I won a bid on a property at *** ***** ******* *** ******* *** on October 7, 2022. I was entitled to a refund of my deposit for $8,525 because they could not close on December 7, 2022. I was coerced into signing an extension to December 30, 2022. Furthermore, Ms. Kim *******, from ******** **., informed me that they would not have been able to close on this house and should have been offered a refund on December 7, 2022. Due to the delays I was homeless and stayed in a hotel. I tried to resolve the with their General Manager, Mr. Alan ******** and he left a vey rude message that “they were able to close and I will not get my deposit and to stop calling them”. When I called to request proof that they were able to close he said he couldn’t give me anything. I am requesting that my earnest money be returned to me as soon as possible. In response to the complaint lodged by Belinda ****** regarding her default on a real estate purchase agreement:
In short, her claims are factually incorrect. At no point was the seller unable to convey free and clear title to the real property. In fact, we sold another property for the same estate and it closed without issue. The sellers granted Ms. ****** an extension to allow her additional time to complete the purchase. When she still could not/would not close on the property, her earnest money deposit was forfeited per the terms of the purchase agreement. While we cannot address specifically what was communicated to Ms. ****** by the title company, we can confirm the title company did inform us there was no issue with the title to the real property.

on october 13 2022 I bid on a vise in an online auction. I won the vise for 75 dollars plus the auctions 15 percent fee for a total of 86.25. when I went and picked up the item it had been broken and welded back together which isnt safe with a vise if the repair wasnt done by a certified welder and weld inspected by a professional. there were no mentions of a break or a repair in the description of the vise online. the pictures online did not show the break and repair which were intentionall because it was so obvious seeing the vise that it had been broken and repaired. i bought a product that I cant use because of safety reasons. i contacted the auction company and their reply was did you attend the preview before bidding. i did not attend the preview because the item looked to be in perfect condition in the pictures and the description had no mention of damage. i can not use this vise because it is not safe. i feel that they sold me an item that can not be used and I should be refunded the full amount paid for the item.Business response

Pyle's auction software misfunctioned and failed to allow me to register to bid on a home on ***** ***** in cross lanes, wv. Requests to resolve the software glitch were ignored. I was unable to bid and unable to purchase the home. Calls to the Pyle Realtor are ignored. A call to the corporate office has not resolved their screwup. I must be awarded the home or a comparable property.Business response

*** ******* *reated a user account prior to the auction. Our agent talked to *** ******* numerous times prior to the auction and tried to walk him through the process of how to place bids. He became frustrated and asked that we "bid for him" which we cannot do in an online auction environment. We heard nothing further from *** ******* until the day after the auction concluded. We had 22 bidders successfully registered for the auction, and the auction proceeded without incident. *** ******* has repeatedly called our agent that handled the sale, including on her personal phone (we have no idea how he got that number), called our main office numerous times and became quite hostile, and sent several emails. This is a case of user-error, not software failure.
