      ***********************, realtor for Shorewest in **********. Did not verify the dates of replacement for the roof and boiler on the home we offered to purchase. He also neglected to tell us the home had a separate air conditioner and furnace for the second half of the home. When we discovered these issues, we tried to back out of the contract. The seller was hesitant to allow this. We had to offer 2500 to cancel the contract. His errors and omissions cost of *******. We would like that money back.

      The Complainant was not our client and had a different brokerage representing him.We never had direct communication with him in any manner. Questions were answered with approximate dates and to the best of our knowledge with information given to us. MLS states on all sheets and information "The information contained herein is provided for general information purposes only.If any of the above information is material or being utilized to determine whether to purchase the property, the buyer should personally verify same or have it confirmed by a qualified expert. The information to independently verify and confirm includes but is not limited to total square footage formula,total square footage / acreage figures, land, building or room dimensions and all other measurements of any sort or type. Equal housing opportunity listing."
      Lines ******* of Addendum A (part of Offer), which was signed by Complainant, also states "Buyer understands that the information which is contained in the ***************************** sheets and additional promotional materials is obtained from a number of different sources and which has not been independently verified or confirmed by the various real estate firms and agents who have been and are involved in this transaction. If any particular measurement or data element is important or material to Buyer, Buyer assumes all responsibility and liability to research, verify and confirm said data element and measurement. Further, Buyer affirmatively represents and confirms that as to any particular measurement or data element which was or is important or material to Buyer as an inducement for the purchase by Buyer, Buyer has independently confirmed and/or verified the accuracy of said particular measurement or data element." 
      During the inspection contingency, some repairs were asked to be remedied by Complainant.Our Client/Seller was reluctant to agree to the first proposed amendment citing repairs and compensation. It was during this time, we were informed by the Broker for the Complainant, that the Complainant never viewed the property prior to writing their offer and acceptance, thus seeing the property for the first time at the home inspection (which took place after the accepted offer.)Complainant's Broker also informed us that Complainant was not happy about the condition of the neighboring house and the landscaping. Per the contract,****** had the right to cure defects and were willing to do the repairs requested by the Complainant and also offered $5,000. Complainant did not want to move forward with the contract, thus HIS Broker drafted a Cancellation and Mutual Release starting that half of the ******* money ($2,500 of the total $5,000) would be released to Seller since not continuing with the Accepted Contract would be in violation since Seller had right to cure and appropriate channels were not used (Notice of Defects). The Cancellation and Mutual Release signed by all parties also states "The undersigned Parties agree that the 2 insert type of contract, e.g., offer to purchase, lease, option, etc.(Contract) dated , for the 3 property located at , 4 in the of , State of *********, is canceled and the Parties hereby 5 release all of their right,title, and interest in and to the Contract, and any and all claims arising out of the transaction."

      The Mulcahy Wendel Team keeps on sending us unsolicited advertising. We have informed/requested to be removed from their mailings, according to our logs 6 times in the last 12 months. We have received 0 response to requests made via mail and email. We request to have are addressed removed from Shorewest's marketing database and for no additional contact. Your cooperation and understanding in this matter is appreciated.

      I have asked both my director and a corporate admin how to finalize my contract with them and no one responds. I will not pay additional fees because they do not respond. I canceled my contract.

      Complainant and I had a meeting set on the 3rd of February to handle their release.  They postponed the meeting and sent me an email indicating they were rethinking leaving.  On February 14th, they sent me an email indicating that they would be leaving real estate in the month of February.  We released them on February 22nd and I reached out to them at that time.  The only charges added to their **** in February were charges for the month of February for MLS, Tech and GHT.  If they had been released on the 14th, their **** would have been the same.  We have already prorated and then waived the remainder of a web page fee that had a cancellation deadline of 1.31.22.
