I purchased a 2021 Case F321 Loader from **** at Jackson Enterprises on 8/22/23. I used the machine very little the next few months, only putting 17 hours on it. In January of 2024, the loader broke down and displayed a code. I brought it to a local repair shop who told me they could not help me because that looks like a foreign machine. I then brought it to Monroe Tractor in ********, a Case Dealership, who connected it to their computer and confirmed that it is a grey market machine and support is not available in the ** as it was built for Europe. A Case representative was contacted and stated that **************** cannot even assist in obtaining information on the machine as it was set up specifically for the European market. This country cannot access any service documentation, specs or even technical assistance. I have a letter from this dealer stating all of the above. This machine currently does not run and will not run until these codes can be cleared; therefore it is completely useless in the ***Many exchanges took place between **** and myself regarding this machine. He wanted to charge me for a rental fee for the time I had it. I had to haul it 3 hours to and from ******** to be told this machine is useless. After threatening legal action, I finally settled with him on a refund of $64,000 because a lawyer will cost more, but he didnt like that I had threatened legal action so now refuses to go good on the offer of $64,000.

      ****,

Jackson Enterprises try's very hard for customer satisfaction, and we try to make every customer happy!
I am sorry about your experience! Unfortunately the used equipment we sell is as is where is equitment, I understand the situation you are and and I tried to make it right with you with offering a resolution for us to buy back the loader. I also didn't like the fact that you were threatening us with lawyers. Therefore the issue was never resolved!
      Thank you,

      Levi Jackson

Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as ************************************************************ still has not offered a resolution regarding this complaint.  I have been sold a $69,000 piece of equipment that quit running after 18 hours of operation and cannot be fixed in the **************  It is completely useless in the U.S.  I understand this was an "as-is" sale; however this particular set of circumstances qualifies as fraud as it was deceptive in nature.  ********s are protected by the FTC's ****** of ******** Protection.  I did threaten legal action because I was not offered a full refund.  If Jackson Enterprises was sold this piece of equipment fraudulently as well, they too can seek full refund.  It does not make sense for either party to pay a $10,000 retainer to a lawyer if it can be settled outside of court.

Businesses and Customers should be civil, courteous and polite in their responses to complaints. It is important to remain professional and productive when participating in the BBB complaint process.
