      10/12/2021

I'd like provide no stars, but unfortunately that's not an option. June of 2021, while on a family vacation with my sister, nephews and parents, we contracted COVID. While my parents, sister, and nephews were driving home they fell very ill and stopped to rest in Tennessee to rest. My father, unfortunately, began having breathing issues and was admitted into the hospital, followed by my sister the next day and my mother the day after that. All ended up having to be admitted into CCU. The following week, my father passed away of COVID complications and two weeks later my mother passed away as well. After suffering such a terrible loss, my sister and I have been spent the past 2 moths dealing with everything regarding our parents estate, which brings me to our beyond HORRIBLE Bergstrom Experience. Prior to going to Bergstrom to sell back our parents 2021 Subaru Outback Limited with 4700 miles, we had worked with our lawyer to obtain the necessary paperwork that established me as the Rep for their estate. Per our lawyer, all we needed to do was pay off our parents car loan, take the title in with my PR paperwork and Death Certificates, and we could sell it back to the dealership without any need to retitle anything. Our lawyer stated that because the car was titled in both their names as OR rather than AND, we could legally sell the vehicle because it became part of their estate. Our father passed away 2 weeks from our mother, making the vehicle legally hers without the need to retitle, but because she passed, it became an asset of their estate and there is no need to retitle on our part to sell it; only if we were to keep it. I called their loan provider, paid off the loan, and they too confirmed because of the nature of situation, we did not need to do anything beyond take in the title and my paperwork and we should be good to go. My sister called Bergstrom on one occasion to verify this and even stopped into their location a week prior (9/27-10/1) and spoke to someone in person to confirm everything. ALL SAID THE SAME THING.....until today. We went in with the car and all the documentation and the first person we talked to had no idea what we where wanting to do. She told us we had to bring in our Power of Attorney, which is null and void the moment the person dies so that was a line of crap. I told her, I am the Rep for the estate and I have the paperwork here that states this to which I provided a notarized letter stating as such. She then excused herself to speak to her manager and took our paperwork. Then she came back needing to see the original contract again, then left. When she returned she said we needed to get the car retitled and my sister told her who she spoke with, face to face, which was exactly the same as our lawyer and the loan company, that we did not need to retitle the vehicle because of how it was titled and as the PR of the estate we can sell the car. She again left the room and came back with her "manager" who immediately said "we have a problem" and proceeded to tell us what the chick said. I told him flat out it was BS and continued to use some "choice" words when I told him that we didn't have a problem based on what 3 separate people told us. He became very curt and said the only way I, the state appointed PR, could legally sell the car is that it had be part of a trust established by the estate and since the estate is titled in my mothers name, not my fathers name too, we needed to retitle it. Which I replied that we were done dealing with Bergstrom and their BS low blow offer on a car that only had 4700 miles on it, and we left. Yes I continued to use profane language with him because of his attitude and complete lack of customer service. He asked me to leave, which we planned on, and yes I spoke very loudly with a few choice words to describe my distain for their company. Yes my father passed before my mother, however, when he passed, she became the the widow of the estate and inherited everything. But she passed, hence way the estate is in her name. Luckily, we took their car to Gustman's who told us flat out that Bergstrom is incorrect, we DID NOT need to retitle because of how it was titled and that my PR paperwork and death certificates where all that were needed. From that point, they took care of everything for us, offered us more money, and even called their finance manager who had just left for the day, back in to cut us the check so we wouldn't have to return the following day. After they took the copies of our paperwork, the salesman's manager personally came out to offer his condolences and hear our story. After everything was done, the salesman even gave us his cell phone number and told us to contact him if we need anything. We are so grateful to the kind and very helpful folks of Gustman Subaru for helping us after the truly HORRIBLE experience at Bergstrom. It's extremely frustrating to have all your "ducks in a row" PRIOR to coming in only to be told we were in the wrong EVEN THOUGH we were told by 3 separate individuals from 3 separate companies on 3 separate occasions that we did not need to retitle anything. We're glad Gustman's confirmed with us that we were correct and was able to save the day. I will never in a million years ever step foot in a Bergstrom ever again for the rest of my life and if my parents were alive, they would do the same thing!
