I hired Eddie M**** Co on October 25,2021 to remodel my bathroom that had already been demo'd and the hole was already cut out for the window. November 8th he started working. November 11th I gave him $9,000 for a deposit that he asked for (he insisted in cash) November 18th I came home to my marble tiles tossed around in the garage along with my belongings. I called to ask him what happened and he said "are you calling to chew me out?" I said no, I'm calling to see what happened since there were tiles broken. He said "you're interrupting my afternoon". November 21st I left for vacation and double checked with him as to what hours he was going to be there to let my pet sitter know. He said 7:00 a.m. to 2:00 p.m. I asked him to let me know if he wasn't coming which was agreed upon in our interview and other texts. November 22nd he took his tools from my house and hasn't been back since. He didn't call, text, e-mail, or leave a note as to why. He didn't leave the deposit or put things back the way they were so the house wouldn't get water damage. He didn't even put the door back on and there's tons of air coming through since he didn't caulk the window. I could only guess that he quit so I sent him two emails now to resolve this and he won't make an appointment with me. I'm afraid he's not planning on refunding my deposit even though he's only put a window in that isn't complete. Here is what I wrote him: Hi Eddie, This is my second attempt reaching out to you to obtain the refund of cash deposit I gave you as advance compensation for services to be performed on my home. I would like you to finish the work that you have started, but unfortunately, because you have not been working on the project for two weeks and have failed to provide me with any explanation or to respond to my inquiries, I have no choice but to terminate our relationship and hire another contractor. He hasn't responded to my emails nor refunded any part of my deposit.Business response

Due per your emails please respond to the email done on 11/29, that explains everything to me,
The schedule had to change due to the unforeseen conditions you never showed me, such as the plumbing and electrical both. You said you had to pay higher insurance because of your electrical, which set off a red flag to me right away. As far as, plumbing, also, I don’t know who did your plumbing, but it was incorrect and you need an ejector pump added or you’re going to need to redo your stack, something else you didn’t show me as we came onto the job.
They call my tools hand tools and we carry those all the time because that’s what we use to make our living basically, and with you being on vacation, not giving me a contact number for the person that was staying there, I thought it was necessary for me to take my tools because I’m sure my insurance wouldn’t have covered it if there was a break in in your neighborhood.
Permitting your job just must happen. You explained to me that you paid higher insurance because of your house’s age which would require a building permit for me and the subcontractors permitting, once I heard that I knew it had to be done because I did not want to do anything illegal in your home. As a contractor I can’t afford to do anything illegal.
As far as cash that yes, I insisted on, that is true because you didn’t want to pay sales tax and you told me that. Now understand something, I put the sales tax in my quote because you wouldn’t even see if I paid it or not. But sales tax is going to be paid on your $9000 down payment to me.
At first you did not want permits and I went along with it and then thinking right away, no we should do permits, and you agreed that was a good idea. In Seattle they follow the building permits all the way through so as a General Contractor I needed to have one to, just an over-the-counter permit for me. There’s nothing structural that we did in that home.
You had mentioned also in several emails that I had quit. I cannot find anywhere where I said that I had quit. And I ask you, again, please follow up on email sent 11/29. Again, I have not lost any interest in your project. It’s ready to go right now. You have to make some decisions and you need to respond to me to get the measurements correct, the placement of your faucet, canned lights in the ceiling, etc.
The payment that you did make to me was a down payment, not a deposit. Per your demand, your letter of demand is rejected by me. I needed to wait for your return to continue work. The job is ready to go right now because it was ready to go. You need to take some responsibility; we need to get a cover inspection on it if that’s what you want. But you terminated me

He’s lying in his response, do I need to point everything out that he’s being dishonest about? He’s not admitting that I asked if the electrician was licensed and he said “he never asked”. He never spoke to me about permits. He never told me he wasn’t coming back after I confirmed with him to get as much done as possible to stay on schedule. It’s not my job to point out plumbing and electrical since I’m the home owner and he’s the person who I’m hired to know what to do. There were no unforeseen things that he’s saying. Everything was exposed since it was demoed and the drywall was cut open where the plumbing was. How could he not see what needed to be done? That’s an excuse. I now have hired another company and they didn’t need me to point out the plumbing and electrical because it was all there. They are professionals and knew what to look for, unlike Eddie M****.
