    Property THREATENS to tow ANOTHER vehicle for flat tire that HAS a required sticker on it but has NOT done so, but towed my car; as of 8-28-24, same vehicle STILL not towed but tows my car after I communicated with the property about it. That's discriminatory. All they had to do is make one phone call and say this car is being worked on; don't tow it. Property says they have no control over the parking however, the towing company knows Historic Properties. So my question is whether the Birmingham Parking System can randomly come on YOUR property and tow a car?I keep a clean apartment and surroundings and yet this is the repayment; don't understand where this discriminatory behavior is coming from. Put into practice what you said you would do with the vehicle with the flat tire FIRST and not my vehicle. The person WITH the sticker on their SUV still has NOT done as management has asked yet you tow my car even though I've communicated with you about it?? What management says and DOES is not consistent with ethical business behavior and has a history of such. If they don't agree take a survey of your residents that have left over the past year, one lived above me and the other on a different floor who had been there for five years. That same vehicle silver SUV is still sitting out there along with other cars that have not been driven or moved in two years!The resolution I want is to have my car returned back to me so that I can sell it; I informed management about my concerns to no avail. Please return my car back to me so that I can sell it. Thank you.

    Part 2 of my complaint: Here's the copy of the text of me ON AUGUST 4th asking apartment management for another sticker. *** I left message with Parking Enforcement Systems*** on 8-28-24; no response. I went by there to confirm the address and get a picture of sign showing information on what's needed to get car back. "Hey there, just letting you know that the white ***** parked on the back row next to my ***** is a loaner until i get my car looked at. Also, can i get a sticker for it please? Thx ************************* 205, ********" Your response - "Yes you might need to move it so it won't get towed I have no control of the towing ****** Now on the 28th of August you telling me to come to the ********************** to get one. You didn't give me this information before, only that it might get towed. Parking Enforcement should have towed the Silver SUV since management had already sent notice to them threatening towing of SUV, instead of randomly towing my car since I had already spoken with management about the car and tried to get a sticker for it.

    My car was towed after paying for parking. The wrong license was entered but even after showing proof of payment was charged $160 without refund of parking payment.                   Please allow me first to start by explaining what we at Parking Enforcement Systems,Inc. do as a company.  We do not own,operate, or manage any parking lots or parking payment machines or apps.  Simply put, we are contracted by parking lot owners and/or operators to enforce their parking lot rules by towing vehicles that do not abide by the rules of the parking lot and/or parking payment options and/or parking signage.  On July 19th, 2024, we towed Mr. ********* vehicle for failure to have a current payment with ParkMobile for the license plate that was on the vehicle that was towed, which means that he did not abide by the rules of the parking payment option that he agreed to when he used that option. 
    ******************** has made some very strong and worrying accusations. Accusations that will be investigated thoroughly.  Im sure ******************** has proof of his accusations, so Im more than happy to look further into this complaint, but will need him to answer to the following questions and provide his proof:
    Why did ******************** agree to, but not abide by the rules of the parking payment option that he used, which state that he must pay for the license plate that was on his vehicle?
    As stated above, we do not own, operate, or manage any parking lots or parking payment machines or app, so why does ******************** think that we can refund any parking payment?
    Did ******************** provide the necessary documentation showing that he had paid for parking for the license plate that was on the towed vehicle?  Showing proof of payment for that license plate is the only necessary documentation that we accept, since that is the only thing that we can see in ParkMobile nForce when we check for vehicles that have paid to park.
    What expenses did ******************** offer to pay for?  The only expense he was required to pay was for the towing of his vehicle, which he did pay for.
    Please describe which employee(s) ******************** is accusing of rude smugness.  After reviewing the phone call that ******************** made to our company to see if we had his vehicle as well as checking video recordings from our impound lot, all I have found is ******************** cussing at our employees.  I did not find one single recording of any employee being rude or smug to or cussing ********************.  I am more than happy to provide these recordings or transcribe them for ******************** or the BBB (which would be posted to their website).  Why does ******************** think that it is okay to cuss at our employees and say other derogatory things to our employees, including to an African-American female working by herself at our impound lot?  What was said to this employee is absolutely disgusting and should not come out of anyones mouth.
    Why does ******************** not have to follow the rules of the parking payment option like everyone else?
    Why should ******************** not have been towed for not following the rules of the parking payment option?
    Why should we give ******************** a refund for not abiding by the parking payment option rules, rules that he agreed to when he used the parking payment option, which in turn caused us to tow his vehicle? 


