I am the administrator of my husbands estate ***** *******.I am writing to request assistance with an insurance charge from 01/21/2025 in the amount of $3,223.00 to my escrow account from the lender Fairway independent mortgage. Loan#**********. They are charging this amount for the year of 2024, despite the fact that the property was not insured with their company throughout the entire year. I am unclear as to the basis for this charge. I was not informed or notified by fairway mortgage company about our property being insured by the company which they are claiming payment of. If I wouldve known I would have contacted their insurance company when the hurricane and tornado struck the area back in 2024.When I contacted fairway employees regarding this matter, they were unable to provide a satisfactory explanation. Its also concerning that they would backdate and claim payment for a period when the property was not insured with said insurance company. When on a prior phone call with-*****- on 01/29/2025 she ensured me the charge will be refunded as soon I submitted the new insurance information. I submitted that information to fairway on 2/4/******** on todays call they expect me to take an apology and to only take what they were telling today 2/11/2025 about a backdated charge.I received a letter in November regarding a renewal with the name of that insurance and not for a coverage of 2024.I have been in contact with fairway mortgage company since the passing of my husband in 2023.and I have found their employees to be unhelpful and not understanding in all this painful process.Business Response

I am writing to formally lodge a complaint against Fairway Independent Mortgage Company concerning their handling of my mortgage financing and the associated appraisal process during my recent home purchase. The representative assigned to my case was ***** *******.Fairway Independent Mortgage Company was engaged to provide financing and conduct the appraisal for the property in question. Upon reviewing the appraisal submitted by the company, I identified discrepancies that warranted further investigation. I subsequently contacted their legal and compliance teams to request clarification and answers regarding the appraisal. Unfortunately, my inquiries were met with a complete lack of *********** addition to the legal and compliance teams refusal to provide assistance, I encountered significant obstacles when attempting to obtain support from Fairways lender and customer service representatives. My efforts to discuss the compliance of the appraisal or any aspects of my case were repeatedly dismissed, with their representatives stating that no information or assistance would be provided unless a subpoena was issued.The lack of accountability, transparency, and willingness to address legitimate concerns is unacceptable, particularly in an industry where trust and integrity are paramount. I am in the process of conducting further research and intend to escalate this issue to the appropriate state authorities to investigate Fairway Independent Mortgage Companys processes and procedures.I respectfully request that the Better Business Bureau review this complaint and take appropriate action to address the companys refusal to assist its customers and its failure to comply with reasonable inquiries into its business practices. Date of Transaction: June 30, 2023 What the Business Committed to Provide:Fairway Independent Mortgage, through its loan officer *****, committed to act in my best interest during the loan process. This included ensuring that seller-agreed repairs were documented and completed before closing and addressing my concerns effectively.Nature of the Dispute:Fairway's loan officer referred me to *** ******** of Key 2 ************, who failed to ensure seller-agreed repairs were completed or documented. When I raised concerns about missing repair receipts, ***** and *** assured me I could proceed with closing, stating the receipts would follow. After closing, I discovered that essential repairsincluding plumbing, electrical, and HVAC workwere incomplete, leaving me with significant financial burdens.Despite filing a CFPB complaint, Fairways response was dismissive, claiming that ***** did not pressure me into closing and shifting responsibility for repairs entirely onto me. Extenuating Circumstances:At the time, I was recovering from childbirth, caring for an infant, consulting lawyers, and hospitalized for a bone infection, which limited my ability to challenge the issues. I trusted Fairways guidance and assurances that repairs would be completed. Additionally, the full extent of the damage was not immediately apparent. Thank you for your response to my complaint. However, I must address several critical issues that your statement failed to acknowledge. As a lender of an FHA loan, Fairway had legal obligations to ensure the property met FHA minimum property standards and that the agreed-upon terms of the sale, including necessary safety repairs, were upheld.
Key Concerns and Obligations:
FHA Loan Requirements:
Fairway has a legal obligation under *** loan requirements to ensure that the property meets minimum property standards prior to approving the loan. These standards are in place to protect borrowers from purchasing unsafe or non-compliant properties.
