      On 11/16/2022 a deposit was placed for a puppy on the company's website. This was after three phone conversations were had about the nature of the puppy and the requirements we were seeking in a pet. All conversations were had with *************************** and at no time did she state our requirements were in conflict with the actual nature of the puppy in question. The website also stated no conflict with our requirements.After the deposit was paid we requested an up to date picture of the puppy as we were excited to adopt a pet. At this time ***** texted us saying the nature of the puppy was different and she offered us a discount on other puppies or a full refund of the deposit. We accepted the offer of a full refund and then she began sending us a series of bizarre texts that skirted around the issue of her providing a refund. This went on for over a day.We contacted ***** via phone on 11/20 in an attempt to amicably resolve the situation and requested that the phone call be documented. ******************* up on me. ***** has also declined to involve her business partner *********************************** or her attorney. As of 11/21 an email pursuant to legal action has been send to Pugent Sound Doodles as the refund has not been provided.

      We were contacted by ***************************** about a puppy adoption. ***************************** had one and only criteria with regard to the adoption the appearance of the puppy. ***************************** expressed interest in a puppy posted on our website and we agreed to show him said puppy. That being said, the puppy he was interested in was very young and it had not yet developed its furnishings. All puppies are born without furnishings and they develop over time. Given ***************************** only criteria of how the dog looked, we encouraged him to view other puppies who had already developed furnishings as to insure his single criteria was met. We agreed to show him four puppies to include the young puppy he had selected and three others with already developed furnishings. We further agreed that after viewing the puppies that if ***************************** decided none of them were good looking enough for him that we would issue a refund. ***************************** did not attend his appointment. We groomed all four of the puppies and waited for him but he did not show up. As posted at our website, the reservation fee is not refundable but it is transferrable. We are prepared to honor the reservation fee paid by ***************************** and we are willing to schedule him a second appointment to view puppies.

      I am rejecting this response because it does not reflect the facts of the engagement with PSD and the business is capriciously removing their offer of a full refund.

      Multiple factors were considered when determining what type of dog to adopt.  For the Bernedoodle breed some of these were that the dog was non-shedding and that it be furnished.  Both requirements were expressed to *************************** in 3 phone calls prior to placing a deposit.  *************************** led us to believe that Peep satisfied these requirements, which induced us to place the deposit for the specific dog along with statements made on the website.  Note we did not place a deposit against a pool of adoption options but specifically for the dog named Peep.  This was confirmed by *************************** via text message.

      After placing the deposit we requested an up-to-date photo of the dog to understand her size so that we would be able to prepare our home for the adoption.  *************************** to date has not provided this photo.  Upon receiving this message, she informed us the dog did not meet the requirements and offered a full refund.  At this time, we accepted the offer of a refund and informed her we were cancelling our appointment for the following day.  Her response was to reject our appointment cancellation and withdrew the offer of a refund.  When seeking to resolve the issue she denied us contact with co-owner *********************************** referring to her as a junior assistant.  She subsequently accused us of being in breach of contract for not attending our appointment.  Now we are being blamed for not attending an appointment when it is clear *************************** did not inform her business partner of the appointment cancellation made the day prior.  This is documented in the attached text message export.

      The narrative offered as a reply to this dispute does not reflect the facts in the attached text message export with ****************************  In my opinion PSD has been unable to consistently honor agreements: a dog is represented one way and then that representation changes, refunds are offered and then denied, claims of voided contracts have been made and then they are made whole again.  Resolving this by furthering a business relationship with PSD and adopting a different dog exposes myself only to more risk of PSD failing to meet obligations.