    Once I receive all this information, I will further investigate these accusations that ******************** has made and report back to you.  Thank you for providing this information and I look forward to getting to the bottom of this complaint that ******************** has made against some of our employee(s).

    I parked my car in a downtown lot and paid for parking using the ParkMobile app. I confirmed the lot number was correct, that my car and license plate were correct, and that I had properly started my parking session. When I returned my car was gone. I checked the app and saw there was roughly 30 minutes remaining. The restaurant informed me this happened often and gave me the number for Parking Enforcement Systems. I called and they confirmed my car had been towed and wanted $160 to get it back. I showed them the receipt for parking but said since their device didn't have a record of payment they would not release my car.This appears to be classic predatory towing. I paid for parking, had a receipt, and all my information was in order. They still demand payment and will not release my car.I'm concerned my car was damaged during flat towing, it's an all wheel drive manual transmission. I intend to have it checked by a mechanic and want my repair costs covered.

    Our sincerest apologies, but we are not a parking company nor do we own, operate or manage any parking lots or charge anyone to park, therefore we cannot refund you any money that you paid for parking with the wrong tag number.  We suggest that you contact the company that you paid for parking with the wrong tag number.

    I payed for parking after battling an out of order kiosk. Retrieved a receipt and had possession of it. ***** was not able to communicate to put recipt in dash so I put it in my wallet in case of an issues. Sure enough they stole my truck and forced me to pay them $160 dollars also numerous other vehicles had been broken into here. They should be held responsible for fixing the screen on the payment kiosk to inform customers of expectations.

    6.  Picture of signs located on the property that *** have been taken.

    7.  Picture of kiosk that my have been taken.

    I have not been contacted to "give information on (a) vehicle that" supposedly "caused damage" to a vehicle owned by Mr. ******, but I'll be more than happy to look in to this.  In order to do so, I'll need the following:

    1.  Date and time vehicle was towed

    2.  Location vehicle was towed from

    3.  Location of supposed vehicle damage

    4.  Date and time vehicle damage was reported to the police

    5.  Copy of the police report or incident report

    6.  Proof that we damaged the vehicle

    7.  Type of information that you are requesting on the vehicle that towed the vehicle supposedly damaged

    8.  Vehicle make, model, color, VIN and license plate number

    Once I receive this information, I'll look in to this further, including but not limited to watching the video recordings of the vehicle being towed.

    On Thursday June 10, 2022 around 10:30 p.m. my vehicle was towed due to the fact I allowed my parking meter to expire. I picked my vehicle up from the impound lot at around 10:50 p.m. I paid the fee to release my car and when I started the car my warning light in the car indicated it had a suspension malfunction. When I drove to the exit gate I could here my car dragging. I told the gentleman working who gave me the keys to my car about the issue I saw and was having and he said when I drive for about 5 min the warning light will reset and the car should go back to normal. As I drove for about 10 min to drop my friend off at home in ******** I called again and the lot attendant told me again that that was common for Mercedes, BMWs and Audis after they have been towed. I asked if my Audi was placed on a wrecker or did they drag it and he indicated that they did drag my car. I got home and tires were rubbing the inner wheel well and my car was sitting on top of my tires. I called again and the same lot attendant told me to call the same number I had just called but dial option 5 to leave a message about the problem and someone will return my call. I have not gotten a call back and the very next day I got the car towed again of which they did place my car on a wrecker because they indicated that my car should not have been **** and I sent it to the Audi dealership where they did indicate severe suspension damage and it is going to cost approximately $****. I would like to get this situation resolved with Parking Enforcement Systems or find out my next course of action should be.

    I'll be more than happy to look in to this for you, if you will provide the following information:

    1. Date of tow (June 10th was not on a Thursday, nor do we have record of any Audi's being towed that day)

    2.  Receipt number

    3.  Location that your vehicle was towed from (we do not tow from parking meter spots)

    4.  Phone number that you called from when you claim that someone told you that we "****" your vehicle

    Once I receive this information, I will listen to ALL of the phone calls (which are recorded) and check the cameras that show how the vehicle was towed.  I will then send them to the BBB.  Please keep in mind that it is literally impossible to "drag" a vehicle with the type's of trucks that we use, which are wreckers.  Also, we did not have the keys to your vehicle, nor do we have keys to any vehicle that we tow.

