      On 15 June 2022, I provided $1000 ******* money to lock in the purchase of property for my daughter located at ******************************************************************* with closing on 5 August 2022. Since she didn't have enough credit for a home loan, I made the purchase in my name with her on the title. The real estate agency listing specifically stated that the appliances were included in the sale, however, company employees removed all of the appliances out of the home prior to closing and without informing us or our real estate agent. I had my daughter walk through the property the day prior to closing since I was visiting my mother who was gravely ill in St. *************** in ********* (she died shortly after closing on 5 August 2022). Upon my entry after the sale was complete, I asked my daughter where were the appliances, she told me that she did not know so I then informed her that the property listing stated that the appliances were to be included. I then asked her to contact our agent at ******************* in ********** ** about the missing items. After a day had passed our agent responded to my daughter that the seller's agency informed her that their cleaning team had removed the items and only offered $150 in compensation that was updated to $200. The cost of the gas stove/oven and ** French door refrigerator far exceeded the amount of compensation from the ***************

      I was made aware of a complaint filed regarding fraud. I have reviewed the file with the office broker and compliance officer and here is what I have found.
      We were on the listing side and your daughter was working with an agent from another real estate firm that wrote the offer. The spec sheet did indicate the appliance were included but the WB-11, offer to purchase which is the state-approved form and controlling document did not include the appliances. Without the appliances included in lines ***** of the WB-11 offer to purchase the seller is obligated to remove all personal property before closing. 
      Your daughter did a walk-through the day before closing with no mention or concern of missing appliances at that time.
      The selling agent sent **** a text after closing asking where the appliances were, but before **** could respond, the selling agent replied with "Nevermind" We expected that the selling agent realized she had never included the appliances in the offer.
      The property management company did confirm that the tenant removed the appliances, not the property management company nor the agents.
       The property management company nor Coldwell Banker or any of its agents ever made any offer of compensation for said appliances.

      If there is something we are missing please let me know but I would suggest reaching out to your agent who drafted the offer to purchase for your daughter to address any issues.  

      I would also appreciate your retracting your claim of fraud against our company at the BBB.
