      I paid my mortgage with them and had the funds returned after days without notice from fairway for both my March and April payments. Once I had noticed I then called and promised to repay the payments to clear the debt which I did, it was also during this phone call that I was assured they would not report the missed payments to my credit report due to the billing error, within 48 hours they reported the missing payment for March to the credit bureaus for both myself and my father who is also on the loan. I was promised they would not do this on a recorded phone call and all of my attempts to contact Fairway have been ignored or I have been denied my request to have the report repealed. They have told me it was possible for them to do so but that they will not due to policy. Beyond this I changed the bank account for them to use for ACH payments and they are not using the account I gave them to do so. I am being charged fees for payments I have made and had the funds to pay. I have been lied to repeatedly and mine and my fathers credit are suffering due to the mistakes of the Fairway Mortgage Company. If there is any assistance you can render to me I am purely grateful, thank you so much in advance for your time and efforts on this matter. -***************************

      Fairway Independent Mortgage Corporation values its customers and appreciates that they chose ********************** as their mortgage lender.  We communicate with honesty and integrity,and customer satisfaction is our number one priority.  ************** Mr. ********* summary of events outlined in his complaint is inaccurate. ******************** is aware that he was late making his mortgage payments and that there were no billing errors on Fairways behalf.  He is also aware that Fairway sent several notices concerning the late payments.  Fairway did not tell ******************** that the negative credit reporting for the late payments would be reversed, and this was confirmed by reviewing the recorded calls with ********************.  Upon receiving this complaint, Fairway attempted to contact ******************** by telephone on May 13 and 14, and regrettably we have been unable to connect.  We sent ******************** a detailed letter along with copies of notices that were sent to him. We appreciate Mr. ********* business and look forward to discussing this matter further with him.

      I was supposedly pre approved for usda loan told to go shopping enjoy so I did. Found a home sent document after document went on for about 5 weeks to find out because wife has foreclosure that I'm not responsible for it's not on my credit and she is not on this loan stopped the process. But let me spend 400 for inspection 600 for appraisal and another 120 for termite and pest inspection and spray. Started insurance on the home to be turned down. Even signed pre closing papers. Not everyone has money to throw away like this it's not right at all

      I was looking for a mortgage loan. I reached out to Fairway and was contacted by ***************************. I setup a meeting where he told me that my Debt To Income ratio was over 70% and they could only approve loans if DTI was 49% or less. My DTI was NOWHERE near 70%. **** then told me he was starting his own business and tried to recruit me. I file a compliant to have the hard inquiry removed from my credit report which was declined. I was denied credit for a mortgage under false pretense so that Fairway's employee could then use it as a method to recruit me to their business. I got on the phone with **** and said that is impossibley my DTI was over 70% and provided my W2, checking, savings, and additional CC information to prove my DTI. That is when **** tried to recruit me. I would appreciate that Fairway review this extremely unprofessional attempt to recruit customers by claiming customers do not qualify for loans. This hard inquiry would be valid if Fairway honored my credit status and offered a mortgage loan to buy a home. Instead, I am left with a fraudulent hard inquiry on my account that continues to impact my credit score and even making it more difficult to procure a mortgage loan for a home. Fairway, please help investigate and remove the hard inquiry from my credit report as I was able to prove my credit history and income and I should have been approved for a mortgage which would have provided us with a home before the inflation, market increases, and other obstacles that now leave us renting.

      Fairway Independent Mortgage Corporation appreciates the opportunity to provide details and context to the events referenced in this complaint.  More than one year ago, ****************** provided written authorization to pull his credit report to a Fairway loan officer.  The credit report was pulled the next day,and ****************** is requesting through this complaint that the credit inquiry be removed.  Fairway is unable to remove the inquiry because it was authorized.  ***************** further states in this complaint that the loan officer provided inaccurate information and tried to hire ****************** to work at the loan officers new company that the loan officer was starting up.  During a recent call with Fairway, ****************** stated that the loan officer corrected the inaccurate information shortly after giving it, but ****************** still finds it unprofessional that the loan officer offered him a job.  Fairway does not condone this type of conversation with a borrower and apologizes to ****************** on behalf of the loan officer, who has not been employed by Fairway for nearly a year.  We thank ****************** for the discussion and wish him the best.

