      J.R. ********************** was hired to provide landscaping services at my residence this summer. On May 18, 2020 personnel damaged my property with their riding lawn mower. The damage included significant scrapes to the decorative concrete curb, which need to be repaired by the company that originally installed the curb.The manager in charge of the property, ****, was notified promptly of the damage and provided with pictures and an opportunity to inspect the property. He admitted that his employees were responsible for the damage, but said he would not pay for the repairs and could only offer an apology. Payment for the repairs was requested on at least two more occasions, but **** refused.I contacted the owner of the company, ***** **********************, leaving him 5 voicemails on 5 separate days in July, asking him to call me to discuss the damage that was done and the repairs that are needed. My phone calls were not returned. I sent an email to *****, also requesting that he call or email me to discuss the damage and the necessary repairs.The company that installed the concrete curb has quoted a repair cost of $400. (Please note that the mailing address I provided with this complaint is not the address of my residence at which the damage occurred.)

      The contract for the work we perform on your property was agreed upon and signed by the representatives of your HOA.  We have no specific contract obligation or liability to you personally.  Any claims made by residents of your neighborhood will be and have been communicated directly through your HOA.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      J.R. Boehlke has liability to me because its employees entered my property and damaged my property. You don't get out of paying for the damage your employees did to my property  by simply saying your contract is with the ***.

      Your contract states:

      "The Contractor shall be responsible to the Association for the negligent acts and omissions of the Contractor's employees, Subcontractors and their agents and employees, and any other person's performing portions of the Work under a contract with the Contractor."

      You owe $400 for the damage done to my property. You can either reimburse me directly for the damage, or you can reimburse the *** for the damage. Either way, it is your responsibility.

      I typed May 18, 2020, but should have typed May 18, 2022.

      This business in incredibly unprofessional and unresponsive. I had my garage ramp repaired last Friday. The ramp looks good however during the repair they tore up the crack filler on over 90% of the driveway, gouged a portion of the asphalt, left tire marks all over the driveway and in our grass and left large and small pieces of asphalt all over which I had to clean up. I came home from work and my overhead garage door was open! How do you leave someones garage door open when its obvious that no one is home. I just had my driveway sealed and the cracks filled a year ago by their company. I paid for the supreme package which is supposed to be good for 3-5 years. I was irate so I called ****, the ** and was told, it happens you just have weak asphalt. We typically do repairs before the sealcoating. I requested that he come on site to go over the damage but he was out of town. Why the h*** did you not inform us of this before we scheduled the work? We would have postponed it til the end of the summer or next year. It was not an emergency!! I assumed that care would be taken to avoid damaging the driveway and crack filler because thats what you expect from professionally companies, right? Since **** was unapologetic and down right rude I called to speak to the owner, *****. That was Friday. It is now Wednesday and I havent heard from anyone. Instead, I received the invoice on Monday. I emailed back informing them that I will not be paying a ***** of the invoice until my concerns have been addressed and I still havent heard back! We are hosting my daughters birthday party in a week and a half and are expecting 60 people to attend! My driveway looks like shit! We now have to spend $700 to repair the cracks and refinish the driveway so the driveway doesnt look horrific. I would avoid this company at all cost. Apparently thats their approach with their customers avoidance.

      Hi ******,

      We are sorry that you are disappointed in the service provided by J.R. Boehlke, Inc.  We work to be as responsive as possible to our customers, which is why you were given my cell phone and were texting with you the day of service, Friday June 3. When you were unhappy with my response via text you called me. While out of town, as you pointed out, I answered the phone to continue the conversation. I listened to your complaint and replied. 

      We responded to your concerns on Friday and apologized for any uncleanliness of the job site. We had also informed you that our guys would return to clean up any dirt or debris left when performing our work. I understand that you cleaned it up before our guys returned. We have since had conversations with the team to ensure they leave all job sites clean. Since then, it has rained several times and when we recently went by the property, the dirt has been washed off.

      I personally performed the sealcoating of your driveway last year and I personally prepared the estimate when you asked for a garage wedge. Your driveway is quite old with a significant amount of what is referred to as alligator cracking, which is a sign of subbase failure. 

      We have looked at driveway and the claim that the equipment used to install the wedge tore up 90% of the driveway crack filler that was installed last year is simply not true. Our guys did not even drive on 50% of the driveway. While, unfortunately, it is possible equipment used to install asphalt may have pulled up crack filler in limited areas, regular vehicle traffic and use can also pull up crack filler. Any tire marks that were left from the skid-loader, did not damage the sealcoating and would disappear in time. We apologize if the possibility of tire marks was not adequately communicated to you in advance.

      We have spoken to our crew and they stated they did not leave your garage door open, and watched it close before they left. We agree this is something that should never happen and will ensure that our crew does not ever allow this to happen.

      Had we known that you had intended to install additional asphalt we would have recommended that you wait to sealcoat your driveway until after the ramp was installed.  Nevertheless, given the situation we offered a discount to perform additional crack filling and sealcoat the driveway again, which would have been considerably less than the $700 you have stated.

      We apologize if you perceived our response as rude.  We take pride in our work and actively work to improve our services every day.

      At this point I am not interested in paying your company additional money to sealcoat my driveway. I never heard from the owner which is incredibly unprofessional. Id like the garage ramp invoice to be discounted. I paid $800 last year to have my driveway sealed and was told it should last 3-5 years. Since I only got one year out of the sealcoat, I am requesting a discount of $534 for the remainder of the two years I would have gotten out of it. I refuse to pay the $1400 until my concerns are addressed.

      We would prefer to resolve and settle this matter amicably, and toward that we are proposing two options: 1) J.R. *********************** for no charge, will sealcoat your driveway and will fill cracks where prior filler has been removed; or 2) discount $300 from your invoice for the asphalt wedge.  In exchange, you would remove any reviews or claims/complaints regarding our business.

      If you would like to arrange for these, please let me know at your earliest convenience.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. We would like our driveway sealed and the cracks filled at no cost. After the completion of the work I will remove my negative reviews on BBB, ************ and Nextdoor App and pay the garage ramp invoice in full. Can it be done July 1st? Otherwise, the week of July 4th works too.