The property in question had multiple documented safety hazards and violations, including cracks in the foundation and driveway, outdated wiring, rusted/broken plumbing, and lack of GFCI outlets in required locations.
Additionally, the electrical system was not up to code, violating both the National Electrical ********** and local electrical safety standards. This includes the absence of GFCI protection in wet areas (under the sink, near the garbage disposal and dishwasher, and in the bathrooms). These deficiencies posed serious safety hazards and violated FHA minimum property standards, which require properties to meet local building codes and safety standards.
Knowledge of Needed Repairs and Inspection Report:
Fairway accepted the appraisal without question despite having full knowledge of the necessary repairs identified in the inspection report I provided.
I shared a copy of the inspection report with both the loan officer and the realtor, clearly outlining the deficiencies in the property and the safety requirements that needed to be addressed. This prompted the creation of the repair amendment to ensure compliance with FHA standards.
The appraisal failed to reflect the known safety hazards and non-compliance with FHA standards, yet Fairway proceeded to approve the loan without verifying that these issues had been resolved.
Electrical and Plumbing Repairs Agreement:
The electrical and plumbing repairs were explicitly agreed upon by me and the sellers as part of the sale agreement due to their importance for safety and compliance. These repairs were required by my inspector, who identified the lack of GFCI outlets and other safety hazards as violations of *** and FHA standards.
I was assured by both the loan officer and the realtorwho worked closely togetherthat the receipts for these repairs would be presented at closing. Despite these assurances, the loan was closed without the electrical and plumbing amendment or the receipts.
According to ******* ****** of Capital Title, only the foundation repair amendment was included in the final documents, and the electrical and plumbing amendment was removed without my knowledge or consent.
Appraisers Role in FHA Compliance:
Do not tell me that the appraiser isnt an inspectorI am fully aware of that. However, as the appraiser completing a *** form, it is their responsibility to ensure the property meets *** standards. The appraiser failed to report visible hazards, including cracks in the foundation and driveway, outdated wiring, and non-compliant electrical systems. Fairway accepted this flawed appraisal without question, despite having full knowledge of the inspection report and the repairs that were needed and agreed upon.
Loan Officers Negligence:
The loan officer not only failed to ensure the property met FHA standards but also failed to include the *** amendment at closing. Instead, the loan officer asked me to sign the *** amendment on July 5, 2023, after the loan had already closed. This is a serious breach of professional standards and further highlights the lack of oversight and attention to detail in Fairways loan process.
Unauthorized Removal of Critical Documents:
I did not consent to the removal of the electrical and plumbing amendment from the closing documents. This amendment was critical to ensuring the property was safe and compliant with FHA standards.
The failure to include this document and enforce the agreed-upon repairs represents a serious breach of responsibility by Fairway and other parties involved in the loan process.
Impact on Me:
Due to these oversights and failures, I have faced significant financial and personal hardship, including:
-Over $30,000 in unexpected repair costs for plumbing, electrical, and structural issues that should have been addressed before closing.
-Health problems, including a bone infection caused by poor water quality in an open wound due to rotten plumbing
-Emotional and financial distress from living in unsafe conditions with my infant child during multiple hurricanes and power outages without grounded electricity (small fire in attic from using kitchen appliances)
Fairways Response and Legal Obligations:
While Fairway claims it does not make guarantees about the propertys condition, this does not absolve the company of its legal responsibility to:
-Ensure the property meets FHA minimum property standards, which include compliance with *** and local safety codes.
-Verify that all required safety repairs, including electrical and plumbing, were completed and documented before approving the loan.
-Uphold the terms of the sale agreement, including enforcing the electrical and plumbing amendment and obtaining the required receipts.
-Ensure all ***-required documents are included and signed at the appropriate time, not after the loan has closed.
-The failure to ensure the property met these standards, enforce the agreed-upon repairs, and properly review the appraisal constitutes negligence and a violation of FHA loan guidelines.
My Request:
Acknowledgment of Responsibility:
Acknowledge Fairways failure to meet *** loan requirements and its role in the unauthorized removal of critical documents from the closing process.
Financial Compensation:
Provide compensation for the significant repair costs I have incurred due to Fairways negligence and failure to enforce the agreed-upon repairs.
