I had a contract with monumental contracting to put siding on my house. They subcontract the project out. I payed in full for the job 3 months ago. The subcontractor is reaching out to me saying he never got payed and monumental wont return his calls. I have reached out and monumental keeps having excuses or not returning my calls or texts.Initial Complaint

I hired ************** in May 2022 to build a large deck and screened-in room onto the back of my home. The contract was signed and I paid half the total job amount on 5/6/22 for $21,000. All permits were approved and work started in Sept. 2022. The structure was partially built by 10/25 when the next payment to Monumental was due. However, I didn't realize that he did not build the structure according to the plans (made by a licensed architect) that were part of the contract. He used undersized posts and beams and left out 2 footings. He used non-galvanized nails, improper clips and didn't cut the wood according to the plans etc. resulting in a structure that was wildly inconsistent with the plans and not safe or up to code. I paid the next installment unaware of this (I was traveling for work and took his word for it) of $10,000 on 10/25. This is when ************** largely stopped returning calls, emails and texts. I have a record of all of the times he failed to respond to show that I was persistent without being bothersome. I continued to reach out with only one reply from ************** per month for Nov. Dec., Jan, and Feb. Each time saying he would call me back or blaming his vendors, both of which confirmed that they had no orders from him. I finally gave him a week to respond on 3/6/23. He responded on the last hour saying "I know your deck has dragged out.. I will put together a discount for the delay Im hoping to be there by April 1st! Once on site I need four days! He never showed up so I reached out 3 more times in April and finally sent him one final email asking to reply or that we will assume that he has no intention of completing the work. He never responded. *** since had to hire a new contractor to repair his work for $10,000 in order to bring it up to code. He should not be allowed to steal from innocent people. Any assistance in either repayment from him or shutting his business down so he cant continue taking advantage of others is greatly appreciated.
