We used Circle R Accounting for our tax preparation for 2021 and 2022. Recently when we applied for a home equity loan it came to our attention that the income from my business was attributed to my husband's social security number (this fact has been verified with both the *** and ******************************** I went to Circle R Accounting within a week of learning this and was told that "it didn't matter as my husband and I are married and filed jointly" and when I asked if it needed to be changed/amended they stated "that would cost thousands of dollars and wouldn't make a difference". After that interaction, I took our taxes for those years to a different tax preparer and had them amended correctly and paid that tax preparer $300 for their services. It was also found that we owed the State of ********* $481 and will be getting a refund from the ****************** for over $900 due to other errors in the tax preparation for 2021 and 2022. Year 2021 was responsible for most of this discrepancy. I am currently working with the ****************************** and the *** to have these matters resolved. I met personally with the owner of Circle R Accounting on October 9 to explain my concerns in hopes of rectifying the situation. He absolutely refused to reimburse us for the fees for tax years 2021 and ************************************ with my depreciation detail paperwork for those tax years in order to take them to a different tax preparer. After further discussion he agreed to give me the depreciation detail paperwork and a letter explaining the discrepancy in income reporting that could be used with the *********************** At no point in the conversation did he apologize for the damage done to us through these mistakes. He continued to maintain that nothing was done in error.

The customer had brought to my staff's attention that an error had incurred that they claimed was the reason they did not get a home equity loan.  When this was brought to my attention, I responded that the error should not have been a reason for the taxpayer to not get a loan, because they filed a joint return and the income was marital property.  The next interaction we had with the client was when they came into my office to bring us fully aware of the mistake and made three demands.  1) We provide her with her depreciation schedules; which are the working papers of our office and we give all of our clients all of their documents and required tax documents as required by law at the time they pay and pick up their returns.  Even though not required by law we did furnish her with her depreciation schedules prior to her leaving our offices in a very timely manner.  2) She insisted I write a letter explaining the issue of what she claimed to be the income being attributed to her husband and not to her.  Upon further review the income had been reported on our end correctly and even the other issues she raised were all reported correctly to the *** when her tax returns were e-filed.  I then suggested we could follow up on her tax return and shared with her the fact that she needed to contact ****************************** to correct her issues. She then stated the first time that she did not trust us any more and had hired another tax preparer.  3) I did follow up and noticed that amended returns had been e-filed for her  by our office and thus again as stated to her the returns were correctly prepared and e-filed by us.  At which point she stated again, "I no longer trust you" and if I did not refund her the money she would report me to everyone as she has nothing but time on her hands.  If she had not stated this I would have been happy to work with her to resolve the issue and despite the fact she was now threatening me and stated she did not trust me; however, she still wanted a written letter explaining the situation. I proceeded to type the letter while she watched me do and handed it to her again along with all of the documents she requested. The demand for a full refund and asking me to perform more work, but was not willing to allow us to remedy the situation on her behalf is where the dispute honestly arises.  We offer all of our clients free audit protection, which she refused to accept.  We felt that no refund was due for work that was completed and additional work was done to remedy the situation at no additional charge, as is common practice.  From the time we were made aware of the client concerns to the situation being remedied was less than 1 hr.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

As I stated in my original complaint, income figures were inaccurately reported to both the *** and ******************************* I have worked countless hours to get this rectified and have paid another tax preparer to amend our 2021 and 2022 taxes. Interestingly enough, shortly after leaving Circle ********* for the second time I received a email from them providing me with the number for the ********************** where my issue could be fixed immediately. That of course is not the case and several documents will need to be provided to rectify the situation regarding our Social Security accounts.

Serious mistakes were found by the second tax preparer and were corrected with the amendments. I have no confidence in Circle R Accounting and have decided to take my business elsewhere. The response to my complaint from this business continues to maintain that no errors were made and that is the most disturbing part of this whole experience.

      Regards,

      *********************
