    I hired ******************** to make some repairs to rental properties. We have now reached an impasse on the service because in his scope of work/ contract and in discussions following he agreed to complete tasks beyond his professional ability. In doing so, he has damaged materials that cannot be replaced and refuses to compensate me for the damages, stating that he never agreed to work on them. My issue is that he never communicated to me any difficulty with completing any of the tasks until after he had completed them in an unsatisfactory manner. Had he communicated any of the issues that he had before taking on the task, I would have hired someone else to do them instead of creating more work in the long run. ******************** did offer a discount of $600 but a quote to repair just one of the items that he damaged is $400 and I am still awaiting quotes on other repairs. I asked ******************** to send me the receipts for the cost of materials so that we could simply negotiate the labor portion based on the poor quality of work and he has refused to do so. I have a recording of the conversation that ******************** and I had after initially seeing his "final" work where we agreed to certain corrections to move forward as a verbal amendment to the original contract but it is too large to upload.

    ******************* did hire me to do some projects to her rental properties in *******.  The contracts that she downloaded are complete as to what work I was contracted to complete.  For starters, nothing has been damaged or not completed as per my contract.  I did not attempt to perform any work that I was not confident that I could complete.  The $400 repair that she is referring to is the resurfacing of the tub.  My contract only states that I would clean the tub.  I recommended that she not resurface the tub initially due to chipping and she agreed.  That's why contract states, "cleaning." I'm not responsible for that.  The second issue she has is the shower walls in the bathroom.  Initially I showed her some shower walls that would work and she viewed them via text message and stated they were fine.  Upon the final walk thru, she stated the shower walls were too plan and she didn't like them.  These were the best shower walls for her project due to it being an older home where the corners are no longer square and the walls are imperfect also.  I agreed to install the shower walls that she wanted but she also wants to take the cost of the new shower walls from my final payment.  That's not how it works.  The new shower walls are a non-flexible material and will not curve with the unsquared walls in the bathroom.  This is why small nails were added to close the corner gaps with the shower walls.  The nails are her complaint.  She states it cant be repaired but it can simply be cut back and add trim like the previous installed shower walls.  This was explained to her before the second walls were installed.  Her last complaint, was tile around the fire place.  Again, reference the contract.  I never stated I would to do tile work around the fireplace.  Initially, there were two end tiles on the floor in front of the fireplace that was damaged.  I told her verbally, I would try to find something that matched.  She and I both looked and could not find anything that she liked.  I had already removed the damaged tile, so I installed some grey tile that she didn't like.  It was only two pieces.  At the final walk thru, she stated that she wanted the tile redone.  I never agreed to that per our contract but I did agree to make it look better, so I did the floor tile as a measure of good faith. At this time, I have installed two separate shower walls and completed tile work that was not on the contract.  I'm not sure what she wants but I have made all the accommodations that I'm going to make. I will take action to place liens on her property.  Per our contract, she owes me $4425.00.  I gave her a discounted price which expires tomorrow for $3000.00.  She states its not enough of a discount.  The discount includes $655 and also with me paying for the new shower walls which are over $700.00.  I have attached pictures of both set of shower walls, tub and tile in front of fire place.  If you need any additional information from me, please let me know..

    I am rejecting this response because: The $700 compensation for shower walls is a reimbursement from what I paid out of pocket outside of our original agreement. As you can see from the attached transcription of our conversation, ******************* and I verbally amended our original agreement. At the 23:05 marker, he stated that he would replace the shower walls, apply the tub kit, install carpet in the closets that matched the other carpet that he installed, and he would retile the entire fireplace. You will also see from the photos and the screenshots of text messages that ******************* did not in fact retile the entire fireplace because he stated that doing so would damage the wall (which I would think that a contractor could fix). At no point did ******************* communicate any problems with the shower wall installation or the tub kit and you will see that in the text messages provided. You will also see in the transcription (24:29) that I previously discussed issues with the quality of his work and was assured that these things would be done correctly.
    I am in no way trying to take advantage of ******************* and you'll see in our communication that I have never once asked him to pay for another shower wall after damaging the current one. What I have asked is that he show me what was spent on materials so that I can remove that from the total and he and I can solely negotiate the labor portion of the bill, because the labor is what I have an issue with.
    Regarding him paying for two sets of shower walls, that was also discussed in the transcription. ******************* told me that there were only 3 styles available, not available in his budget, but in general. That was not a true statement and once I had a chance to go out and look at materials for the bathroom I noticed the price difference in all of the things that were removed and replaced with cheaper items. This isn't about trying to get something for nothing. It's about fairness on both sides. We agreed to what would be done to move forward and he did not hold up his end of the bargain and is completely shirking responsibility for doing poor work under the excuse of it wasnt in the original contract, but youll see me address EVERY single item and why it wasnt in the original contract. You will also see that I asked ******************* to address how we would handle conflict and budgeting issues in the original contract via email and he did not do that, which is why I am handling it this way since I cant get him to be accountable for his poor work and communication.
