We purchased our home in November 2021. The couple we bought it from had never lived in the house due to them going through a divorce. ***************** honored a 1 year warranty. 4 months after living in the home I noticed the hallway floor giving out and other places in the home. The hallway being the main issue as it was splitting. I contacted **** to come out and take a look. He came out Feb 2022 to look at the floor. He acknowledge that the floor was bad. He stated he would get back with us in a few days. He did and proceeded to tell us that he was not responsible for the subflooring. We had an inspection done in April 2022 which **** was given to fix the issues the subflooring was covered in black mold. We have since lawyered up and currently filing a lawsuit against Hart Homes LLC *****************. I have attached documentation of what is going on since he was last in our home in Feb 2022. It is stated in the report that the subflooring is rotting away. The mold is active. My entire subflooring needs to be replaced. The pictures showing the cracks in the walls and fire place is not normal settling of the house. I will also mention that Winter ***** we did not have heat. The **** was not installed correctly. We have had a Forensic Engineer come out and assess. I have not gotten the report yet. I can provide that when it arrives.We made multiple attempts to reach out to ***************** when the issues came up and he refused to help or let us know who laid the flooring down. We even offered to meet halfway and he still refused. We have emails and text messages to prove as well. The home did have another builder that walked away with the owners money and ***************** was the project manger. The home sat exposed for over a year without a roof. I can provide pictures of that if needed. ***************** was asked to finish the home. He knew the subflooring was bad and needed to be replaced when he laid the flooring down.