Review and Reforms:
Commit to reviewing your processes for verifying property compliance with FHA standards, overseeing appraisers, and ensuring that amendments critical to borrower safety are enforced and documented.

My wife and I executed a mortgage in favor of Fairway Independent Mortgage Company on or about March 8, 2022 (the Refinance). Included in our Title Commitment form was a ****************************************** (***) Partial Claim Lien that was recorded in ****** Countys Public Records. However, the *** Loan was not paid off during the closing for the Refinance and was removed as an encumbrance on the Final Title Policy.According to *** guidelines, this type of loan program must be satisfied upon sale or refinance of the encumbered property. Since it was not satisfied, unbeknownst to us, the *** Loan became due and payable, and started to accrue interest and penalties. In addition, *** and the *************** of the Treasury withheld our 2023 tax refund and are garnishing our paychecks. This has been hugely detrimental to us, both on a personal and financial ******** a chain of frustrating events, possibly the most frustrating aspect of this ordeal for us has been the bait-and-switch game that Fairway appears to be playing. For well over a year, we have been continually told by Fairway employees that their situation is getting taken care of by Fairway. It has not ******* of the filing of this claim, we have lost more than $17,000 and continue to live garnished paycheck-to-garnished-paycheck. We, both personally and through legal counsel, have contacted Fairway to attempt to resolve this situation, but Fairway is refusing to do anything to help us, which is why they have now turned to filing this complaint.We have not filed a complaint to this point because of their reliance on Fairway's statements promising to help rectify this issue. However, as discussed above, that has not happened. We hope the BBB will see this as a an extenuating circumstance to help us with our issue.Business Response

Fairway believes the Ballards have directed their complaint to the wrong party. ******* Title made an error in its work and missed a second loan when conducting work on a loan the Ballards did with Fairway. The final title policy provided by ******* Title did not list the second loan. The Ballards additionally never made Fairway aware of the second loan. Fairway believed it was in 1st lien position until made aware almost 2 years later in March of 2024 about the second lien when the Ballards contacted Fairway about a garnishment notice from *** because the Ballards had stopped making payments toward the second loan. Fairway then self-reported the lack of 1st lien position and was required to repurchase the loan Fairway did for the Ballards.. Fairway filed a title claim with Fidelity, but to date, Fidelity nor ******* Title have resolved this issue caused by StarTex Title.
Fairway has done nothing wrong in this matter.Simply put, the Ballards came to Fairway for a refinance, Fairway then refinanced the only loan it was made aware of by the Ballards and StarTex.Again, at no point in the refinance process was Fairway made aware of the Second Loan by ******* or the Ballards. I paid my mortgage with them and had the funds returned after days without notice from fairway for both my March and April payments. Once I had noticed I then called and promised to repay the payments to clear the debt which I did, it was also during this phone call that I was assured they would not report the missed payments to my credit report due to the billing error, within 48 hours they reported the missing payment for March to the credit bureaus for both myself and my father who is also on the loan. I was promised they would not do this on a recorded phone call and all of my attempts to contact Fairway have been ignored or I have been denied my request to have the report repealed. They have told me it was possible for them to do so but that they will not due to policy. Beyond this I changed the bank account for them to use for ACH payments and they are not using the account I gave them to do so. I am being charged fees for payments I have made and had the funds to pay. I have been lied to repeatedly and mine and my fathers credit are suffering due to the mistakes of the Fairway Mortgage Company. If there is any assistance you can render to me I am purely grateful, thank you so much in advance for your time and efforts on this matter. -***************************Business Response

We communicate with honesty and integrity,and customer satisfaction is our number one priority. ************** Mr. ********* summary of events outlined in his complaint is inaccurate. ******************** is aware that he was late making his mortgage payments and that there were no billing errors on Fairways behalf. He is also aware that Fairway sent several notices concerning the late payments. Fairway did not tell ******************** that the negative credit reporting for the late payments would be reversed, and this was confirmed by reviewing the recorded calls with ********************. Upon receiving this complaint, Fairway attempted to contact ******************** by telephone on May 13 and 14, and regrettably we have been unable to connect. We sent ******************** a detailed letter along with copies of notices that were sent to him. I was supposedly pre approved for usda loan told to go shopping