      We contracted with Ampro on 30 April 2021 to build an addition to our **** home. We wanted a general contractor to get the two-story addition dried-in before the rain. Because of the increased costs, we planned to take over after the drywall and tape phase. The remodel to the existing bath and kitchen were to be phased in after the new kitchen and master bath were functional. Work began 27 May 2021, and was supposed to be substantially complete by September 2021. However, the first two phases have lasted well past the delays expected during normal construction, and even those due to the pandemic. A rough timeline illustrates our difficulties: -15 Dec. framing finished -14 Jan. existing walls opened for plumbing, adjacent tub/shower removed -21 Jan. skylights and roofing installed -28 Feb. most plumbing/electrical in -19 Apr. doorways opened into the house -5 May remaining windows installed -17 Jun. rear french doors installed -5 Jul. gave notice of contract termination Ampro executed their typical work installing roofing and siding adequately, but we are dissatisfied with their management, lack of onsite supervision, communication, and horribly written contract. They failed to recognize there were multiple discrepancies between the drawings and engineering (such as skylights we kept mentioning). We've struggled with water intrusion, heating, security, quality (e.g. interior walls built between old floating floor and crumbling plaster)... There are multiple failed and missed inspections. They didn't communicate to inspectors the scope of work, and they don't understand what is required for the inspection to start insulation and drywall. They have not installed the shower valve (inside the wall), and insist that we install the bathroom fan, and kitchen exhaust after they drywall (contrary to what the inspection requires. Now they want the entire next draw when that phase is incomplete, and we paid for the deck that hasn't been installed.

      Mr. and ******************* are ****** simplifying and slanting much of the information that they are conveying to avoid paying the third stage of their contract.  The past two years have been raqvaged by supply problems as well as labor shortages. The Woodasrds job is no exception. Windows have bee taking up to sis months from the time of order just to mention one component.

      The ******** contracted for a rough shell. In a rough shell electrical as well as plumbing are to be roughed in only. No valves. Electrical is the same situation. No fixtures. None. Bath fans and shower valves are not rough in items.  The time required to construct their addition is completely in keeping with the average time required to build larger projects in the years from 2020 to 2022. 

      Ampro was ready to install the insulation and drywall and called for the required inspection.  Mr. or ******************* interfered with this inspection and made sure it did not occur.  The regular inspector was not available at this time so his knowledge of the project was not available at this time.

      The third draw for the third stage is in fact over due. It was due at the passing of rough electrical and rough plumbing. These have both been signed off.  The ******** are attempting to save money by not paying the monies due Ampro. (See the ******* Statement) They have stated this in their complaint with no regard to the rights of Ampro or the enforcement of the contract.

      This boils down to the ******** wanting to save money at the expense of Ampro Builders llc. 

      Ampro remains in contract and has every intention of completing the contract as we were in the progress of doing.

      The customer response leaves out a few important details and paints a false picture.

      Brushing off the impact of covid ******************************************************************* the last two years. Supplies critical to the completion of projects were either scarce or not available. Inspectors were working outside as little as possible all adding at least a year to projects.

      The ******* project is a seriously complicated project including the adding on a two  story addition to  an old two story home with a ******* roof line and many past alterations all done without plans.  

      To depict the master ********* and his helpers as incompetent and the reason for slow progress is pure conjecture.  The *********** skill level is superior and he is able to solve the daily problems that larger crews could not. The ********* assigned toi the ******* job is highly experienced in complicated remodels and a lesser person would not have succeeded in completing the framing.

      The inspector notes detail exactly that the previous inspector had knowledge of details that Mr. and ******************* claimed had been skipped.  The shear panels were inspected and approved per the inspection card. This is now acknowledged while in the past was said to have been missing. 

      The insulation Company does seal the plates as required as well as electrical boxes.

      Ampro excluded the vent fans and the ducting from the job contract. Vent fans and ducting are done by an HVAC contractor and NOt the plumber.  Mr and ******************* did contract with an HVAC contractor who installed heat ducting and should have installed the vent fans and ducting.

      The shower valve was not part of the Ampro contract as well as any valves or plumbing devices. Ampro contractracted for rough in only whether electrical or plumbing or framing.  

      There really is nothing wrong with the framing as you well know.  You are mentioning possible additions to the framing which are minor at best.  

      Your money draw was due at rough electric and rough plumbing having been signed off which they are.

      You created your own possible problem with the new inspector by allowing him to erroneously believe that the shear had not been inspected.  The inspector was to have been met by our staff person but you caused the inspection visit to be terminated or called off.

      You are correct in the need to meet him.

      The job was built during Covid 19, relentless bad weather and supply problems.  Your job is over 80% complete and the areas you have mentioned such as Vent Fans and the plumbing valve are your responsibility. You are contributing to your own job lag and failure to pass for insulation installation.

      If you would like to get serious about paying Ampro what is owed we are more than willing to meet and work out a solution.  We have not yet invoiced you for the added costs of materials which unfortunately are skyrocketing due to supply problems and covid.

      We are proceeding with a lien and collection.