    I look forward to getting this information from you, listening to the phone calls, watching the video and reporting back what I've found.  Thanks.

    This company illegally towed my car which was parked at my apartment. They admitted that the company I lease from had not contacted them and that they had decided to tow my car because it didn’t have a pass on it. When reviewing my lease, this is not a stated requirement nor is it even in the document. I spoke with my neighbors who confirmed they didn’t call either. My car was towed at noon on a Wednesday simply because they were driving around looking for vehicles. The entrance to my building is in an alley off the a street. I noticed my vehicle was missing & called the number on the sign posted outside to explain that I was legally parked. The man didn’t care and instead, began yelling and cussing at me, claiming he works for the state which is also not true. These people specifically targeted my vehicle considering half of my neighbors do not have signage because, once again, this is not a requirement. They likely would’ve come back for the rest if they were not otherwise preoccupied with making sure, I (19) didn’t get my car without paying. Seeing as this my car is registered in my lease at this location, they committed grand theft auto by impounding my vehicle and claiming they wouldn’t release it without charge; even though they knew it was unlawful. The man was so rude over the phone that I had to have my dad drive down there with me as I was concerned for my safety. As we pulled up the “manager” began yelling and cussing at my dad and I as we tried to discuss the situation. It is a disservice to ********** that this business is still in operation considering the multitude of stories like mine. There are multiple BBB complaints about this company, to which nothing has happened.

    Let me first start out by explaining what we at Parking Enforcement Systems, Inc. do as a company. We are NOT a parking lot operator or owner, however we ARE a non-consensual towing company. We are contracted by parking lot owner’s and/or operator’s to monitor their private parking lots to insure that any persons who either do not pay the proper fee to park on a parking lot, park without proper permission, park without proper permit (as was Ms. ******* case) or fail to abide by the posted rules of the parking lot has their vehicle towed from the property. Ms. ******* DID NOT have a parking permit sticker on any window of the vehicle towed, nor did she have a hangtag hanging from her rearview mirror or laying on her dashboard, AS REQUIRED BY HER PROPERTY OWNERSHIP COMPANY. As verified with her property ownership team this morning, all tenants are given either a parking sticker or hangtag with their move it packet. It was Ms. ******* responsibility to place the hangtag or sticker on her vehicle when she moved in. Again, because Ms. ****** failed to abide by the rules established, her vehicle was towed.
    We typically take complaints very seriously, however this one is so full of lies by Ms. ******* that it's almost impossible to do.
    Lie #1. We did not tow this vehicle illegally. Towing a vehicle for failing to abide by the rules of the property and doing what the Tow Away Zones signs say will be done to violators is not illegal.
    Lie #2. We did not tow her vehicle because we “were driving around looking for vehicles”. This vehicle was actually called in the night before by a tenant who could not find somewhere to park at the property that she lives at and has a parking permit to park at. That same tenant decided to wait until the daytime to email us pictures of this vehicle showing that it did not have a permit in it and that it needed to be towed. A copy of the email is attached. Having said all of that, it really doesn't matter in the first place, because the property ownership team wants us driving around looking for cars that do not have a proper permit to park and towing them 24/7.
    Lie #3. The man that spoke with Ms. ******* did not “yell and cuss” at Ms. ******* on the phone, nor did he claim that he “works for the state”. The entire phone conversation between our employee and Ms. ******* is also attached.
    Lie #4. We did not “target” Ms. ******* vehicle. We did what we were asked to do by a fellow tenant who saw that the vehicle was breaking the rules and because of that, she had nowhere to park.
    Lie #5. It is false that “half of (her) neighbors do not have (permits)”, because that tenant was asked to send pictures of ALL vehicles parked on the property without a permit and Ms. ******* was the only one without one.
    Lie #6. We didn't commit “grand theft auto by impounding (her) vehicle and claiming (we) wouldn't release it without charge, even though (we) know it was unlawful”. Again, what we did do was “literally” what the signs say will be done to vehicles that violate the parking rules of the property. We have been licensed to do this for longer than Ms. ******* has been alive and have never be charged with “grand theft auto”.
    Lie #7. Our employee was not rude to Ms. ******* over the phone (as per the previous mentioned attached phone call) and her comment about being “concerned for her safety” is libelous towards our employee and our company. There was nothing concerning about what our employee told her. He simply told her that we had the vehicle, why we had it, and where to pick it up.
    Lie #8. Our “manager” did not cuss at Ms. *******' dad. What he did do was ask Ms. *******' dad if he was the one that said he was going to “kick (his) ass” to him on the telephone, which is in fact what Ms. ******* dad did say that he was going to do. Repeating what someone said to someone else is not cussing at them. A copy of that phone call is also attached.
    I'm honestly not sure why Ms. ******* made this libelous complaint with the false allegations knowing that they aren't true and that she didn't abide by the rules, other than to publicly make libelous statements against us, but in any event we will not and do not give refunds or give any money to anybody for any reason. We did absolutely nothing wrong.