enjoy so I did. Found a home sent document after document went on for about 5 weeks to find out because wife has foreclosure that I'm not responsible for it's not on my credit and she is not on this loan stopped the process. But let me spend 400 for inspection 600 for appraisal and another 120 for termite and pest inspection and spray. Started insurance on the home to be turned down. Even signed pre closing papers. I was looking for a mortgage loan. I reached out to Fairway and was contacted by ***************************. I setup a meeting where he told me that my Debt To Income ratio was over 70% and they could only approve loans if DTI was 49% or less. My DTI was NOWHERE near 70%. **** then told me he was starting his own business and tried to recruit me. I file a compliant to have the hard inquiry removed from my credit report which was declined. I was denied credit for a mortgage under false pretense so that Fairway's employee could then use it as a method to recruit me to their business. I got on the phone with **** and said that is impossibley my DTI was over 70% and provided my W2, checking, savings, and additional CC information to prove my DTI. That is when **** tried to recruit me. I would appreciate that Fairway review this extremely unprofessional attempt to recruit customers by claiming customers do not qualify for loans. This hard inquiry would be valid if Fairway honored my credit status and offered a mortgage loan to buy a home. Instead, I am left with a fraudulent hard inquiry on my account that continues to impact my credit score and even making it more difficult to procure a mortgage loan for a home. Fairway, please help investigate and remove the hard inquiry from my credit report as I was able to prove my credit history and income and I should have been approved for a mortgage which would have provided us with a home before the inflation, market increases, and other obstacles that now leave us renting.Business Response

More than one year ago, ****************** provided written authorization to pull his credit report to a Fairway loan officer. The credit report was pulled the next day,and ****************** is requesting through this complaint that the credit inquiry be removed. Fairway is unable to remove the inquiry because it was authorized. ***************** further states in this complaint that the loan officer provided inaccurate information and tried to hire ****************** to work at the loan officers new company that the loan officer was starting up. During a recent call with Fairway, ****************** stated that the loan officer corrected the inaccurate information shortly after giving it, but ****************** still finds it unprofessional that the loan officer offered him a job. Fairway does not condone this type of conversation with a borrower and apologizes to ****************** on behalf of the loan officer, who has not been employed by Fairway for nearly a year. I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.I spoke with Fairway and offered data, W2, and other financial information to prove that I was indeed eligible for a line of credit from Fairway, but Fairway was unwilling to review any of the data. As expect, since the employee has left Fairway, trying to recruit me using Fairway's system, Fairway is unwilling to perform any actions to prove the validity of the information provided. Even though I authorized the credit check, i was lied to by Fairway's employee in an attempt to recruit me to their personal business. I met all requirements but was denied credit by Fairway which makes this credit check invalid. Being lied to by their employee and denied credit which could have been used to secure a home in a very volatile market forced me and my family to sign a high lease while the market continued to get worse. Fairway's unacceptable practices should have consequences but as we know, banks never do. The credit check clearly proves I should have been offered a line of credit which Fairway fraudulently declined to give, costing a hard credit check that will be on my credit report for 2 years with zero accountability to the company and zero credit line offered by the company. The company did not legally provide an offer even with eligibility, therefore, the hard credit check should be removed. Fairway should have been reviewing all lines of credit, yet in this instance, Fairway claims plausible deniability? If no line of credit is offered after meeting all requirements, then the hard credit check should be removed. I gained nothing but trouble dealing with Fairway and I would asvise working with a company unwilling to investigate and improve their own business practices; Fairway has decided to just blame someone else and try to sweep this under the rug like it didnt happen, so I am making sure others are aware of how Fairway does business.

Fairway Independent Mortgage Corporation tried to connect with ******************** several times, but we received no response. Fairway obtained written authorization from ******************* to pull her credit report, so we cannot request the inquiry to be removed as it was permitted. This is true even if a loan is not ultimately closed if the credit pull was authorized,the credit inquiry remains. If ******************* would like to discuss this further, we are happy to do so and she can contact us using the direct contact information that was provided to her. Thank you.