      I spoke with Fairway and offered data, W2, and other financial information to prove that I was indeed eligible for a line of credit from Fairway, but Fairway was unwilling to review any of the data. As expect, since the employee has left Fairway, trying to recruit me using Fairway's system, Fairway is unwilling to perform any actions to prove the validity of the information provided.  Even though I authorized the credit check, i was lied to by Fairway's employee in an attempt to recruit me to their personal business. I met all requirements but was denied credit by Fairway which makes this credit check invalid.  Being lied to by their employee and denied credit which could have been used to secure a home in a very volatile market forced me and my family to sign a high lease while the market continued to get worse.  Fairway's unacceptable practices should have consequences but as we know, banks never do.  The credit check clearly proves I should have been offered a line of credit which Fairway fraudulently declined to give, costing a hard credit check that will be on my credit report for 2 years with zero accountability to the company and zero credit line offered by the company. The company did not legally provide an offer even with eligibility, therefore, the hard credit check should be removed.  Fairway should have been reviewing all lines of credit, yet in this instance, Fairway claims plausible deniability? If no line of credit is offered after meeting all requirements, then the hard credit check should be removed.  I gained nothing but trouble dealing with Fairway and I would asvise working with a company unwilling to investigate and improve their own business practices; Fairway has decided to just blame someone else and try to sweep this under the rug like it didnt happen, so I am making sure others are aware of how Fairway does business.

      Fairway Independent Mortgage Corporation tried to connect with ******************** several times, but we received no response.  Fairway obtained written authorization from ******************* to pull her credit report, so we cannot request the inquiry to be removed as it was permitted.  This is true even if a loan is not ultimately closed if the credit pull was authorized,the credit inquiry remains.  If ******************* would like to discuss this further, we are happy to do so and she can contact us using the direct contact information that was provided to her.  Thank you.

      This mortgage company has incorrectly listed my house as in foreclosure and subsequently up for auction. This issue has been ongoing since around August/September of 2022. When we contacted Fairway months ago when this first began, they said they weren't sure how this issue arose but that "they were looking into it." We have also consistently been told throughout these months that our mortgage is in fact up to date in Fairway's system with no reason given for why it has been listed as foreclosed nor why it is listed as "for auction" on multiple websites (including popular real estate page, Zillow). Throughout this issue, our credit reports and scores have also incorrectly reflected a foreclosed mortgage and late payments. Since this issue began, we have had lots of unwanted post-mail, email, phone calls, and unwanted visits to our personal home/residence by strangers wanting to buy our house and/or help with foreclosure. After this began, Fairway told us they hired a law firm to handle our issue. We were in frequent communication with that law firm and Fairway, and the unwanted visits and mailings/calls seemed to decrease for a time (but not completely, nor was my credit report ever corrected). Within the last 2 weeks, however, we have been informed by a new/different law firm that they have taken over our issue from the initial law firm we had been working with. We called Fairway to confirm this, which they. Since switching to a new law firm, we have again had frequent unwanted calls, emails, and visits to our personal home. This all has led to many frustrations and fear for our family's safety at our own home due to the visits from unwanted people. We have also spent money and time on a sign for our yard to further dissuade unwanted visitors. We have spent many hours talking with Fairway and lawyers, yet Fairway continuously gives us the run-around when we ask why this is still an issue and why we continue to have inaccurate reporting to the credit bureaus.

