In July 2020, we hired Premier Outdoor Services to design and install new landscaping on our front, side and back yard.In total we paid Premier $11,190 to perform the work in the attached statement of work/contract.We contact ***** at Premier about a dead tree and **** in the Spring of 2021, he stated he was having labor issues and we agreed to wait until July to have the tree and **** replace, as guaranteed in our contract (Page 2 "III.Premiere Outdoor Services LLC provides warranties on products and services installed for one (1) year from date of install. I understand that all implied warranties are voided in Act of God conditions."). July came and went and we did not hear from ***. After numerous attempts (at least 4-5) and not receiving a return call. He finally got back to and asked us to give it the year to see if the tree and **** would "come back". They did not and are still dead in my backyard. ***** has stated that he would only send us a check for $150 total for the tree and ****. The tree is a 10-foot-tall tree and I do not have the equipment to remove and install this size of a tree. We asked ***** on the phone to just take care of this and we did not want to have to take him to court to fix this, at this point he got very upset and said, "go ahead and see what good that does, I did not guarantee the tree and ****".We contacted WITI ********************* in ********* for assistance, they responded to ** that after 8 weeks Premier Outdoor Services did not respond to them and they are not able to help us resolve our complaint.Please help.***************************Business response

Customer was offered cost of tree. Customer is upset because they think that Warranty of Materials covers the installation as well. I offered to give customer a refund the value of the Tree and I was told "see you in Court" no offense but I took that a bit amusing over a $150 tree. We installed almost 7k in landscaping and CUSTOMER STATES WE DID A GOOD JOB! yet beware because we only cover the dead tree and not the labor of the replacement.!!!
Now keep in mind that this took place last spring my willingness to pay the $150 value of tree to them and the Customer waits until right before said season is about to begin to splatter this all over the place and leave 1 star reviews even though we did a good job! their words exactly!!!
Sounds like a planned attack to me maybe a little bitter cause they are not getting thier wayHowever after them running to every site they can find 9 months after offering to pay for the tree itself and bashing me with 1 star reviews now I refuse to do anything
