable with full payment upfront. I found another company to complete my roof with 1/2 upfront and the balance on completion.I informed the owner that I would not be continuing with his company for my roof replacement service and requested a refund.He refused any refund or portion of my $2500.

      We met with this homeowner on October 10th, 2020. We inspected her property that day and found storm damage on her roof from the recent storm. She signed a contract with us to install her new roof once the insurance company approved her roof. Her roof was approved by the insurance company on October 26th, 2020.

      Right after the contract was signed, we start incurring hard costs. For example: Satellite imagery. We use satellite imagery of her roof structure to verify all measurements. This is used for several different things. One being the verify the measurements by the insurance company are correct. Many other hard costs happen right after the contract is signed as well.
      According to the terms in the contract, three things needed to happen before the roof could be installed. 1) The deductible needed to be paid. 2) The *** (deposit the insurance company gives to do the work). 3) the color and style of shingles need to be selected.

      She paid her deductible on November 9th and selected the color of her roof that day as well. Work ordered were prepared, supplier verified roofing materials. The only thing needed to install the roof was the ACV monies (monies given to the homeowner for the deposit).

      November23rd, 2020, she gave us the ACV check. Some insurance companies make this check out to the homeowner and their mortgage company. When this occurs, the check needs to be mailed off to the mortgage company for them to endorse. The mortgage company requires a lot of paperwork and documents from us i.e. our Contractors License. We mailed the check to the mortgage company with all the proper paperwork. The only thing required is for this check to be endorsed and sent back to us.

      The mortgage company would not endorse the check without the homeowners loan number. We called and emailed the homeowner several times each week requesting the loan number. We tried to contact the homeowner for months. She did not respond.

      Finally, the homeowner responded to us in May 2021. She said she was ready to do her roof now.

      The check the mortgage company had was now voided because there was an expiration date on it. We had the insurance company issue a new check. Homeowner gave us this new check on June 9th, 2021. This time she gave the loan number.

      The mortgage company sent the check to the homeowner instead of to us. At this point the homeowner stopped responding to us and we once again were in the cycle of calling her and emailing her.

      Finally, she responded to us and once again said she was ready to install her roof. This time she said she wanted it to be installed right away. During this conversation she said she cashed the check that was sent to her and was not going to give us the money to install the roof. Tying to find a happy middle ground to install her roof we all agreed she would pay only $1,000 of the check and keep the rest until the project was complete. She agreed to pay that the next day.

      Once again there was zero response from her.

      Every date, time, document, etc. is documented in our CRM system if any additional information is needed.

      The result was she breached the contract we all signed and agreed to. Currently we have decided not to pursue legal action against this homeowner for breaching the contact. This does not mean we will not pursue legal action against this homeowner in the future .
