I have an outstanding debt of less than $800 with a credit card company that I haven't be able to pay and recently, April 1st, received a letter that states that if I don't pay MAC Financial Recovery the outstanding debt within 7 days of the letter, legal action may be initiated and then go on to say "In the event we obtain a judgment against you in a court of law, MAC FINANCIAL RECOVERY INC. will have the ability to garnish wages and/or place liens on any assets you may possess." which is threatening and intimidating language and using undue pressure, all of which isn't allowed by the federal government.Business Response

I am rejecting this response because in your letter, you clearly did use threatening and intimidating language and in fact did put me under undue pressure. Telling someone you will take them to court over $760 debt especially when it's the first time you have even tried to contact the person is clearly an attempt to intimidate the person and the person under undue pressure and therefore you are not following federally regulations. Therefore, I will not be paying this debt at all. Also, considering I was contacted a year ago by another collections agency about this debt and in their letter, they actually have the correct information regarding this debt and you don't, I'm confident you're just ******** which is another reason I will not be paying you anything. My mom is diagnosed with breast cancer 2 times and I am the only one that is able to help pay for her treatments I have explained this to MAC financial recovery I have no business with them they choose to buy my account.. Covid came and I was working in the hotel industry I lost my job and couldn’t afford to pay my credit card bill I explained to them now I lost my job again where I will soon be homeless yet they still threaten me to sue me so they can garnish my wage. Mac financial is calling me for a unsecured debt over 9 years old, last payment made was in 2015 for a ******** **** card in Alberta, they claim I owe them over $10,000.00. This is has been a stressful situation *** ******* *** ******* **** ******* **** ********* ****** ********* I have had to restart my whole life at the age of 62. I live on disability and partial pension less than 1400 a month on vancouver island. For the last almost 2 years, I am being called daily on my phone number ************ by this business. They leave me messages saying they are calling from MAC Financial, with a very special offer intended to improve my credit rating, and I should make sure to return the call at ************, extension ***. Company is currently trying to collect a debt well over 15yrs old. It was entered on my credit report last summer dated April and March or 2020 and have recently updated this toJuly of 24. This debt is past the statue and should never have appeared on my report. These guys have been harassing me about debt they bought that is almost 8 years old credit card debt past the statue of limitations for it. The original debt doesn't even show up on my credit report. I have spoken with Greg from MAC- he is very **** on the phone to me when I do answer I've asked them to stop calling me as it is harrassement. He told me he can do whatever he wants and he isn't scared of me or my lawyers because I don't have any money. His words. If they record their calls you can hear him threaten me. I have asked for all communication to be strictly by mail. Nope MAC calls me daily. I ask that MAC does the proper thing and remove my phone number from their file. MAC financial purchased my debt from a second party debt collector in 2020 and has since been harassing through threatening letters, multiple daily robo-calls and emails. Multiple attempts have been made to both dispute and settle the debt, all of which MAC is unwilling to work with. Repeated attempts to add the debt to a Debt Management Program have been rejected by MAC Financial, all so they can continue to collect interest rates that appear higher than the legal limit, and damaging my credit, including negatively impacting the ability for my business to obtain credit. Original debt was $200 yet MAC claims it to be over $600 and has refused a settlement of $400 as well as illegally contacted my cellphone, and continued contact after receiving a letter stating my Inability to Pay. Only acceptable resolution would be for MAC financial to immediately remove the debt from collections status on my credit report and accept a settlement of the debt.Business Response

We cannot update the credit bureau until the account's balance is paid in full. The original limit of the card was $200 which they maxed out by claiming the payment was never received. When I had asked it to be closed the balance was zero but I have no idea what ******** **** did after that.

I am rejecting this response because:The balance of the card was paid off in full in store by debit as clearly shown in the provided, which they claimed was never recieved and attempted to raise the balance for non-payment. This clearly shows the payment was made to ******** **** and ******** **** would be responsible for provide copies of proof of payment notifications they received as well as the repeated requests to have the account closed.
As the bank account that was used in 2018 is no longer open I cannot provide further details other than the same copies I sent to ******** **** originally as proof of payment when it was made in 2018.

I am rejecting this response because:No proof has been provided showing that there was any balance remaining after the payment was made, nor was the card used in any way after that time, and would not have been a span of time of over a year between uses.
I have proven that the payment was made and that ******** **** failed to put that payment towards my balance.
The obligation is on ******** **** and MAC Financial to provide proof that there was a remaining balance by way of a dated bill for a date after the last payment was received.
I informed my credit counselor that the payment had been made and the offer was not to be made and thus it was removed by the credit counselor.

I am rejecting this response because:I had repeatedly informed ******** **** to block the ****** ***** **** from charging the account, which they did not do. None of the purchases were authorized or performed by me as the account was supposedly blocked from use. All this shows is that ******** **** continued to allow the card to be accessed without authorization and continued to charge interest after the request for the account to be closed had been made in July of 2018.