      Mar 31, 2023 we were in a tornado, our rented house was deemed unsafe, so we checked our options & found rent was more expensive than buying so we contacted a realtor, who referred us to ******/Fairway IM. We explained our situation & were assured they could help, fast forward 7 months, we found a house we wanted to make an offer on, but we could not get anyone to answer our questions, no return calls etc. We started checking with them 10 days earlier as our current preapproval letter would expire in 10 days, previously we just told them nothing had changed & were issued another preapproval. We asked what we needed to do to make sure all went well, no response. Our realtor decided to see if they could get answers & was told when she called to not show us any houses, that we didn't have a real preapproval. We had to insist they share what they were told, the realtor says they were told we hadn't provided requested current check stubs. Which was NOT true they hadn't requested anything even though we asked repeatedly. Since we were this far along w/them we gathered all our paperwork, again even though nothing had changed in the 6 months since they had all our paperwork. We took to them.We contacted ***********************, told her to not refer us to her "team" a week later still nothing but we had to unfreeze our credit & had done so when we inquired as to the status we were told we had to have 3 alternate trade references since we had no actual credit score, we hdecided 11 years ago to be debt free in our senior years and that worked well for us until the tornado, just like the 1st time we applied, they knew all this 6 months ago. Now we've had to start this whole process over wa new lender&we've been living in a room in a relatives house, the new lender is giving us good advise & are working on this. ***************************** team thru Fairway IM messed things up for this senior couple after surviving a tornado & losing everything, home, cars, clothing OUR ENTIRE LIVES LOST

      Fairway Independent Mortgage Corporation sympathizes with Mr. and ************* regarding the tornado hitting their rented house.  Unfortunately, it is necessary for applicants to qualify for a mortgage loan in order to be approved, even if the applicants experience a natural disaster.  The branch spent a significant amount of time discussing the loan requirements with the Kings, and we do not believe there was a lack of communication.  We wish the Kings the best in their quest for homeownership.

      [BS we were told we were pre-approved & have 3 letters, different dates, saying the same, before the last one expired we had tried to contact *****, for 2 weeks she passed us to her "team" who didn't respond much less answer our questions. We knew the expiration was in 2 weeks and we thought we'd found a house to put an offer on, so I tried to contact them so everything would be in place, they didn't respond, so our realtor offered to contact them on our behalf, thinking they might get some answers for us. But instead ***** told them to NOT show us any more houses as we didn't have a "real pre approval" and that they had requested current pay stubs., and we hadn't provided those. THEY ABSOLUTELY DID NOT REQUEST ANYTHING. So we already had ALL the documents they had requested and had already, we added current pay-stubs & bank statements, then ***** tells us we need 3 alternate trade sources, which we had given her our bank statements, which they had already so we did the conference calls with ****** with TMobile, current auto insurance **** & former auto insurance Progressive, statement from UStor of **** years. But then were told thats not good enough, but here's the thing we'd been jacking with Team ****** for 7 MONTHS, so now all our payments are from before the tornado and since we no longer had a place to live, or utilities or bills of any kind due to losing everything in a tornado and now having wasted 7 months. She never told us we didn't qualify until a couple weeks ago, but there were things she should/could have suggested that we do instead of leading us on and wasting our time for 7 **** months, doing c*** that ended up hurting us and causing us to be in a worse position than when this 1st happened.  We had chosen to be debt free 11 years ago as seniors, which worked for us until the tornado. But it caused us to have no credit, we have NO DEBT, NO BAD CREDIT, either.  She never once told us that would cause us to not be able to get financing, NOT ONCE see we didn't lose our home due to anything we did or didn't do, we didn't get evicted, didn't move around, we didn't change or lose a job, didn't not pay our bills and when this 1st happened we hadn't missed or been late on any bills for past 11 years, but now theres a lapse of 7 months, ****** wonder who caused that??? Thank-you Team ******.  Why weren't they honest & we wouldn't have wasted our time & would have done things to improve our situation.  you understand ***** caused us to be in the current horrible position, there were no bills that continued, except TMobile, ****, Ustor since there was no rent, no utilities nothing for the past 7 months, thanks to *****. Now we're stuck living in a room at a relatives house for 8 months now & it should have only been a few months, we're further away from buying a home than when we started. We know & understand "rules" but sometimes there needs to be exceptions, considering extenuating circumstances
      (like for a disaster) and above all honesty presented in a timely manner.

      We lost everything, try to imagine. You can't unless you've lived it, we're seniors we no longer have the luxury of youth , we don't have an extra 8 months, at our ages. We shouldn't be experiencing this at all and we darn sure shouldn't have been treated the way we were in this, its despicable. We hope that Team ******/Fairway sleep well, cause we aren't and its their fault. What a way to treat seniors, I'm sure the media will love to interview us again and follow up on how we're doing after the storm and the wonderful way we've been treated and what Team ****** & Fairway have done to help us, oh wait that's NOT what happened.

