On June 16, 2022, a gentleman named ************************* from Sierra Santa Fe, backed into my front yard ****** with heavy machinery destroying seven 30-year-old arborvitae. Attached are some pictures I collected on the day of the incident. My address is *****************************************************************************. **** was working a contract for the *****************, ** to chipseal the road I live on. I have reached out to the ***************** to report the incident and was told to request restitution from Sierra Santa Fe. I obtained a quote from a local landscaper for repairs which came out to $2,228.30 (attached quote). The force of the impact uprooted the plants which now need to be replaced.Business response

The Complainant is not our customer, but a resident of the *****************. The arborvitae were not backed into by the heavy machinery but a large branch that was in the public roadway was snagged by the side of the machine and broken off. Per our contract with the city we were required to chip seal from edge to edge of the public roadway.
The failure to maintain the arborvitae caused an obstruction in direct violation of the of the ********* Municipal Code Section 5.56.210.
5.56.210: - Miscellaneous Obstructions.
(1) No obstruction may be placed in any public way which impedes, or inconveniences travel except for approved traffic control devices (see Section 5.56.150).
(2) No garbage cans, leaves, grass clippings, prunings, other debris, or obstructions may be deposited on any public street, walkway, path, public utility easement, lane, or alley. Burning of any debris on improved roadway or sidewalk surfaces is prohibited.

I have attached an email between the complainant and the ***************** project engineer stating that the bushes were in fact in the right-of-way.
The complainant first issued a $600 cash demand for one damaged ****, which he said was an estimate from his landscaper, but upon request of said estimate, the damage had escalated to the $2,228.30 quote for a replacement of all of the bushes.
Each time the complainant has not received his desired result he has continued to attempt to threaten and escalate in order to receive "compensation" for damages on a property that he is 1. Not the property owner and 2. In violation of ********* Municipal Code Section 5.56.210 and is ultimately the actual property owner's (his new wife) responsibility to maintain.
In closing, I would like to reiterate that he is not a consumer or a customer of ********************** and does not meet the Better Business Bureaus criteria for filing a complaint.
