    I entered into contract with Foothills Landscaping and irrigation LLC on 1/1/24, to build a dry stack basalt retaining wall 74 L 44 H along the front of the house, and 10 return up driveway. Another small wall by the front steps to be built. This job also included landscaping, removing old curbing, unwanted plants, removing crowned area of turf by steps, building a 6x4 patio, new curbing throughout front. New bed on south side of driveway. Relocation of existing irrigation to accommodate new layout. Installation of new drip zone with 1 automatic valve and pressure reducer set up for front yard bedding plants. Plants to have individual set **** 3 black bark on all beds. New compost topsoil over all turf areas and turf on any disturbed area on the south side. Installation of Bluegrass blend sod, rolled after installation. The owner, ***********************, was to build the retaining wall himself. He started to try and build the wall, he was doing a good job but he was busy with his other customers so only built about 5ft on the front of the wall. His workers tried to build it, but they had no experience with building this type of dry stack. It didnt look right to me, I had a retired stone ***** come out and take a look. She said it wasnt being built right, needing anchoring rocks to help stabilize it. I gave **** the feedback. His guys work on it some more. Then one day **** showed up and said that he gives up. I think he just bit off too much. He said he could just put the dirt back and charge me for what hes done! He had done nothing, but tear up my yard, the sprinklers system, and kill my large spruce tree. He was going to charge me for that! So, I suggested that I would allow him to put the option#2 that he had quoted me for a retaining block wall instead. I told him I want the original quoted *****, and he would need to get rid of the rocks. He agreed, and said that he would lose money on getting rid of the rocks, but he wanted to have a happy customer. He finally had the majority of the wall built by 4-24-24. Then I was having concrete work done and they needed to pause. The only thing that is almost done is the front retaining wall and most of the side of the driveway part. They have worked a little on the backfill, and a little on the irrigation. Now he sends me an invoice, adding on $6,800.00 for fees for removing the rocks, dirt ect including personnel hours to do so. This is not what we agreed too. In the contract it says prices include deliveries, materials, labor, equipment, and expertise unless otherwise specified and agreed upon in writing prior to commencement of work. It also states in the contract, Any price changes will be agreed upon in writing between contractor and customer prior to the commencement of work. Now he says he will knock $3,100 off and not put a lien on my house, if I sign the contract. Then he will finish the work. Otherwise he will pick up any unused materials and bill me. The original quote was for $33,880 for the entire job. The block retaining was quoted at $3600.00 less. So the cost for the entire job now should be $30,280. I have added on a couple things after the start, to make the total *********. His new estimate is $47,597.88 which is completely crazy!! I have already paid $19,400 to Foothills. He has not completed that amount of work yet, the retaining walls arent completed. They were $17,960 completed. The irrigation system is all torn up, no curbing, flowerbeds or grass. He did install new irrigation boxes, with manifolds and double check valve, new rainbird controller. Used about 8 hours of labor. This amounts to $1,502.22. If he finishes the retaining wall, installing the cap and continuing where he left off, adds the wall around the steps area. Then we would be at ********* worth of work done. I would owe him $62.22 if he didnt want to continue. I certainly dont owe him anymore. I feel he wants me to pay for his mistakes.
