We paid a $9500 deposit to KCD Fence Builders LLC to install new pvc fencing at our home at ***********************************************************. We signed the contract on 7/7/2023 and paid the deposit of $9500 on the same day with personal check #****. Installation of the fence was to begin on 8/7/2023. On 8/6/2023, we contacted ***************************** to confirm the work would begin. ***** informed us that he was delayed on another job and would start on, 8/14/2023 at our home. On 8/14/2023, ***** did not show up to do the work. On 8/14/2023. we contacted ***** who again informed us that he was delayed and would not be able to start the work until 8/21/2023. He also stated that he would contact ***** (gas company) to mark the property gas lines as well as pull the building permit. On 8/20/2023, we reached out to ***** by text to confirm the start date of 8/21/2023, since ***** had still not come to our property and ***** informed us he would not be able to start due to some legal obligations he had to attend to that week. At this point, we told *************** was in default of the contract we signed and would would like a refund of the $9500 deposit that we gave him on 7/72023 that he cashed at his bank. ***** stated he would get the refund to us. On 8/25/2023, we contacted ***** to find out when he would be dropping off the refund, he stopped answering our calls and our text messages.
