      I signed a contract for a deck and basement remodel last year in October 22 with Berm Construction, I will attach copies. We went back and forth with me pleading for him to finish the job, at least the basement, and he kept putting me off, giving me change orders, and saying I needed to pay the draws and change orders right away. I have paid $48,000 to date, by February of 23, and essentially nothing has been done towards the deck since then. The basement was not finished well, there was a lot of punch out work that still needed to be done, and the a/c had not been hooked up again from when he disconnected it to move it. I had to hire an a/c company to see what was wrong once he did hook it up, and he blamed my thermostat, but it was low 2# of freon. He sent me another change order bill of $3100 when I threatened him that he needed to finish it, and I was tired of waiting. I had a lawyer write a letter to him after 7 months saying he had the specified time to finish the job, or he was terminated. The problem is that his draw schedule had only $5,000 left. He has not done the door, nor the deck, but has left six 4 deep holes in my yard 2 wide!!! We have demanded an accounting of funds, materials delivered to site, and he ignores it all. Said if I sent him the $3100 change order money, hed pour the footers with concrete. I dont trust him. He would not say he would finish the deck. There is only $5,000 left!!! His mother said she has no control over him, and is very sorry, but you have to do what you have to do! She is the one who signed the contracts. It is going to cost me at least $25,000 to get somebody in now to just finish the deck, not including the door. The yard is very unsafe, and I have been having trouble sleeping for months now knowing that I have been scammed. I want the $35,000 back to get the deck completed and door put in, that were part of the contract I signed with him.
