      Water Damage to Mobile Home Early July 2021, I contacted Nisby Home Renovations Ltd. To have a quote to renew the siding on my mobile home. July 18 2021 the salesman from Nisby came and met with me, looked over my place. The Salesman was named ***** * *** * ***** *** **** *** *** **** **** **** *** *****. We sat down to talk and during that conversation he has said that they would leave the old siding on and put insulation over top of everything. Then they would place the new siding on top of the insulation. He told me doing this would add double insulation to my home and save me on heating costs, as well as keep my place cooler in the summer. ***** then gave me a quote of $********* plus GST of $****** totalling $********* He requested that I pay $******** at mid point of project. I then called my son to seek his opinion on the subject as I wanted to make sure I was getting a good deal. My son said yes, that sounded reasonable. Plus, the company is known to be in business for over 25 years. I thought I could trust that they would do a good job of my mobile home. I knew what the job was going to entail. So, I told ***** that I would like to compare prices and I would get back to him. ***** said to me, if your asking other companies don’t mention the quote I gave you. He then said I wouldn’t ever get a better deal with any other company. While we were talking, I mentioned that my next project would be to get a new roof, because mine was getting older. Although it wasn’t a necessity just yet. Then I said I wanted to have new floors put in after that. I didn’t expect after saying that. That both ***** and ***** would throw that back at me as their defence for not talking care of the water damage that Nisbys guys caused to my mobile home. But that’s exactly what they did. ***** asked when he was there as the outside was being worked on, if he could take a look at my roof, he looked at it. Didn’t go onto the roof just up to look. He then said when your ready to have the roof done, if you want to give me a call. I wrote a cheque for $******** and then he shook my hand and left. A few days later I received a call from ***** saying they were busy and wouldn’t start my siding until September. Due to an early snow fall in September I received another call saying my siding would now be put off until the following year, 2022. I was fine with that, as winter had hit, and it could be done next year. In Feb of 2022, I received a call from ***** telling me the work would begin on my trailer in March if weather permitted. When I told him there was 3-4ft of snow around my trailer. ***** said, “No Problem”. The guys can dig a trench around your place and proceed. I said I thought they should wait till the snow melted and the weather was warmer, and things are shifting due to temperatures changing. ***** said, “we do it all the time”. They showed up as they said and placed the materials on top of the snow in my yard without tarps or dunnage. Just put it all on the ground. The two guys that came to do the siding, started by digging the trench near my deck and a path on my yard to the materials. At my place of employment, I had asked a retired contractor if that was normal. He said, “No, you never start outside work on a place until the snow has melted, weather warms up and the ground stops shifting”. To early in the season and it could cause other problems. When I brought my concerns to *****, he disagreed with me. Although had previously admitted that he knows nothing about the construction aspect of the jobs he sells. I just shook my head. I asked, “How long will the siding take”. He said 3-4 weeks at the most. Weather permitting. The two crew members came and started the work with snow still on the ground. Very little was done. They spent very little time at my place doing any work and didn’t even show up everyday. When I spoke to *****, I asked him, are you coming to check on the progress of the project? If not, who is leading these guys on the job. ***** said he was leading the crew but couldn’t be there every day to check on them. Told me he was too busy to come every day and then added that he knew nothing of the job was supposed to be performed. I am just the salesman. I then asked him, if you don’t know what’s supposed to be done. Why isn’t there someone here who dose? ***** then said that *** ********* was on another project and their head carpenter ***** **** was off ** *** *** ****** ****. At the end of March, I came home from work my mobile home was stripped down to the bare wood. They removed the seal from around the roof area. That’s what is supposed to protect the walls and ceiling from leaking when weather comes down. The screen door at the back of my trailer had been removed, and not replaced. Was told it would be put in later. The work appeared to be going at a crawl and only a small amount of insulation was placed at the back wall of the trailer. Then when I came home and seen that, it was unsecured and flapping in the wind. I used what I could to hold the insulation onto the house, and called ***** and told him what was going on. He didn’t bother to come and check on my trailer until the next evening. I was fed up, as my neighbors had informed me that the guys would either not show up or if they did, you were lucky to see 3 hours out of them. Not to mention every day I came home from work that they were there, I was cleaning up after them. * **** ***** *** ** *** ******* **** ********** ******** ***** ***** ** ***** ********** **** ***** *** ****** *** ** *** ** ***** *** ** ***** **** ***** * ***** **** ******* **** *** ******** ***** ** *** ***** ** **** *** **** **** *****. 