On June 27 ********************************************************************************************************************* my basement. They broke my water supply pipe from my well. and did not use dust containment practice nor wet the concrete while busting concrete. They opened my basement windows and left my door to the upstairs open along with the exterior door. Thus filling my entire house with fine concrete dust. They also left an extremely rough and diverted finish to the poured concrete. The salesperson who sold me this product reassured me that there would be no dust problem and the floors would be finished to a nice smooth finish. When I discover the broken pipe and that I had no water supply I immediately called ABT and told them I need water because I have stage Iv prostrate cancer. I needed to use my toilet, and wash myself, plus have drinking water for meds. They said they would return my call that day They did not. I called and left messages 19 more times that week. No reply until I got ahold of them and insisted a return call. Finally a manager returned my call and asked if they could send someone to look and if I could send a picture of the pipe. I said yeas and sent picture. A few days later the Company VP called and told me he would set up a conference call with me and the sales rep and a manager. That never happened . After that I stated to receive phone calls demanding payment of the remaining bill. I alway told them that payment would be withheld until I could get estimates for damages and then the bill could be resolved. It took a while to get estimate as business were extremely busy and short of help. Before I could could get estimate I received letter from their attorney stating legal proceedings had started and they were placing a lean on my home. As to this day they have refused to admit damage nor send anyone nor attempted to resolve the issue.Business response

Attached you will find the signed contract that shows *** made the customer aware that dust would be generated with the work, and they would be responsible for any additional clean up after our crew cleans up the site after completion. It also states that *** is not responsible for the damages that the customer is stating we caused. We encourage all our customers to read the contracts in full before agreeing and always let them know that dust can be of concern. Lasty, it shows it was agreed upon for final payment to ABT at time of completion.
*** made several attempts to work this matter out with the customer, but he refused to work with ***. We also attached an email from him that stated *** was harassing him by calling him to work this out. Also shows *** making one last attempt to work this out with him, and the customer never reached back out to us to help get this resolved. At that time, we felt it was necessary to turn this over to our legal counsel to work this matter out and take over all correspondence with the customer. The last attachment is the letter from our counsel to the customer to get the matter resolved. They did not hear anything back from the customer with the time frame they had given just like ABT. At that point, the next step for ABT was to have legal counsel send a Lien notice, as it was apparent to us that the customer did not want to work anything out. The customer had not responded to our email and the lawyers letter. If, the customer wishes for the plumbing to be paid for by ABT, he had more than enough time to get an estimate for repairs and to work that out with our legal counsel. The project was completed over 4 months ago on July 1st, 2022.Customer response

Included is e mail communications and an estimate for repairs. But scene then I have learned the repair is more complicated due to state and local codes. A new well will be needed to he drilled because we found out that the existing well has a sand points. That is no longer allowed. I am awaiting the new estimate at this time.
