      We rent from Lexington Management since September 2023. Ever since then it has been a nightmare with the management. Our neighbors have constantly been loud PASSED the quiet time hours listed in our lease contract. We attempted to go over and talk to our neighbors after 4 long hours of non stop banging and screaming. At this point it was 11:30pm, we politely asked if it was them making the noise if they could be a little quieter because we get up for work at 4am everyday. The woman was drunk and said her 2 children (one aged 2 years old) were upstairs playing. A month or so went by and the noise continued EVERY NIGHT. we brought this up with our landlord and our apartment managers. We attempted to call over and over to talk to someone about this issue with Lexington Management. Not once did they offer help. They only told us we needed to contact the emergency police. One morning at 5am my roommate and I were leaving for work when the neighbors we have had the problems with stormed into our garage and threatened our dog and told us all the noise was our fault and we better f****** stop or something will be done. They put notes in our yard and we feared for our safety so we called the police and reported this. Even after contacting the police and reporting this with our apartment managers, Lexington Management did not care. We told them we were scared for our safety and wanted to meet in person with them and they told us that is not necessary. We are now in January and still are having problems every day and night with the noise and the last email I sent to the managers at Lexington Management was on January 3rd and I still have not received and email back. They are not addressing any concerns we have. We have been threatened by our neighbors and they still dont answer our phones calls or help with any issues. We want them to step in and tell the neighbors to be quiet, since it is listed in the lease that there is a quiet time. And to address further issues.

      While we appreciate that this has been a frustrating experience for ********************, we have not been given sufficient evidence from either her or any reports from the police regarding excessive noise. Lexington Management will address lease violations when they occur, but in the absence of a lease violation this becomes a civil matter between two parties. While we want ******************** to be happy with her experience as a tenant with Lexington, it seems as though we have come to somewhat of a crossroads.

      We will continue to maintain the status quo and attempt to address any issues that she reports to us as efficiently and effectively as possible. However, if she has come to a point where residing in her current unit is no longer a desirable, she has been asked to please let us know, and that we are willing to offer her the option to vacate and release her from her lease obligation.

      If this option is chosen, she would have the choice of vacating the unit by 2/29/2024, or 3/31/2024 and to let us know by Friday, 2/9/2024.

      I was a former tenant of Lexington Managment's "Knots Landing" apartment complex. After re renting my apartment to new tenants on March 21, 2023 I went on to our portal and removed the banking information after paying a $500 fee for re renting, that previously we were NOT going to be charged. Upon opening my email this morning I found my bank account to be negative $779 due to a $1025 and $1.25 charges from lexington. I called them immediatly and asked for clarification, and my money back immediately. I was transfered to another employee, a woman who became confrontational upon me demanding my money back. Regardless if our payment information was removed from the tenant portal or not, NO FURTHER CHARGES should have been made on our account once they re rented it. I consider this to be fraud and theft. I was told they would "call me back" when they had time but I was not allowed to speak to any managers about this. I called my bank and am told a 10-day waiting period for a STOP PAYMENT. I am now going to lose my health insurance coverage, my phone is going to be turned off, and my internet shut off-which is how I work from home due to them over charging, illegally stealing money they had no right to take, and now giving me run around and attitude when I called and demanded my money back. The only response I was given was "well the other person on the lease (my elderly mother) removed payment info on 4/1 but it didn't save. If this isn't resolved by the end of the business day, I'm asking for 25% interest on all money illegally taken from my account, per day.

      On 1/06/2023 i had an inspection done on my duplex because my lease was ending. While they were doing the inspection my mom was over with her puppy and i have a gecko in the downstairs room. After they left that Day there was no mention of the animals That they had seen all that was written was that I was not supposed to have candles in the house in which I removed afterwards. After they did inspection three days later they sent me an email to renew my lease with no mention of the animals. They gave me until the 20th of January To either renew my lease or give them a 60 day notice. on the 18th I put in my 60 day notice because we had recently been approved for a home. The next morning I got an approval email from them saying that they approved my 60 day notice. Right after that I received emails from them giving me a notice to vacate the premises within five days because of the animals that they had found on the property. Before I put my notice in they never mentioned anything about animals or giving me a five day notice so it seems retaliatory. They also said that we owe them $1000. they fined us $500 per animal which is not in our lease, its $500 per occurrence but they added whatever they wanted to our lease. they said that if we did not pay that we needed to be out by this Thursday . We have tried to contact them to dispute The situation but they will not return any of our phone calls or emails. We were willing to pay the $500 that we owed for having the gecko but we did not want to pay an extra $500 for something that wasnt in our lease. They came to our property three different times to serve us a five day notice, Other than that we have not been able to contact them on any matters going on. We need help! I have two little boys and i need to figure out our living situation.