      It is unfortunate that Fairway Independent Mortgage Corporation must follow the program guidelines provided by the agencies under the circumstances experienced by Mr. and Mrs. ** but it is required.  It is commendable that Mr. and Mrs. * made a decision to live debt-free, but that decision impacted their credit report when they returned to Fairway for a new preapproval letter. The tradelines they previously had were no longer active as they explained in their complaint, and they no longer had what was necessary to be preapproved.  These circumstances were not within Fairways control or anything that Fairway could have anticipated.  Fairway understands that Mr.and Mrs. * are disappointed that Fairway cannot preapprove them for a loan right now, but we stand firm in our position that this outcome is not based on any action or inaction by Fairway.

      [They should not have lead us on, because of *********************** we wasted 7 months, its her fault that 7 months have gone by, and now we're in worse shape than when we lived thru a tornado. How proud you all must be. There were things we could have done to improve our situation, things that our new lender advised us. Instead we wasted 7 months during which we still had no bills that they would accept. We had cell phones for 15 years, a storage unit we'd had for 13 years, auto insurance, but they wouldn't accept those even though they said they would. Without a place to live, pay rent, mortgage or utilities, we were trying to buy a place to live.  We had 11 fricken years DOCUMENTED, rent, utilities, storage unit, ******** but because she jacked us around for 7 MONTHS, which apparently shows as a "LAPSE" , and then just didn't communicate at all, still has never communicated that they couldn't do anything for us. Course that's nothing new for her.  This was all thru NO FAULT of ours, it was a TORNADO, for heaven's sake, we didn't just change jobs, get fired, move around, get evicted, ALWAYS paid all our bills on time for last 11 years.  We LOST EVERYTHING IN A TORNADO. If you seriously don't have a way to help in extenuating circumstances, you might consider it.  Are we seriously the only ones you've ever encountered that's been in a natural disaster.  *********************** caused us to be where we are now, imposing on a relative, further away from getting a home, because of her, she's the reason we are where we are right now, NOT our decision to be debt free, we had documented payments for 11 years when this all started. ***********************, Team ******/Fairway IM did this.

      Instead they should have advised us things we could do to help ourselves, did they? NO, strung us along, wasting 7 months, that is worse than the insurance jacking us around for 5 months. horrible communication, unprofessional to say the least. They should have been honest & up front, that way we wouldn't have wasted any time with them.

      Fairway Independent Mortgage Corporation last provided a preapproval letter to the borrowers on August 28, 2023.  At that time, they qualified for a loan.  When they came back to Fairway in October,they no longer qualified for a loan.  Fairway understands that the borrowers had to deal with issues concerning the tornado referenced in their complaint, but they must still qualify for a loan in order to continue being preapproved.  The borrowers used strong words in their complaint, stating that Fairway strung them along for seven months and did not communicate properly. This is untrue.  Fairway provided three preapproval letters to the borrowers, and the borrowers did not find a home and close on it before the third preapproval letter expired.  It is unclear why the borrowers find this or the tornados aftermath to be Fairways fault, but Fairway stands firm in its position that we provided excellent service and communication to the borrowers at all times.  We wish them the very best and appreciate the opportunity to provide these details.  Thank you.

      [Nothing about our situation changed, from April 2023 up to Aug 28th, 2023 still at same job, same social security amounts. We're still staying with same relative, still same cell phones, same storage unit, and 11 years documented, with utilities and reference from our former landlord.   No rent/mortgage payments, no more utilities. And NO THE COMMUNICATION WAS ABSOLUTELY MOSTLY NON EXISTENT, REPEATED CALLS, MESSAGES & TEXTS.  Specifically questioned what we needed to do since the "not a real pre-approval" expired 2 weeks after I asked repeatedly what we needed to do. ***** promised to call at certain times, then didn't REPEATEDLY.  There were things we could have done that would have benefited us. She still to this day has not gotten back to me to tell us that there's nothing to do and we can't be pre approved. so NO they did not communicate.  

      She should have been honest & up front, and not wasted 7 months, (yes she did) it was very UN-professional & unacceptable. As our reviews will reflect.

