The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.
Update - On June 7, 2023, Judge Joseph Reeder from the Putnam County Circuit Court, West Virginia, issued a temporary injunction against The Defendant's Gary and Veronica May, Tyler May, and Joshua May. The injunction barred them from selling, installing, repairing, or remodeling mobile homes without a license and from harassing consumers who complained to the Attorney General's office, and harassing employee of regulatory agencies, and even the media. The injunction also barred the Mays from selling any real property during the pendency of the case.
On March 23, 2023 the West Virginia Attorney General Patrick Morrisey filed a lawsuit with the Putnam County Circuit Court against Gary May, Veronica May, Tyler May, and Joshua May d/b/a May Brothers Mobile Home Movers who allegedly engaged in the sale, installation, repair and remodeling of used mobile home without a business registration certificate from the tax department or the Manufactured Housing Board and the Contractor Licensing Board. They are charged with falsely representing to they public they are licensed to sell, install, repair, and remodel used mobile homes, and engage in plumbing and electrical work without required license; Failing to transfer title for mobile homes, selling mobile homes that are not merchantable, failing to make promised repair or fulfill other obligations, and failure to furnish proper notice of three-day right to cancel. Charges filed allege the business is in violation of the West Virginia Consumer Protection Act (WVCCPA), West Virginia Contractor Licensing Act (WVCLA), and the FTC Rule three-day right to cancel.
The action seeks to permanently enjoin the Defendants from engaging directly or indirectly, in the sale, installation, repair, or remodeling of used mobile homes or in the provision of home improvement services as the owner of a business, an employee, agent, subcontractor, or in any capacity in West Virginia. The State is seeking a civil penalty of up to $5,000 for each violation, voiding all agreements made between the Defendants and consumers without penalty, requiring the Defendants to provide clear titles with liens to all consumers who purchased a mobile home from them, awarding the state for all amounts they collected from any consumer for the sale, installation, repair, or remodeling of used mobile homes or the provision of related home improvement services, and awarding the state a judgment for all its costs, including reasonable attorney's fees.
