      Institute of Transformational Nutrition (ITN) has online courses to teach students how to be a health coach. In their student agreement I signed for the term in which I was enrolled, it states that students will have *access* to their curriculum for 14 months. I was not *****ed access to their curriculum for 14 months. By their own admission through email, they calculate 14 months as 420 days (14 x 30 days). Nowhere in their agreement do the specify that they are calculating 14 months as 420 days. Since there are 31 days in 7 of the months of the calendar, one cannot calculate number of days in a certain number of months by multiplying by a factor of 30. To calculate the number of days in a certain number of months, one multiplies by a factor of **********, resulting in ********** days in 14 months. By their own admission through emails received in 2023, their countdown of 420 days started on the date of my enrollment, however I was not *****ed *access* until the following day. I was also not *****ed access for one day during a time in which they were updating their system. I was only *****ed access for 418 days or ********** months of a 14 month agreement. They expect me to pay in full for an agreement in which they breached (and admitted they breached through emails) when they didnt ***** me access for the full number of months of that agreement. If this is the way they calculated the number of days in a certain number of months, then they have potentially breached their agreement with every single one of their enrollees. I have attached copies of the emails and will send a copy of the agreement upon request.I am officially requesting a refund of the payments I have already made due to their admitted breach of the agreement.

      As you can see from the email thread documentation provided by the complainant, ITN has been more than willing to work with ******************** to assist in getting the outstanding balance paid in full. The last communication ITN received from ******************** regarding access to the course was October 16, 2021,which ITN replied to on October 18th, 2021, and we received no further response from her until reaching out about her unpaid balance in June of this year, and after four attempts at that. Our Student Enrollment Agreement states we will submit unpaid accounts to collections after 30 days of failed payments.Hence, Ms. ********* account has been closed with ITN and sent to collections,and we will pursue every actionable channel to collect these funds. This unpaid tuition balance is the only existing contract breach between us.

      As you can see by the correspondence within the email I supplied, ITN rendered their student agreement with me null and void whenever they did not ***** 14 months of access to their program as ITNs representative admitted within said email thread. I replied twice to their 4 times and explained in that email thread that a previous email I sent had gone unanswered.  I also explained in said email thread that when *** confirmed that my progress was missing, that I was devastated.  I also strongly suggested in that email thread that ITN should just keep the money which I had already paid and to not pursue further payment from me since they breached their own agreement with me and possibly every other ITN student using their mathematical calculations.

      The point is that the agreement was for access for 14 months.  The rest of this is mute.  
      I was not *****ed access for 14 months.  I was not even *****ed access for 420 daysthe number of days ITN decided was in 14 months.

      If you were given 14 months to live and that was converted to an exact number of days, would you want to multiply that number by 30 or 30.41666666666?

      If you were taking a math exam in elementary school and were asked how many days are in 14 months and your answer was 420, it would be marked incorrect.

      Each party is to uphold their portion of an agreement in order for each party to be accountable for their portion. 
      ITN did not uphold their portion of the agreement with me or potentially every one of their students.  Therefore there is no longer an agreement between ITN and me.

      As admitted by the ITN representative in the email thread I submitted, the countdown of 420 days started on September 5, 2020, but I was not given login information until September 6, 2020.  I was not *granted access* until September 6, 2020.

      This quote is taken directly from ITNs website.
      *************************** overcame poverty, abuse, and personal health struggles


      The ITN representative replying in this complaint is using abusive tactics to try to shift blame and try to gaslight by saying that the only one who breached the agreement was me.  During my enrollment, and possibly during the enrollment of every one of their students, ITN calculated the number of 14 months as 420 days.  The number of months times the number of days14 months x 30 days according to the emails.  Nowhere in the agreement does it state that they would be using this mathematical equation to determine the agreed upon 14 months of access.  Even so, I was not granted 420 days of access.


      I received an email from ITN on September 3, 2021 stating 2 months until you lose access.  Two months by ITNs calculations should have been 60 days, however 57 days later my access was stopped on October 30, 2021.  This email didnt specify if the student could still continue the program and could still graduate or if the extra money paid for continued access was just to access the materials as resources for those who already graduated the program.  On September 3, 2021, my progress in their curriculum was such that I might have been able to complete it by the first part of November (which is when 14 months should have been), but I sent an email to them with questions for clarification just in case.  This email went unanswered.  My progress was missing in October 2021.


      People who try to blame shift dont like facts.  
      These are facts which were even confirmed by ITN in my previous emails with ITN:
      I signed the agreement on September 5, 2020.
      I was not granted access until September 6, 2020 when I received an email from ITN with my login information.
      I was not granted access during the system update.
      I received an email on September 3, 2021 stating 2 months until you lose access and I could continue access for just $97 per month extra.
      My access was cut off October 30, 2021, 420 days from the *date I signed* the agreement, not from the date I was granted access.
      I was given access for 418 days.


      Several website including ******* *************.com, Calculator.net, and more concur with the math I learned in elementary school:  
      14 months is ************* days
      14 months from September 6, 2020 (the 1st date I was granted access) is November 6, 2021 


      Even if ITN had been able to recover my lost progress, the above facts are still true.


      I did not sign up for my access to be shorted so I could then pay for it to be extended.
      I did not sign an agreement with a company so I could teach math, not only for me, but also for quite possibly every single one of their students.  Did ITN use this math with everyone else?  Did ITN extend days to anyone else when their system was down? 
      I did not sign an agreement for ITN to breach their own agreement, thus rendering any further portion of the agreement null and void.

      I dont understand what service you (BBB) provided me other than allowing me to expose poor business practices of ITN to a 3rd party.  The company (ITN) did NOT address my complaint.  My complaint was that ITN did not fulfill their portion of the agreement.  They did NOT address this even after admitting in previous emails that they did not fulfill their portion of the agreement.  BBB also did NOT address my complaint.
