      My 85 yr old mother and I (who am disabled) lived at ***************** Apt 2 from Dec 2023 to April 2024. When we moved in I had a check in sheet and listed all the damages to apt. When we moved out I left the manager a copy, since she lost hers. Yesterday, May 22, 2024, I received a letter with multiple pages, w/photos, of damages that were already there and were being charged for them. Everything from stains on carpet, kitchen and bathroom flooring missing blinds. These again were all listed on my sheet day of move in. The blinds were cheep and broke when the wind blew in. I requested to maintenance for replacement, w/ no response. ***** the manager told me not to worry about them. There probably was a small amount of smoke on walls in large bedroom but that was it. Not in whole apartment like they are saying. I looked up this company and they have done this to others. They're not only keeping our $900 security deposit they want an additional $1500. My poor mother has been having chest pains because of this.

      Dear ******,

      This is a response to complaint file #******** regarding the complaint about move out charges and her outstanding ledger balance. They resided at ************************************************************************************ located in the ****************** from December 1st, 2022 to April 30th, 2024.

      M & J Wright Investments, **** has reviewed the complaint. There seems to be two issues at hand: carpeting and painting charges. The tenants smoked in their apartment; thereby causing damage to the apartment walls,carpets, and amenities in the apartment beyond normal wear in tear. Upon Moveout,the tenants were subsequently charged for all the smoke damage to their apartment: carpeting, painting and amenities.

      Per Their Lease under Security Deposit:
      ****** agrees that the security deposit in the amount set forth above shall be held by Lessorpremises must be left in clean condition and ready for the next occupant. By clean condition and ready for the next occupant it is meant clean and the better of: (1) the condition of the premises when turned over to the Lessee, or (2) The condition of the premises following the completion of any work performed by either party to improve the premises (normal wear and tear is expected)All Sums due under the lease may be set off against security deposit..

      Per Their Lease under Lessee Duties:
      Tenant shall be liable for any property damage, waste or neglect cause the negligence or improper use of the Premises or the building or development in which they are located by Tenant or tenants s guests or invitees;

      Per Rules and Regulations #**: 
      Painting shall be done only when necessary, by Lessor only, but in no event more frequently than every three years, except for damage not cause by the Lessee.If it shall become necessary to paint the premises, or any part thereof, sooner than three years from the date of the previous painting, because of misuse by the Lessee, Lessees occupants, guests or invitees, the cost of such painting shall be charged to the Lessee. 

      Non-Standard Rental Provision #**:
      Smokers in the apartment create dirt and smell which is considered to be beyond ordinary wear and tear. Smokers agree that they will be charged $17.00 an hour for washing down the walls and the appliances plus $200 for painting a studio, $250 for painting a one bedroom/loft and $300 for painting a two bedroom/loft per coat. 

      There has been an oversight of all the stains to the carpeting documented upon move-in. The tenants are still responsible for the painting invoice. The refund check is in the mail. We have left a voicemail message for our customer. Our sincere apologies for the oversight.
