      I contracted Mr. ***** ******************** to install a new drain field at my home. As stated in the contract, the job was to "Clearing/Hauling/Disposal of ********** Area" and installing a new drainfield. Clearing the drainfield area included removal of approximately 16 trees and their respective stumps. During a visit to the worksite prior to work commencing, Mr. ******************** and I discussed the proximity of one of the larger stumps to the proximity of my property lines and the neighbors utility service lines. Mr ******************** stated at that time that "removal of the ***** with an excavator might damage the neighbors utility lines so he would talk to a friend about grinding that one ***** out. The job is now complete except for removal of that *****. Mr ******************** now states that removal of that ***** is my responsibility because "***** grinding is not part of the contract". I can not plant a new lawn in my front yard until the ***** is removed. Mr ******************** is also demanding payment of the remaining $10,226.30 of the contract or assessment of a 1.5% per month finance charge.

      I Have Had Several Conversations With ***************************** Regarding The ***** Grinding Not Part Of The Proposal For His Clearing Of The Drain field Area.

      He Came Into Our Office On Monday 04/01/2024 To Pay The Remaining Balance Due On The Clearing & Installation Of The Drain field.

      At That Time He Also Stated That The The Conversation Between Himself & Daryl  At The Time Was Not Confirmed Or Clarified If That Was Part Of Our Proposal.

      Currently We Are Getting A ***** **************** Out To His Property To Grind The ***** Down And We Will Have A Separate Conversation Regarding The Cost Of That Service.

      I am rejecting this response because: It is true that the original contract did not specify grinding. The original contract was to remove all of the trees and ALL of the stumps.  It did not specify how they were to be removed.  The contract has not been changed nor was there any mention of additional cost, therefore, I expect the ***** to be removed without additional cost as agreed upon in the original contract.

      Again, When ***** Walked The Site With ***** He Stated He Would Take Down The Tree, But The Grinding Of The ***** *** His Responsibility.

      The ***** *** Grinded Down Via A Hired Contractor By Us And The Bill *** Sent To My Office For Payment.

      I am rejecting this response because:  The statement made by the business is incorrect.  When walking the site, ***** Hemley stated that he would "talk to his friend about grinding the ***** out.   He DID NOT say that it was my responsibility to have the ***** removed.  The ***** has been removed and I have not been billed nor do I expect to be billed for removal.  If I am not billed, then I am satisfied that the matter has been resolved.
