I signed a 12 month contract with them for my son to take karate classes. In November of ********************************************************************************************************************************************************** August 2022instead of July 2022. Now that we have come to the end of our contract they are trying to say we owe them for November 21 and December 21 and I have bank records proving that the amount was paid for December 21 tuition. For some reason they are saying that they don't have it on their end. I'm not the first parent to say that they have felt conned or betrayed by this company.

Regarding the martial arts membership provided by ****************************** DBA Two Dragons Karate to ************************************ for her son *******

On 7/14/21 Mrs. **************** enrolled her son by signing a **************** Legal enrollment agreement (contract for services) which stipulates she agreed to pay 12 MONTHLY PAYMENTS of $205.85 for a total of $2470.20 via electronic payment (EFT) on or before the 5th of every month. The contract stipulates default will take place if any payment is missed. Not only did we work with Mrs. **************** with regards to her missed payments, we also gave special attention and provided extra classes for her child due to his challenging behavior at home and in school.

The following is the log of her payment history.

Enrolled July 14th 2021 with no tuition payment made that day.

Her 1st payment was due (according to the contract) on 8/5/21. It was not! it was however paid on 8/16/21  (PAYMENT #1) with September's (PAYMENT #2) & October's (PAYMENT #3) payments being paid but also late. NO PAYMENT WAS MADE IN NOVEMBER OR DECEMBER! This created a legal default status however in trying to do our part to help the child we let it slip. The next payment was made January 26th (PAYMENT #4) February (PAYMENT #5) March (PAYMENT #6) April (PAYMENT #7) and ***** payments (PAYMENT #8) were made (ALL LATE) she was back to her old pattern of non sufficient funds status in her account however made a phone payment on June 23rd (PAYMENT #9) and finally made the last payment she would make on July 27th (PAYMENT #**).

*************** ***** genuine owes not only for the last two payments, she will owe collection fees, late fees (for all late payments as per her enrollment agreement) as well as any associated service fees that are accrued.

I believe that she is confused regarding information her bank is providing her as I have seen this before. She claims that her bank shows a payment. it does not, rather it shows a draft attempt not a payment made..

In this case the client is in default and going to collections if both owed payments are not made ($411.70) in full by 8/30/22.

      Complaint: 17679812

I am rejecting this response because:

im not exactly sure how someone can say that a bank statement isn't proof. i have sent *************** and Soke a copy of my entire bank statement that shows there was a payment made on January 14th, 2022 and on January 27th, 2022 and i have also attached text messaged between *************** and I stating that my account was  caught up and in good standing as of January 14th, 2022. how would this be if i didnt make Januarys payment until January 27th? I believe at this point this company is going to fight this tooth and nail even though they know that they messed up somewhere and because of their pride they refuse to admit there was a mistake and they refuse to fix it. And even tho i have proof showing that *************** acknowledged that December's tuitions fees were paid on January 14th, they will not accept they are wrong. I am needing additional help in getting this taken care of and have reached out to other parties to be sure that this is resolved.

      Sincerely,

      *******************************

******************* refused to discontinue my contract after a death in the family made attendance and payment impossible. Also called me a s*** for not being able to pay.

      Business response

      07/27/2022

      Hello,

Two Dragons Karate follows **************** RCW and all the laws and guidelines set forth by our elected representatives.

In this case, even if the client had provided proof of the claims made, the reason for the request to cancel the program is not a legitimate or a "legal" reason to not pay for what they bought.

Since this complaint has been filed, the client cancelled their contracted monthly payment which in turn is a violation of their membership agreement (**************** legal contract) and initiates the acceleration clause. This means legally they now owe the entire balance plus all fees. In this situation the balance of the debt gets turned over to a collection company which adds all service, collection and legal fees which in turn will be reported to all three credit bureaus.

During my last conversation with this client, she was requesting nothing. She simply wanted to complain directly to me while I was teaching. Yes after being interrupted three consecutive times I did end the conversation as my responsibilities were, at that time, to the paying clients and students on the floor. After which I have a recorded log of 22 harassing phone calls made to my business directly from their phone number.

Had the conversation been respectful and productive I would have offered a 1/2 settlement offer but we never got there as some people think that being abusive to our staff on the phone is a tactic that is helpful to their cause. It is not!

Even in this complaint there is no request for any action.

We at Two Dragons understand that martial arts training takes perseverance and dedication. Sometimes people are willing to say anything to get out of paying what they owe and legally must pay. I believe this is the situation in this case.

In closing, I thank all involved for their time and look forward to having a honest and productive conversation with anyone involved.
