We are building a house and the contractor (***********************) to build the staircase in our new home said the project would take 120 hours to complete at a rate of $50/hour plus materials. We agreed to that and on 1/9/23 and He started ordering parts for the stairs on our hardware store account. On 1/20/23 we paid him $3000 for (50%) of the agreed upon 120 hours of work. On 2/25/23 (5 weeks later) ***** still had not finished the stairs and we requested that he stop working on them and leave because we had subcontractors waiting. ***** said he just needed a little more time and that he wouldn't go over 120 hours and would be done by 3/3/23. We completed payment of his 120hrs of work (totaling $6,000) on 3/10/23. ***** did not finish the staircase. On 3/14/23 he stated he was at his 120 hours. After that last day we verbally confirmed that we were all settled up and he said "yes" except for a few small materials that he would send us the receipts for and we agreed that was no problem. Two weeks later (March 28th) we got a bill for an ADDITIONAL 40 hours of his work. When we asked for a detailed invoice and hours explaining where this claimed time was from, he refused to produce any details or email us back. At one point we did finally have a phone conversation where he said that he had "volunteered " those supposed hours because he thought we couldn't afford it at the time (which was NEVER talked about/mentioned or agreed upon) but was now billing us for. We sent him two follow up emails again requesting more information from the invoice he sent us, and he refused to send any information or correspond with us. July 4th, he emailed us to state he would be putting a lien on our house because we had not paid his bill. HE NEVER EVEN FINISHED THE STAIRS AFTER THREE MONTHS. My husband finished them on his own. And this guy is now putting a lien on our new home. We just want him to drop the bogus 40-hour additional bill and not put a lien on our home.
