On May 28th I was forwarded and email written by ******************** on May 27th stating that I was scheduled for my evaluation on June 29th. I sent her the $500 deposit via Cash App to reserve that date. In the memo of the Cash App payment I wrote, "For *************************, 6/29 evaluation". On June 11th, my attorney emailed ******************** to make sure that my deposit was still good to which she replied with an email that same day stating, "Going forward, **************** will need to cover the remaining $2500 (which is due the day of his appointment on July 27th) ..." This was forwarded to me by my attorney, which confirmed to me that the final date I was scheduled for my appointment was July 27th. On June 26th, ******************** sent me a text message at 4:32pm confirming that I would be arriving the next day for my appointment. At 8:11am on June 27th, I responded that my appointment was on July 27th. She emailed the courts and admitted that she had made multiple errors with the various communications pertaining to the date of my evaluation. She stated that she was booked out three months, but was willing to perform my evaluation on July 4th, Independence Day. A motion was filed on June 28th where the requirement for an evaluation was suspended pending an agreement could be made between my ex-wife and myself. I requested the $500 deposit back from ********************, and she declined the request and sent an email to my attorney stating that the attorneys were to inform their clients that deposits are non-refundable. A non-refundable deposit was never stated in any correspondence, nothing was signed stating it would be non-refundable, and her professional website states nothing about a non-refundable deposit. I also pointed out to ******************** that the deposit I made was for an evaluation on 6/29, which she was unable to accommodate. I've requested a refund from her and from Cash App, and neither is willing to assist.