      Dear ****,

      The inspection on 1/6/2023 was a standard in-unit inspection that is performed annually in each our rental units. This inspection is unrelated to your lease end date.

      When you say the inspection was done because your lease was ending, that is not true.

      During the in-unit inspection the animals were noted, but because we do not have documentation about whether animals are approved in that moment, we do not make assumptions about that or question our renters during the inspection.


      Your lease renewal letter was mailed to you along with all other lease renewal notices that were scheduled to go out for renters whose lease end date fall on 4/30/2023.  Again, this is unrelated to your in-unit inspection, and the animals were not a consideration in your renewal process.


      When you received your 5-Day notice and fine regarding the unauthorized animals, it was due to the inspections team finalizing the inspections from that time period. Depending on how many inspections were performed that week, the data that was collected, the day of the week the inspection was performed, etc are all considerations as to when the reports are finalized. Once the inspections team determined that the animals found in your unit were unauthorized, you were sent the 5-day notice and fine.  This would have been the case whether you decided to move or decided to renew your lease.


      We have documented several phone calls where the other lease holder in your duplex spoke with ****** and ***** from our corporate office regarding this issue. Implying that you cannot get a hold of anyone is untrue. In fact, your roommate had recently spoken to ****** about working out a payment plan, which had been approved.


      ********* Statues require that the Landlord use reasonable diligence in serving 5-day notices. That means we must attempt to serve it more than once before we can post and mail it. That is why we were there more than 1 time.


      Lastly, the lease that you attached to this complaint is not your lease. Your lease states the following:

      PETS: No pets of any kind, including caged animals, are allowed on the Premises at any time. No visiting pets allowed. The only property that allows a maximum of 2 cats is ****************. The only properties that allow a maximum of 1 dog are the following: Urban Edge and *******, ********** in the Cabeletta and Cadenza floor plans only and Bridgewater in the Townhome and Lower style units only. Pets are ONLY allowed when there is a signed pet agreement in place and all required deposits and fees are paid. Breed & weight restrictions apply, details displayed in the pet agreement. It is the responsibility of ****** to notify guests of the pet policy. A $500.00 fine, per occurrence, per animal, will be assessed if an unauthorized animal is found or seen on the Premises for any amount of time. This fine in no way grants permission to keep a pet on the Premises and will be considered a default under the Lease Agreement. Aquariums over 12 gallons are not allowed. Only 1 aquarium is permitted up to 12 gallons. Any aquarium found that exceeds the 12-gallon limit will be considered unauthorized and a $500.00 fine will be charged. Any size aquarium found to be housing anything other than fish, will be considered unauthorized and a $500.00 fine will be charged. (attached)


      Accordingly, you were charged $500 for the gecko, and $500 for the puppy.

      I relocated to ********* for the purpose to obtain a degree as a nurse practitioner. Lexington assured me that the property was smoke free. Not only is cannabis smoked on a continuous basis by the nearby tenants, my neighbor is growing cannabis in his home along with running generators continuously causing my Co2 detector to gain levels over 100 PPM. I have alerted the management company via email, telephone, and text without resolution or acknowledgement of the issue. They are also aware that I have a documented disability. Police have been called and was in agreement that they smelled marijuana and heard the generators. This has had a negative impact on my health and am seeking new living accommodations. Since I have lived at the Lexington property, I have had severe health issues such as, headaches, blurred vision, nausea, and shortness of breath. I am an ICU nurse and I am familiar with CO2 intoxication. Lexington Management is not concerned about the safety and welfare of the individuals who reside here. They are not taking any action to correct this issue for the health of their tenants. The photo attached is the running value of CO2 in my home, but has reached 120 PPM on a regular basis. It is difficult to breath at times and I am forced to leave my home for several hours before even semi-safe levels resume.

      The only assurance any prospective renter has or is given about the property being smoke-free is what is stated in the lease agreement and in our advertisement. If a resident is visually seen and documented as smoking on the property, then a fine in accordance with the lease is issued.

      After we were made aware of ************** complaint, we issued a warning notice to everyone, as a reminder, regarding the no-smoking policy. 

      Additional attempts were made to find the cause,including obtaining copies of the police reports that resulted from ************** police call, none of which provided any usable evidence. We woujld not disclose to any other tenant what actions have been taken regarding another tenant, so ************ is not informed if or when we enter another unit, and certainly not the findings. ************ has stated that she has talked to the neighbor in question before, but she did not visually see anthing while trying to look over his shoulder. Her statement that "my neighbor is growing cannabis in his home along with running generators" is all based on suposition, not fact. 

      To say that Lexington is not taking any action is also false. It is just not disclosed to her which would be inappropriate and would violate the other tenant's privacy.
