I have filed a consumer protection complaint: File ****** - South Bay Marine Center Inc.My complaint:I have been a slip holder at South Bay Marina since ****. In 2017 when I turned 65 I received the email below informing me my rate was now locked in for as long as I continually return to South Bay Marina which I have. Their duly appointed representative made an offer to me to lock my slip rate "indefinitely" on Friday September 18th of 2017 as long as I continually return to South Bay (see copy of email attached). I have held up my side of the agreement. Several times in the past years, with new management of the marina, I was billed the then current rate and upon my informing them of my Senior Lock-In Rate it was summarily reduced to that rate. So both in writing and then reinforced in practice I do have a long term agreement for my Senior Lock-In Rate. A lawyer I talked to said that ********* contract law would consider this an actual offer which is a binding contract. My rate for the last 5 years was $1,645 and now is being raised by over $1,000 to $2,700. The owner states that they have hired a professional marina management firm, F3, and that future pricing and management of the marina is their decision. However the contract that is offered is by South Bay Marina LLC and the payment is made to South Bay Marina LLC. My lawyer said it would certainly seem at the very least that there is apparent authority, and likely a nondelegable duty involved as there were no limitations on the Senior Lock-in rate as promised by South Bay Marina LLC and they are still the legal entity who own the marina. I would appreciate your help in enforcing South Bay Marina LLC to uphold the agreement/contract that has been in place and operational for the last 5 years and satisfy that rate indefinitely as per their original offer and practice. As a result of my filing a complaint they fired me as a customer which was both retaliatory and discrimination. Would appreciate your help.Business response

Dear **************************,
I am writing to inform you that we will be ending our customer relationship effective immediately, in accordance with the terms of your Slip Rental Agreement with us. As you are aware, the term of your agreement with ** was for the 2022 boating season, which commenced on May 15, 2022 and ended on September 30, 2022.
Please note that your Slip Rental Agreement is seasonal and may not be extended. It must be renewed for each boating season at the sole discretion of Lessor. While Lessee may have the option to renew the Agreement for subsequent Boating Seasons, Lessor reserves the right to not allow Lessee to renew the Agreement, in Lessor's sole discretion.
Furthermore, if Lessor extends to Lessee a right to renew the Agreement, then Lessor shall give Lessee notice of Lessees option to renew the Agreement at least sixty (60) days prior to the commencement of the applicable Boating Season. The Renewal Notice shall set forth any changes or modifications to the Agreement or the Vessel and Mooring Rules, the amount of Mooring Fees due for the applicable Boating Season, and such other information, in Lessor's sole discretion, as Lessor shall determine.Based on the above terms, we regret to inform you that we cannot honor the "Senior Lock-In Rate" that you have claimed. As per the terms of your Agreement, Lessee must fully and punctually perform and observe all the terms, covenants, and conditions required to be performed or observed by Lessee hereunder.
