      ************************* was no professional when it came to being my realtor.1) I paid $13,000 for my fence prior to closing. ****** pressured/bullied me into accepting verbal commitments for it to be done after closing. These commitments were between my realtor, ******, who is the boss of selling realtor, ****. Who in turn is the wife to builder, ***. They all knew each other... And this cost me the correct fence that was never installed properly. *reason the complaint is past a year: is because I tried for 6 mths to request install with builder, but no luck. I also tried for 7 mths (& $10,000) to get legal help for install. These both failed to get the fence done due to ****** allowing a verbal commitment instead of written and/or her not requesting my $13,000 payment to be refunded to me at closing due to work not completed. It was her responsibility to provide me with accurate and honest information and she did not. ****** also allowed other items to stand as verbals at time of closing: Road Maintenance Agreement not completed (I paid attorney to request); home warranty was not in my name (only to find out after closing warranty did not provide ANY fixes to house for seller; roof and septic both failed in 1st year); and 11 month walk through for new builds was refused (had to pay attorney and prove).2) ****** highly recommended/referred me to companies that were awful. Her recommended movers cost $5,000 and I had to provide the truck. The employee's stole from me, broke things, stacked boxes that fell, failed to complete job, and made unwanted sexually threatening remarks to me. Her loan officer messed up the paperwork, costing hundreds.My other property she sold, she hired her own contractor who did $41,000 fixes which included re-purchasing items already provided (lighting for entire upstairs), fixing items with no damage (replaced all toilets in house & unnecessary flooring), and even broke a window and tried to hide it.I want the fence 1 acre at her cost.

      I am providing proof to support my email to BBB, 13 pages total.



      The Road Maintenance Agreement was not complete before closing (subject to 'Merger Doctrine' later discussed*). 
      The Home Warranty info was not completed before closing (due to this, I was unaware the warranty FIXES NOTHING!, it's only for the builder not the buyer). 
      The 11 month walk through was only a verbal agreement (I later had to pay an attorney to prove this was to be done). 
      I'm including proof ****** agreed the Legal Addendum was for the fence to be 1 ACRE (the rest of the email has no legal significance). 
      The ********* Addendum states 1 acre fenced, and 2nd Addendum states the cost $13,260 for fence, both included below.
      Proof of the closing date to show that items were not complete by the date of 3/15/22. 
      Proof ****** knew the fence was to be installed AFTER CLOSING, 2x emails provided (subject to 'Merger Doctrine'*).


      *The 'Merger Doctrine' states that for real estate sales, all agreements prior to closing, will at the time of closing be merged together and end. For example, the fence was part of a real estate sale and an agreed upon item. But once closing documents were signed, the agreement for the fence was no longer valid. All prior commitments are legally lost when closing papers are signed.
      This is one reason you hire a realtor, to back your finances and make wise legal decisions that as a buyer you may not know or understand. A realtor should know the paperwork, and know the best course of action for the buyer. In the case of the fence being paid for, but not installed prior to closing, new documentation should have been drawn up by ****** and signed by both parties to be sure my money was not lost. At a bare minimum, I should have been refunded for the fence that was not done at time of closing. It is the realtor's professional duty to be sure paperwork is handled correctly, and ****** failed me greatly. She not only failed to provide new paperwork to keep my money safe, she also failed to get me a refund or be sure the work was done correctly.


      The fence was not done correctly. ******'s email shows she agreed the fence was installed wrong.
      Due to wet lands on my property, I've included proof from Pierce County the fence can be extended and a map to show where those areas are.

      Hello *****,

      I appreciate you calling me back to discuss this matter before I make a formal response.  I apologize for not getting back to you right away as I was out of town since your call.

      I wanted to talk to you about the best way to handle this complaint in your opinion, because I have hundreds of pages of emails and text messages related to the real estate transactions involving **************** and my firm, Infinity Real Estate.  I can assure you that everyone involved with ****************, including myself, the builder, and the two agents at my firm (one who initially represented her, the other represented the builder) and all the contractors and vendors did their absolute level best to make her happy at every point.  We go above and beyond for our clients, and the hundreds and hundreds of reviews that are available from various sources online are testments to that.  **************** was no exception.  Everyone went above and beyond for her under very challenging circumstances.   

      My firm only got involved by directly representing her after she fired the original realtors she hired.  She insisted on wanting to purchase the ******* home and insisted on working directly with our firm.  *********************** initially represented her and did an amazing job trying to meet her needs, but **************** became verbally abusive and combative to ****** in the same manner as she had the previous brokers.  Both the Seller/Builder and **************** wanted the sale to proceed to Closing so I stepped in to assist in getting it closed and then to sell her Tacoma home. 

      ****************, as we now know, has a long history of making these types of complaints and accusations against others without being willing to take personal responsibility for her actions.  They extend far beyond BBB complaints and attempts to file suit, they include criminal proceedings against her which I became aware of during the course of these transactions.  With my understanding of her history, I do not want to escalate this situation any further.

      Her primary issue in this complaint is the chain link fence that was installed after the closing.  This took place at the height of the supply chain disruption and there was no way the fence could be installed before Closing.  She had to close and move ASAP due to the criminal proceedings referenced above that involved her neighbor in Tacoma so it was agreed that the fence would be installed later.  

      What she fails to recognize (including in the redacted documents she provided) was that a schematic drawing of the fence was provided to her along with the pricing for 495 linear feet of fencing - all of which she acknowledged and agreed to per the email I attached.  (Before my direct involvement)  After closing, 495 ft of fencing was installed according to the drawing and then she got mad.  She wanted the full acre of her property fenced.  In the original contract negotiations it was noted that the builder would provide pricing for approximately an acre of fencing, that is true, but that is not what the parties agreed upon after.  Since Closing, the builder has tried and tried to work with her and resolve her complaints.  He told her from the start he would install more fencing at her cost because what was installed was agreed upon and this is only a fraction of what has transpired, most of which I had no idea about until very recently because her claim was against him. 

      I truly do have empathy for her because she feels she has been wronged, but I will not agree to paying her any money or engaging her any way because she has already treated me, my staff, and all of the kind and gracious vendors who have tried selflessly to assist her with utter disrespect.
