      On the morning of 4/13/2023 North Central paving poured blacktop in my driveway, for which I paid a total of $8,450.00. At that time overnight temperatures were in the lower forties in the **** ***** ****** ***** area. Mr. ******* of North Central paving started pouring blacktop at 9:00 a.m. the temperature being 50 degrees and no sun on the problem area until mid afternoon due to garage blocking sun. The blacktop is pores, uneven, edges high in sever places, and blacktop was spread approximately 8 inches into part of mulch bed and 4 inches high 7 ft long where it is now touching the Alberta Spruce tree. I have since gotten another scooter for my handicap due to getting hung up in various places with the one I had since the edges of the blacktop are high and uneven. I contacted Owner ***** ******* 4/14/2023. She and her son stopped by my home 4/17/2023 and asked how much I needed to settle and when I said fix it. They Left and I saw Mr ******* looking at the driveway in early May and discussed with him cutting away blacktop from tree-no answer- no response. Called him on cell phone 5/12/2023. said he couldn't talk and would get back to me, and never returned my call. I sent a letter to North Central Paving 7/2/2023 - no response.

      On April 13, 2023, we paved Mrs. ******* driveway.  When I got up at 6:00 a.m. the temp was 41 degrees and sunny.  The first truck loaded at 9:21 a.m. at which time it was in the upper 50’s.  The trucks arrived on site at approx. 10:00 a.m.  Mrs. ***** was present while the work was being done.  She did not stop the work or make a complaint about the work they were doing.  She paid in full after looking at the job.

      On 4/15 she called the office and I spoke to her.  Her complaint was the water wasn’t draining.   I referred her to my son, ****, who was on site.  He told her that he could not come Saturday but would be there on Monday.  We both went there Monday.  She stated at that time that the water wasn’t draining properly and it would cause foundation damage.  She got a water hose and attempted to illustrate that the water didn’t drain, it did drain.  She then stated she didn’t like the appearance of the parking area.

      She only complained about the upper portion of the driveway, she stated the lower part was fine.  I offered to seal the upper portion at no charge, she said NO, she wanted it fixed by removing the asphalt on the upper portion of the drive and redoing the asphalt because it didn’t drain.  We said we can’t do that, it is draining.  At that point it was clear we could not come to any resolution to the matter and we left.

      **** went back out and spoke to her again.  He purposely went when It was raining and he pointed out the water was draining.  This time her concern was about the driveway being too far into the mulch bed and the edges of the driveway were too high.  She informed him we did terrible work, someone had told her it was the worst job they had ever seen.  We have no idea who this expert is.  She told **** we had used our second team employees to do her job.  She was belligerent and rude.  We have only one “team” and they take pride in their work.

      **** went back one more time, this time to take pictures showing the water draining from the driveway.  He did not speak to Mrs. *****.  We received a letter from her dated 7/2/23.  We asked our insurance agent to contact her as a neutral third party since we had gotten nowhere.  She did not answer the phone and he had no way to leave a message as she apparently doesn’t have voice mail.  We do not have a cell number.  When we asked for that on the first visit, she said she did not give it out, to call the land line.  We had asked our agent to tell her we would cut the asphalt (an area approx. 8” x 2’-3’) where she indicated to take care of the mulch bed issue and that we would put dirt along the edges of the asphalt where needed.

      I’m not sure what is happening at this point.  The complaints have evolved over time and we are unsure exactly what her issue is now.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. 

      According to my **** **** **** and **** ***** *** North Central Paving started paving my driveway at 9:00 a.m. on April 13, 2023 when temperature was 50 degrees. 

      On 4/17/2023 Ms ******* and son witnessed water running across walkway near the foundation.  **** stated I was forcing the water with the hose.  After moving the hose further away it did not stop the water.  They could see there was a water problem, along with condition of the driveway, mulch bed and sides of blacktop. Ms ******* asked how much it would take to satisfy my complaint. My reply was I needed it fixed or I could get an estimate to have some fix it. The conversation ended. I stated comments that were made about the driveway, but at no time was I belligerent or rude. There was no offer of sealing the driveway, fixing the mulch bed or edges of asphalt.

      Ms ******* stated she did not have a way to contact me. She called my cell phone 4/12/23 to inform me a worker had been hurt and depending on his condition may not be able to do the blacktop the next day. I do have voice mail and check my messages daily.

      After completing the job, **** and associate came to front door and tried to explain why the blacktop was in the mulch bed.  Due to my disability could not inspect the driveway until next day. I trusted they had completed the job as it had been done the last 2 times in the past and paid in good faith.

      The water problem as of now is not a problem.  Putting pressure on the hot asphalt during the hot weather packed the area enough to reroute the water to the mulch bed.

      We were contacted by ******* ***** on Thursday, September 7. ******* is **** ******* son and lives there with her. He paid 1/2 of the cost of paving the driveway. ******* left a phone number so that we could contact him. **** called him on Saturday, September 9. ******* asked if there was anything we could do to resolve the driveway issue. **** told him we had proposed a solution but his mother had refused to accept that. He asked what the proposal was. **** told him we were willing from the beginning to seal the upper portion of the driveway, cut the portion of the driveway which she says is too far into the mulch bed and put dirt along the edge of the driveway.
      He asked if that proposal was still open. **** said of course, we were willing to do that all along. He said if we were willing to do as stated, just plan to do it so this could be taken care of. **** contacted him on September 14 and he confirmed that his mother was OK with our proposal. **** told him we would get in touch as soon as possible and get this taken care of. This should resolve the matter.

      Offer should have been made in the beginning. Blacktop was poured when it was much too cold. This being verified by my ring cameras and the weather service at that time. Audio and video technology should make us aware of our surroundings constantly.
