1. In *************, via the internet and working through the Traveling Bohemian website, we made a reservation for a flat in ******** offered by the defendant through Airbnb for Saturday, March 12 and Sunday, March ****. On Tuesday, March 8, only one day after the total refund period expired, we contacted the host to ask about cancelling because a major snowstorm was predicted for March 12 and authorities recommended not traveling. This had not been predicted earlier and we contacted the host as soon as we saw the predictions. He responded by saying that the storm would be less than seven inches and passable. (See attachment 1)3. The ************************ warned repeatedly that the storm would be far more dangerous than that and that conditions would be impassable in places. The *** advised against travel. (See Attachment 2)4. We asked numerous times to cancel for that weekend without penalty or to postpone our reservation until the weekend of April 9.5. After multiple back and forths, the host told us he could not cancel and reschedule, and we should talk to AirBnB. AirBnB said they couldn't do it; the host had to.6. Beyond being an unfair practice to deny us a full refund in its own right, this claim is explicitly bolstered by the Extenuating Circumstances Policy of AirbnB. That policy says that it does not cover extreme weather events in North America (including *******), but only from December through February (emphasis added). It is our position that your failure to give us a full refund or allow us to postpone our visit for a month constitutes unfair or deceptive acts or practices declared unlawful by Section 2 of Chapter 93A of ************* law and other state and federal statutes as well as the common law.Customer response