4 weeks had passed and barely anything had been done. Then Two heavy rains came down, over two weekends in April. Then snow fall and I knew there would be issues. The plywood was still bare and there was nothing protecting the outside of my trailer. Water stains started to appear along some of the walls at the edges where my ceiling meets my walls. Water was making its way down the inside of my walls and at the edges of my ceiling throughout my trailer. Wood on the outside was soaked as it was not protected at all. The following week a bit more insulation made it onto the walls. But they left quickly as I was told one of them had a family emergency. When I got home that night, my yard was a mess. Garbage was left everywhere, tools everywhere. They even left a can of end seal without its lid, allowing rain to get it. So I closed it up and went inside to call *****. After the rain I had gotten over the weekend, ***** came over. I was at my ropes end, and I told him. “Get some one to do the job right”. The one guy that came to clean up and before he left, he took my brand new outside sensor light. I made sure I got Nisby to replace it for me. Then I had a new contractor come and I could see he knew what he was doing. He saw all the mistakes that were made and first put my seal back on. But before that, I had one last good rain fall where everything got soaked and water came into my trailer, soaked my walls windows and rugs. I had water coming in at every outer edge of my ceiling in my trailer. I was soaking up water and trying to keep from getting worse. It was an absolute nightmare The new window they had put in my living room was soaked and leaking on me on my couch. Even my curtains were stained with water. So at first I had to deal with all the water and then the water damage. After all was said and done, I had mold issues and lifting everywhere. My floors in every room, my ceiling tiles all damaged, my insulation in my roof mold. I was told by Nisby that they would be sending someone out who would do mold testing, but they never sent anyone because it would cost them to much money. So I paid for the mold test and water damage testing to be done and they were very fast to want the results. He then was quick to say he read it as my fault for the mold. My insurance company came out and did an assessment and said they would not cover the damages because it wasn’t due to aging or nature. As there were no obvious signs of pooling in the center of the roof as is common with aging damages. Instead, the damages were caused by the removal of the seal along the ceiling line that was done by Nisby’s workers during the siding job. So, insurance would not be paying for any of the damages as they deemed it Nisby’s responsibility. * ** **** ***** ** *** **** * **** **** ** ******* **** *** *** **** ******* **** *** ******** ******* ** ** ***** ***** *** *** ** ** ******* ** **** ***** **** ** ****** ** *** ***** At the end of it all, I got unskilled workers. I thought I was getting professional siding carpenters. I got a salesman that sold me one alright. I got an owner who denies any responsibility and has gone out of his way to hide from me and not come to the table and take care of what his workers did. My insurance company emailed him and told gave him the report, nothing. Mold testing done and paid for by me, and nothing. Other contractors saying it was his fault and emailing him with what he left me with, nothing. At the end of the day, the damages caused came to roughly $********* between materials and labour of everything damaged As I had every exterior wall replaced, ½ my insulation, all my flooring and baseboards, and some subfloor replaced in my living room under the window they installed that leaked so bad, it put a hole in my sub floor. Because of all the water that I got inside it forced my insulation under my trailer to drop and that protective bag is on the ground, and that must be replaced too. **** *********** ********* ** **** **** ** *******. I had to scrimp and save for a year and finally get another company to come in and do the work he refused to acknowledge was his responsibility. *** ************ *** ****** came and have completely re done the inside of my trailer and I have been living in a construction zone for over two years thanks to Nisby and their guys. I only wanted to update my trailers siding not have all this happening to me, I am in my 70s and didn’t deserve this at all. This was supposed to be an existing thing for me to get for myself. It’s been nothing but a huge mess and disappointment. I didn’t even have enough at the end of it all, I had to take out a line of credit to finish the inside damages.       Hello,

