      On 7/4/21 I signed 12 month membership agreement with this club (our child has respiratory issues, so we wanted his health to improve by exercising at this club); $169/month. A few months later COVID came and requirement for mask wearing and vaccination/testing. On 11/3/21 I spoke to the club and was told that members must wear masks and have vaccine card or test done within 72 hrs. These requirements did not work for our son. Club allowed "freeze agreement" for 3 month til 1/4/22 (promised no charges). On 12/10/21 I spoke to the club and we agreed to another 3 month "freeze". I submitted freeze form on 12/10/21 for 3 month (til 5/4/22). On 1/4/21 I was charged $169. There was no response to my phone inquiries, so I requested an attorney to help me. On 1/6/22 attorney sent the club letter asking to refund money and advising that The Attorney General issued guidance allowing customers to cancel their membership at any time, for any reason, due to global pandemic; this letter served as written request for membership termination. The club responded stating they will not terminate the membership, but refunded $169 they took from my account on 1/4/22. I contacted the bank asking not to allow any charges to this company. Club attempted every months to charge me $169, but unsuccessfully. On 5/4/23 $169 charge went through. Now my bank is disputing the charge. I am begging for assistance: can you pls help me to resolve the issue? If Attorney General allowed customers to cancel membership with gyms and fitness due to global pandemic at any time and for any reason, why the Club is not honoring The Attorney's General *********, did not terminate our membership as it was asked by an attorney in writing, and, keep charging my bank without our authorization after we told them we are cancelling the membership due to pandemic and child's medical issues. I have lots of written communication between myself and club, including agreement and the attorney's letter. thank you kindly.

      This email is in response to your email to us of 6/13/2023.

       

      As a response to your email, I am attaching the emailed response that we sent to *****************************, with whom ********************************** initially hired with the same complaint that was just filed with your office.

       

      The response in our email will clearly show that we were 100% in compliance with all State mandates and that this complaint is actually about Viginta ************* wanting to cancel an agreement without having fully complied with the terms of that agreement. We see that ********************************** already submitted most of the pertinent documentation regarding her complaint. Our response to ***************************** should answer all of the points brought up in the complaint. ***************************** found no further cause to pursue ********************** complaint. After ***************************** found no cause to move forward, she called us back and tried to give us a different excuse for wanting to cancel her membership; namely, that her children moved away and that she was too sad to complete the terms of her membership agreement.

       

      We believe that you will come to the same conclusion that ***************************** did after receipt of our answer.
