      I came to a contract agreement with this business, August 16, 2020. The contract was for an approx 320 sq ft ADU, attached, altering an existing garage. The contractor has not fulfilled the contract. There has been a long list of contractor-negligent delays, as well as the contractor refusing to fix defects, or complete the work. I have paid an initial 40% deposit, and a partial progress payment. We agreed that the progress payment would be partial, because the contractor had still not completed essential work. An example is that the shear wall inspection has failed twice, and been canceled three times. At this time the building is framed, sided, has rough in plumbing, rough in electrical, a door and concrete floor. Over a year later, there is no way I can progress the project to an occupied state, because the contractor has not fulfilled their portion. This is also causing me a housing security issue. I am living out of a motorhome, and winter is approaching. I want a billing adjustment, a partial refund, to be excused from the contract, and for the business to continue to guarantee their completed work for a full six months from October 12th 2021.       We were contracted last August to build out a garage conversion. However, it was adding a second story to the garage. Despite the small square footage, it required moving an electrical mast and cutting off her power. After working with ************* they had said they were 12 weeks out from being able to disconnect and reconnect power for a project like this. Since the entire roof and structure would have to be opened, 12 weeks would have put this in December. We decided cutting her power and removing her roof in the dead of winter wasn't the best idea. Permits were originally handled by ******************. Original sets of plans were put through permitting and permitted by ******************. Then after signing the contract, ****************** decided to make structural changes with her architect, specifically regarding windows and door sizing. In April, we provided estimates for the windows that her architect had put on the plans. The price being disagreeable to ******************, she decided again to make structural changes. When the Shearwall inspection came along, the inspector noted these changes as well as requesting an engineers letter for the way the t1-11 siding was installed over dens glas. When we requested a letter from our engineer, he requested the structural calculations that were originally done with the project. He found that the original architect used generic shearwall schedules and didn't perform the lateral shear analysis that would have been required by permitting. He concluded that the engineering on this project was actually not performed and there was missing hold downs required as well as interior plywood sheathing needed. We sent ****************** a change order for this. She rejected the change order despite our safety and structural concerns. We will not be letting ****************** out of the contract as we don't see ignoring a safety concern to be a good reason to be let out of a contract. Her progress payment was supposed to be $17,000. She wrote a check for $10,000 instead. Citing delays and negligence. However, in September, she ordered windows after disagreeing with our window pricing and those windows had a lead time of 11 weeks. 

       

      The delays on the project have been due to numerous changes from ******************. We offered to pay for a hotel due to a small delay from changing a framer due to them being unreliable. We will be rescinding this offer.  This delay was only a week. 

       

      We also have documentation of our claims. Text exchanges as well as an engineers letter proving that her architect didn't perform necessary structural analysis and after ****************** made structural changes, refuses to perform a field revision through permitting.  She has paid less than half of our contract price, despite 900% of the project being completed. We have retained council and will likely be suing ****************** as she continues to refuse the structural concerns we have. .

      I am rejecting this response because: BHS has provided an inaccurate and incomplete account of their refusals and negligence. BHS has neglected to send receipts, proof of costs to date, remedy of confirmed siding defects originating with BHS mistakes in installation, plumbing connection and gave my home key code to a subcontractor who proceeded to enter the occupied residence without client knowledge or permission causing fear and trauma to the additional female resident.