      We feel as if we have not caused this damage. Attached is a report from her insurance showing how bad the roof was and customer has recently replaced the roof because this is where the water was coming in. When we stripped the old materials off of the mobile home all of the substrate was rotten. We replaced $**** worth of rotten wood on her home which shows that her home has been leaking for years. Once we replaced all of the rotten osb with new osb we put on 4x8 sheets of halo exterra which has a built in water resistive barrier. Attached is the link to the product we used which shows that it can be installed without the need for additional house wrap. The customer still owes us $******** on this contract which we told her she could put towards her repairs just out of good faith even though we were not the ones who caused this damage.

      I have contacted Nisby 3 to 4 times and they are avoiding my request for a resolution. I have a roof that was installed in 2015 and is now leaking. This has caused internal damage to my home and mold has started to form, which is a health concern.

      May 18 (2022): Signed a contract with Nisby for the installation of an egress window with a mutually agreed install date of June 16. Paid $**** deposit. May 25 (8 AM): Nisby was supposed to be at my home on this date at this time to assess. They showed up at approx. 9:15 AM, and I was in a meeting and could not attend to them. May 28/29: This was the agreed upon rescheduled date but no one showed up. June 5: After I contacted them, they came to assess. June 15: I emailed Nisby to ask if the permit was approved, since the rest of my reno depending on their permit being approved. The response was that they had not even filed for the permit yet. June 20: After not hearing anything back, I contacted Nisby again. I had several conversations with someone who I assumed was a Nisby employee. They said the permit would be filed that evening. They sent me the owner statement that I had yet to fill out because no one had asked me to before. June 21: I received a text stating they hadn't received a completed owner statement. This turned out to be false, as the issue was on their end not being able to see the filled out fields. This is when I realized that the person I was talking to was not a Nisby employee, but rather a subcontractor. It turns out, it is the one specific contractor that I did not contact for a quote ***** ** ******* **** ****** * ****. July 24: The window is installed finally. July 25: I noticed a gap in the window and let the contractor know. I also had to clean up the mess of rock they left on the street. July 28: Contactor says coming by to see window. Doesn't come. July 29: Says coming by on Aug 2 instead Aug 12: Date for window replacement. Does not happen Aug 15: Window replacement. Does not happen. Aug 16: Window replacement Aug 18: I notice window is jamming Aug 19: Contractor calls to say its supposed to be that way Later, I contacted ******* ******* and they said it's not supposed to do that. Waiting on them to inspect. Nisby wants payment.

      I have been working with you every step of the way on this. We are not walking away from the job whatsoever. We have paid for the permit, engineer report, window, window accessories and labor for this job. All I was asking for was a progress payment on the job until ******* comes out to inspect the window. The window has already been inspected by the City of Winnipeg and passed inspection. I have already provided you a discount in the way of gift cards. If that does not work for you please get back to me.

      I contacted Nisby Home Renovations in May to get an estimate on a new roof at our residence as well as siding on the protruding portion on the roof as well as 2 vents for the garage roof. Jim at Nisby Home Renovations came out and provided me with a quote on May 19, 2022 and the next day I paid the deposit of $********* The quote indicated that the roof would be done in June and the siding in August, 2022. June came and went and my daughter and I who share ownership of the home decided to forego the siding on the portion protruding from the roof because different advice received we thought of postponing that portion of the work until we were fully informed. I called Jim at Nisby Home Renovations and he removed that portion of the work and provided me with a revised invoice. He indicated that the roof would be done soon and around July 5, 2022 the roofing shingles and materials as well as the vents for the garage roof were delivered, during that day, the "hydraulics failed" as indicated by Jim and no work was done. My daughter and I waited around 2 weeks and still no word of the work being done, instead the shingles remained on a crate on the grass. My daughter called and left a message asking when the work would be done. That following Monday (July 25, 2022) Jim at Nisby both left messages that "our time had arrived" and the work would be done on Tuesday, July 26, 2022 the next day. My daughter waited at home during the morning until 10:30am (nobody had arrived). She was annoyed and went to the office of Nisby Renovations at 203 Ferry Road and Barry/Jim said that a roofing company was to begin that day but the lead hand was out buying roofing nails and later sick. I called this man who has the same business type subcontracting work out. We cancelled the job and accepted their resolution of option 3 to pay for the restocking and receive $610 refund. Shingles were returned. Grass below the crate was damage. Nisby is now ignoring our request to accept the refund.

      Mr. ****** ******** Home Renovations Ltd *********************************************************************** Last year I contacted him for repair of stucco corner of the house back (L) where the drain is. The winter cold water I think was the cause of damage. A hole need repair. He said after repair he will paint the whole house around that will cost $*********. I paid him after the stucco guy finished the job. $******** June 4, 2021 and the 2nd job was to replace the storm door both front and the back of the house in which the sliding glass catch unable to hold when you need air in warm days. The ***************** storm doors came to replace a new door one in the front and one in the back. I do not have the name of the person did the replacement. When he finished the work, everything was working. Well, when winter came the back door facing North East was hit by winter storm over and over. Last winter the back door started not to close with click every time has to pull back to close and inside the glass started to form with ice that I cannot see out. I called Mr. ******** 3 times, once in Feb. 2022, another in March and another in May requesting him to ask the gentleman who installed the doors to fix the lock in the back. Mr. ****** said he can fix it. Why do I want the man that installed my door? And he said that the man has been retired and he never come to check it our himself. Three weeks ago, I wrote to ********** as they have no phone numbers to call only address on its paper: Atten: ***************************************************** and since I do not receive any reply, I paid the storm doors on June 22, 2021 to Nisby Home Renovations Ltd. $******** for 2 storm doors. Now for the past few days the front door when close the (L) upper end will hit the door frame that indicates the door is warped. The company paper written 10-year guarantee that they will repair or replace any component of the door to be defective in material or workmanship under normal use by the original purchaser.