      In December 2021 I wrote *************************** and asked if she thought she would have an F1 bernedoodle available in May. She said she would, so I placed a $1030.00 deposit. In April I checked back to make sure we were still on track (since puppies should be born about then) and she confirmed that we would have first pick of her F1 puppies that were ready to go home in June.When I checked back in late May she said we were still on track. On June 7 I became worried that we would miss our window for getting the puppy during our summer vacation since we still hadnt even seen the puppies (they go home at 8 weeks.) I asked if I needed to find a plan b puppy elsewhere so we wouldnt miss our chance since it was important for us to have time with the puppy before returning to school the first week of August. She reassured me that she had a puppy and showed me a litter of F2 puppies. I repeatedly reminded ***** that we had requested an F1 (1/2 Bernese mountain dog, 1/2 poodle), not an f2 (1/4 Bernese, 3/4 poodle.) ***** then showed us June (who she said was an F1 but later listed on her website as an F2.) when I said no to June she showed me Belle and said she could go home in late June but would cost extra. I agreed but when reviewing the contract saw that Belle would not be ready to go home till late July. When I realized it was not going to work out to get an F1 in May/June as requested I had no other choice but to find our puppy elsewhere. I requested a refund of my $1000 deposit since ***** didnt keep her end of our agreement and lied about the genetic makeup of the dogs. I could no longer trust her as a breeder. ***** refused to return my deposit and proceeded to send a very nasty response and accused me of running a breeding program (which I am not and can prove my dog is neutered.)Since she was unable to fulfill her end of our agreement, and then lied about their genetics, I would like to request a full refund of my deposit.

      We thank **************** for reaching out to the BBB. **************** is a repeat customer who adopted her first puppy from us in 2020 --she is famliar with our reservation fee terms and conditions.


      Per the reservation fee terms and conditions as posted on our website where **************** remitted her reservation fee, "*The reservation fee is non refundable. The fee is transferable across litters up to three times.       Given, **************** was a repeat customer we were especially accommodating to her and we spent a great deal of time across many days and weeks showing her different puppies because she was undecided. At first she wanted a male sable, then she wanted a female sable, then it was a tri color F1b, then a tri color F1. We made ALL OF THOSE PUPPIES AVAILABLE TO HER. 


      **************** eventually chose a female F1 tri color named Belle who was $6500. **************** proceeded to provide the necessary documentation for the puppy to be shipped to her to include her drivers license and preferred airport (********* International, See attached text message) and Belle was no longer advertised.


      Despite having selected a puppy, **************** subsequently, several days later, sent us a text advising of her intent to back out. (See attached text message) As it turns out, **************** had found a different female tri color puppy for $4500 so she was cancelling her purchase with us (See attached sales contract from the other breeder). Please note the puppy she purchased was a tri color female; the exact same puppy she had selected from us. 


      The real issue here is that **************** decided not to purchase the puppy from us becasue she found a cheaper one. **************** was not forthcoming about this and is instead casting blame in an attempt to obtain a refund. 

      At this point, Ms. ******* reservation fee has been transferred three times and per the terms and conditions it is now forfeit to administrative costs. Nonetheless, we will go above and extend a fourth transfer to **************** and honor the full amount of her reservation fee to any puppy of her liking to include Belle who is yet to find her forever home due to having not been advertised.

      I am rejecting this response because:

      1. In Dec. I asked the owner if she would have an F1 bernedoodle puppy available in May/ ****. She said she would so I placed a $1030.00 deposit. I continued to check in to make sure the pregnancy was on track and we would be able to get our F1 in May/****. ***** reassured me that everything was on track and to not worry. 

      2. After repeatedly assuring me that she had an F1 in ****, the owner showed me three puppies who were not available until late July or were not F1s.

      3. The first litter she showed me were a litter of F2s (75% poodle, 25% bernedoodle.) I reminded the owner that I was ONLY interested in F1 (50% Bernese mountain dog, 50% poodle) as I skijor and F1 bernedoodles are great pullers.

      4. The owner then reassured me she would have an F1 available in **** but would get in touch. 

      5. She then showed me "****" who I thought I recognized from the F2 litter and reiterated that I only wanted an F1. She later posted "****" on her website as an F2 even though she told me that **** was an F1.

      6. She then showed me "Belle" who was more expensive, but at least was an F1 puppy available in ****. I agreed and began filling out the paperwork, when I noticed her birthdate. The owner had been dishonest and Belle would not be ready to go home in **** as promised, but instead wouldn't be 8 weeks old until the end of July!

      7. I complained to ***** and she again showed me "****" (who was later confirmed to be an F2.) 

      8. I fully intended on getting an F1 from ***** in May/****, but she simply did not have one available as promised. When I asked for a return of my deposit, she refused.

      9. I then had to scramble to find a puppy from another breeder when it was clear that ***** would not be able to provide what she agreed to.

      10. Because of the dishonesty of offering F2s and saying they were F1s, and repeatedly claiming she would have an F1 in ****, which she clearly did not, I am no longer interested in purchasing future puppies from Puget Sound Doodles.
