    Government Action: BBB reports on known government actions involving business’ marketplace conduct:

    Minnesota Dept. of Labor & Industry Consent Order
    On January 10, 2022, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated the terms of the Consent Order signed in July, 2021 by not submitting a new 'Responsible Licensed Individual' (RLI) as required, which resulted in the termination of their electrical contractor's license. On December 15, 2021, the business submitted an application to reinstate their electrical contractor license.  Under terms of the Consent Order, the business agreed to ensure all future communications with DLI are truthful, accurate and complete. The business also agreed their RLI is a W-2 employee and is actively engaged in electrical work for the business and not employed by another business and to ensure that all individuals performing electrical work, including installation of solar panels are W-2 employees and properly licensed or registered as electricians. The business shall pay a $4,000.00 penalty, which is stayed on the condition they comply with the terms of the Consent Order. The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details go to the below link.

    On July 15, 2021, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11 (b) (2) (6) and (9) (2020). Under terms of the Consent Order, the business agreed to ensure all future communication with DLI, including applications for license renewal, are truthful, accurate and complete and until the business designates a responsible licensed individual and employs a Minnesota licensed master and journeyworker electricians to perform solar system or solar panel installation, all advertising shall include a disclaimer prominently stating solar system installations are performed by Minnesota licensed electrical contractors. The business also agreed to ensure that all registered unlicensed electricians only perform electrical work while under the direct supervision of the business's Minnesota licensed master or journeyworker electrician employees.  The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.     Pattern of Complaint

    On January 20th, 2023, Sun Badger Solar LLC was sent a letter for a detected pattern of complaints. These complaints pertain to consumers stating that they have paid a deposit for work to be performed, and the work has not been completed, or in some cases even started. Consumers also state that it has been difficult to reach anyone at the business to attempt to remedy these issues. Phone calls and/or emails are not being returned. 

    On January 30th, 2023, BBB received a response from Sun Badger LLC regarding the pattern of complaints inquiry:

    "Thank you for reaching out. Unfortunately, Sun Badger has been struggling through some adversity at this time, directly related to the federal rate hikes and talks of recession. Our primary solar lenders changed the payment structure for 90% of our customers, which resulted in a substantial decrease in cash flow. This decrease led to a missed payroll and subsequent furlough of a large portion of our staff, hence the lack of communication. 

    Our goal is to secure funding and work toward rebuilding Sun Badger from a personnel standpoint. We are hoping to leverage subcontractors and install partners to fulfill many of the outstanding projects. We have also paused all new sales or marketing initiatives in all states and have not contracted a new customer since this adversity hit. It is our goal to address every customer concern when we are able to."

    The Dane County Sheriff's office launched a criminal investigation into the business practices of Sun Badger Solar in early April, 2023. The Waukesha, Wisconsin solar installer allegedly shut down in January, 2023.
