On May 6th, 2024 ****(the owner of Valley View Industries was supposed to build a Pergola attached to our house. it was to have 16 centres & be level with Eastern corner of the house. A Pergola already existed on my house and he was to build it similar to that(it reached the end of the East side). That did not happen as what was build fell short of the end of the house & the last rafter(closest to the west side of the house) was not equal distant to the other rafters which left it too short on the east side. I asked him to adjust it as I was not happy with how it looked as it was not built to what I asked for. $******** was the deposit for them to build it with another ******** when completed. I have already paid the ******** and have repeatedly asked him to fix it. He has informed me it will cost me another $******** for ****************** plus $ ******** for for scale drawings plus taxes. He has also said he would give me $1,000.00 if I wanted to get another ********* to do the job to find a finishing ********* is difficult & who knows what they might charge. I also feel he should fix his error.

I am rejecting this response because:
I have suggested an alternative adjustment to my ******* by cuttiing the end of the already excisting beam at the east side of the house(where it should match up with the end of the house) and adding an additional piece of beam to it which will then reach the end of the house. This piece of beam would have an extra T shaped brace to hold the two pieces of beam together.  The process would include moving the one brace to the new end to support the additional piece of beam.  Also it would mean moving the rafters & strapping along the beam to be equidistant apart from each other & from the end of the porch overhang. By adding this new piece of beam and adjusting the rafters, strapping &  brace the original design, asked for by me, will be met. This whole process would only require a small amount of extra material as most of the wood would just be adjusted to fit to my original request.  Initially he accepted this idea then decided it would cost me an extra $******* on top of the $ ******* which was owing when the ******* was completed.   Now according to his video he claims it cannot be done.  According to the video he sent he doesnt see an alternative; yet, he previously agreed to my suggestion to bring the ******* in line with what I originally asked for.  He also assumes I would not like the holes in the ledger due to the repositioning of the wood.  This would not be a problem for me as the wood is rough cedar & high enough up that it would be difficult to see any left over s**** holes.  My suggestion, to fix this ******* design, so it will meet my original criteria came from an experienced ********* & although my ******* will not be exactly as ordered it will fit the perimeters I originally asked for.  As it sits now the ******* looks incomplete & throws the balance & symmetry of the whole house off.

    Sincerely, **********************

I understand your concerns regarding the pergola installation. Our agreement was to replace the existing pergola with a structure similar to the previous one, terminating at the eastern corner of your house. This understanding was documented and reflected in our discussions, concept sketches, and the photographs I provided.

It appears there may have been a misunderstanding regarding the alignment you expected with the "end of the house." As I understood it, the pergola was to end at the eastern corner, as per the original specifications we discussed where the old pergola ended. The suggestion to extend it to align with the extension over the end ***** of the house was not part of our initial agreement.

Regarding the proposed adjustments to align the pergola with this new vision, it would require significant structural modifications and additional resources beyond the scope of our original agreement. As such, any adjustments at this stage would involve additional costs.

However, in recognition of your concerns and to facilitate a resolution, I am willing to offer a $1,000 discount on the final payment. I believe this discount goes above and beyond our original agreement and can be applied towards adjusting the pergola to better meet your expectations.

I remain committed to finding a solution that satisfies both parties. Please let me know how you would like to proceed, and I am open to discussing further to reach a resolution.