      Closed a REVERSE mortgage with Fairway's ********, ********** office on June 26, 2023.On October 13, 2023, Fairway's corporate based attorney, ************, sent me emails, then on Oct. 17, 2023, I received from ************, papers for me to initial. Today, ************ offered double compensation of $500. to get me to sign a CHANGE IN TERMS that will make the mortgage pay off MORE expensive.I have been offered ZERO proof of this being a "mistake" and, in my opinion, this may be a way they obtain more money for the reverse mortgage AFTER closing contract has been signed. Maybe their ********** staff is, in my opinion, too under supported to make sure the money figures are correct, BEFORE closing, or in my opinion, trying to find a way to gain additional money. I wonder if this is a pattern to take advantage of **********?They must compensate me for the costs this change will make over the next *********************************************** terms. And there is no guarantee that they will NOT come back repeatedly with more "needed corrections" to possibly gain more money from a person on SS and Disability, trying to keep their house.I calculate that the difference in cost to me when I sign their term changes is a MINIMUM of $55,4900.31 (using a mortgage calculator); of course, Fairway has NOT provided me any information about the financial impact of this requested signature for the CHANGE IN TERMS.The cost will actually be It will be MUCH, MUCH MORE because a reverse mortgage has negative amortization, where the pay-off balance increases over time.Please help an old person being by a BIG financial corporation.Thank you, BBB, truly, for your vigilance and help.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Fairway has provided the same broken record response to this problem.  They offer NO proof that this increase in the minimum rate is legitimate 

      and not a whim. Nor has Fairway offered any promise that this would be the last and final change.  There is NOTHING to stop them for requesting more numbers to change to their FINANCIAL FAVOR. 

      They said I signed compliance document; does that mean I am a slave to any change they wish with NO proof that the numbers they want are legitimate?   Would The ************************ (FTC) be applauding Fairway for offering zero proof of legitimacy for the requested change to the contract, despite requests?

      See the comment from the attorney in an email sent AFTER the case opened with BBB. Notice the sentence attorney wrote, regarding the change to ****% requested: "This is not a significant request because the chance the interest rate would decrease to *****% is slim to none."

      I suggest that Fairway leave the numbers as they are (lowest interest rate is currently (0.0%) and have 3 executives:  CEO, CFO, top attorney sign a letter swearing to no more changes to the contract for me and my heirs.    

       How hard is that if they claim it has "slim to none" chance of going to even Fairway's requested higher rate*?

      Fairway Independent Mortgage Corporation reiterates that a clerical error occurred, we reached out to Ms.*********** to assist with the correction, and to date she has refused to do so.  Fairway has not requested Ms.*********** to do anything other than what she agreed to do when she signed the Compliance Agreement.  Fairway would truly appreciate a call from Ms. *********** so we can go over her questions and concerns directly with her.  Whether she agrees to do so or not, there is no further information or responses that Fairway can provide to the BBB in this matter.  Thank you.

      This could be cleared up quickly if Fairway PROVED that the request to CHANGE the contract is NOT a WHIM (or worse).

      Why go to court when Fairway can easily present objective evidence to me & BBB that this request

      is the result of a "clerical error."  

      Your client's viewpoint: How can a client possibly know, for example, that this is NOT

      an alleged dishonest business practice, when no proof to the contrary is offered?

      What is Fairway gaining by withholding objective evidence to resolve the matter NOW?

      Go ahead, Fairway, please PROVE that you made a "clerical error." 

       

      My last offer is still viable, including the request for the letter (see my earlier response)

      to be signed by executives.

      I opened an application for a reverse mortgage. I was required to pay for the appraisal up front. The loan agent I was working with left the company January 2023 for another mortgage company. I did not want to transfer my application. I felt neglected by the new agent at Fairway. Did not continue application. I contacted several individuals for refund of appraisal that was never performed. They located my account and said they would followup. They never have.I still have not received a refund. I would like a full refund of appraisal fee.

      A corporate member of Fairway Independent Mortgage Corporation left two voicemail messages for Ms. ******* upon receipt of this complaint, but we did not receive a call back.  Fairway sent Ms. ******* a check to reimburse her for the appraisal fee, and we apologize for any inconvenience.  Thank you.
