      On Dec. 3rd, 2021, I had Case Concrete, owner Terry Case, from Green River, Wyo., come over with his crew after I told him what I wanted with my approximately 16' X 73' long driveway. I told him I wanted it sloped to the south, so water wouldn't go back toward house foundation and we agreed on this plan and and he stated he would also put a drainage channel on southeast section of driveway along utility shed, to channel the water to the east after rain or snow melt. They poured the concrete and I noticed that it never looked sloped, and asked Terry, the owner, if they sloped it away from the house/foundation and he said they did slope it with a 3-4" drop in 16 feet. When they got all finished, I asked Terry if he guaranteed this project and he said I guarantee our work. The crew finished up and Terry stated one person was going to stay over at a motel and put the concrete blankets on around 9:30 or 10PM, and I texted him at 10:09 after I checked and they weren't on, so supposedly they got put on after 11PM that night. We had a hard wind on Dec. 5th and blew blankets off and so I texted Terry and, he said he would come over from Green River, which is 65 miles from here, and I told him my wife and I would put them back on and weight them down so the wind wouldn't blow them off again. We have copies of all text messages and the timeline is well established for all conversations. The 1st rain/snow was like Dec. 6th and the moisture never flowed to the south and pooled all over the driveway and flowed in parts back toward house, so I put a level on it and it is completely level and no slope whatsoever to the south. It has continuously cracked on every section of the driveway Anyway, since 2021. he has stated he will make it right and after 80+ text messages, he has had one excuse/promise after another and has not shown up to re-do this driveway. He was suppose to be here today, July 10, 2023 and as usual haven't heard back from him. Over 1 1/2 years waiting...

      7/272023 I along with Art Maestas (concrete hand) arrived at 1420 east second west avenue kemmerer Wyoming. To inspect driveway. Jim Vilos Stated that this driveway has no water run off going to the south of the driveway. This is not true. Using an engineer's level, several places approximately 20 places the level was set and pictures taken. There was not one place that there was any flow going back towards the house. The minimum of 0.5 %, the maximum was up to 2.85% of fall going towards the South and towards the West was recorded. Jim mentioned the concrete cracks.  After pouring concrete control joints were added to try and control where concrete cracks. Concrete does not always crack where we wish it would.

      I find it amazing how this contractor lied from the start about everything, from the slope of the driveway, which he said was sloped 3-5" to the south, lied about he would take care of it and "make it right", lied about coming over to get with me and check it out for over a year and a half, with all the copies of messages, I sent. THEN, he sneaks over and lays a level down in one spot and with a pair of binoculars, you still can't see where the level bubble is located, without our permission or knowledge! You would think that a legitimate contractor who is interested in doing a good job for customers, instead of ripping them off would make the fault correct. They didn't even complete the cement work they said they would do, putting a tapered drain by using cement to drain water to the south side of propert so water could drain south and them east along utility shed. Please find the CLEAR pictures of exactly where he put his blurry "engineer level"! This is "shoddy" work and these types of businesses need to have their licenses revoked. Please find the enclosed pictures and by all the previous sent messages, you will see that this contractors statement is a flat out lie!!

      This contractor can't even put down the correct address. The correct address is: 1420 2nd West Avenue,  NOT: 1420 East Second West Ave. All the copies of messages I sent to BBB clearly shows he was trying to get out of doing the job right. He was hoping we would forget about it. I saw another complaint from them on BBB website similar to mine, and a D+ rating.  Complaint #20336207.

Pictures do not lie as to the slope of the driveway.  There is nothing to make right. The driveway slopes. As far as the cracks there is a product made that can be put into the cracks. The job was complete  as last payment was received. If you would like to agree on a date and time I will again bring level to prove slope of driveway.

      We REJECT his response, as you are well aware, that it took over 80 text messages and lie/excuse after lie/excuse and contacting the BBB, to get him to "secretly" sneak over to our property and do  quick pictures and blurry ones at that. We were never called or messaged about him coming over. As you can see by our previous pics and today's pics, there is no 3-5" slope in 15' 8" of width. At minimum slope 3",it would be 1" drop every 5 feet and my level which is 2' in length shows level in the exact same spot where he took pics of his "engineer" level. The pics I am enclosing will show that both ends of the driveway BY END OF HOUSE, shoe that it is level. He said from day one, in 2021, that he GUARANTEED his work! I questioned him about the "slope" when he was sitting in his pickup while his crew was finishing up and ge said, at that time is was 3-5" slope. A while after concrete blankets were removed, I went and measured it for "slope" and immediately notified Terry, the owner of the problem, and he stated, " I'll make it right!" He we are in July/August 2023, after 80+ messages, complaint #20336207, and he FINALLY has to make a decision. For the slope of the driveway to achieve a MINIMUM 3" slope in 15' it has to drop 1" every 5 feet and I put my 24" level in the EXACT same spot where he put his "engineer" level and CLEARLY the level bubble is centered. BOTH corners of the south end of house driveway, show level!  There are over 12 big cracks in the 72' long driveway, and now water that is standing on driveway continues to flow into and under this concrete. We had to put rain gutters across both corners of house to channel the water from downspouts across to other side of driveway next to house. His intentions were to take $14,000 (job payment in full) and move on to the next "victim!" We REJECT their resolution and ask to be made whole in every way!       Better Business Bureau:

      I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID 20336207. I understand that because I have decided to not pursue arbitration that BBB will close my complaint. I wil pursue other  legal avenues.

      Case concrete poured concrete steps and sidewalk for me on 5-14-22. After they were finished the steps were not properly finished after forms were pulled. Sidewalk is not straight across (dips in the middle) so water/ice does not run off. Porch failed a building inspection. (Was not finished to code) Owner Terry Case responded several times over text between 5-16-22 and 7-28-22 that he come over to make things right and finish to my expectations. He has never shown back up or offered any other sort of resolution.