    The company responded in an unprofessional manor, and tone. The documents & emails they stated they would attach are not. My vehicle had been moved from the previous day when they had towed it. My neighbors did in fact *not* have their permits and still do not.

    Contrary to Ms. ******* feelings, it is not unprofessional to defend your company with facts when someone has made false, libelous statements online for the world to see, with the intent to cause finance harm. 

    We did in fact email [email protected] on June 7, 2022 @ 2:58pm with the phone calls and email sent from the other tenant requesting us to tow your vehicle because you did not have a permit in it as required by your management company.  We received a confirmation email from the BBB immediately thereafter stating that they received our email with these attachments.  I suggest you reach out to them and ask why they did not provide those to you.  

    We stand by our previous presentation of ALL the facts, which Ms. ******* knows are true, which is why she did not dispute them in her reply to our previous rebuttal.  Those facts include, but are not limited to, that parking permits are required to be in vehicles parked at this apartment complex and that all other vehicles parked on the property that day did indeed have them. 

    Once again, we will not and do not give refunds for doing our job.

    I arrived on a ****** flight on 6/7/22 to check into an ****** located at ********** on ******. Per the instructions I thought I was in the correct lot but couldn't get the app to work to pay for the parking. It was very late and I was exhausted so I decided to get up in the morning to figure out why the app didn't work and call the number on the sign. Since it was past midnight I didn't expect anyone to answer on 6/7. I woke up the next day to go deal with it and my car has been towed. No note or warning. Also there wasn't a single other car in the lot so clearly I wasn't causing a problem by parking there. In doing research online it is very clear this is a scam and the city should not be tolerating it. This reflects very poorly on your city and doesn't engender a feeling of wanting to come back. I tried the app again today and still couldn't get it to work so found a different lot to park in, The annoying thing is that everyday tow trucks are driving by on this street and clearly making tons of money with this racket. Not a great way to run your city Birmingham. :(

On June 7th, 2022 we towed Ms. *****'s vehicle for the the aforementioned reasons. Contrary to Ms. *****'s false statement that “the app didn't work” when she arrived, it actually did. The ParkMobile app did not crash that day, nor has it crashed any other day. The attached documents show exactly how many cars had paid to park in this ParkMobile **** parking lot the day and time that she was towed, whether they were still there or not. Just because there may not be other cars in a paid parking lot, doesn't mean that someone “wasn't causing a problem parking there”. In fact, the “problem” is that she did not pay to park. The number listed on the sign for the option to pay to park over the phone (attached photo) is answered 24 hours a day, 7 days a week, so I'm not sure why Ms. ***** assumed it wouldn't be answered. Nowhere on the sign does it say that it wouldn't be answered. We towed Ms. *****'s vehicle roughly 12 hours after she parked it there, according to her statement about her arrival time, so to imply that this is a “racket” and that we are “making tons of money” is absurd. If anything, a 12 hour grace window was given to her to make payment. Not to mention, this is the only vehicle that we towed from this property this week, so any other tow trucks that “are driving by on this street” aren't ours. Ms. *****'s statement that her “car had been towed. No note or warning”, couldn't be further from the truth. Also attached is a picture showing the “TOW AWAY ZONE” sign on that property stating that violators vehicles will be towed at owner's expense, which is the “warning”. It is not a “scam” to do exactly what the sign says will be done to vehicles that violate the rules of the property. It's called doing our job. Ms. *****'s job was to pay to park, which she didn't do. Had she done that, her vehicle would not have been towed. I'm not sure why Ms. ***** feels entitled to break the rules and then make slanderous and libelous statements online for others to see, with the intent to cause us financial harm and extort money from us, but we clearly did nothing wrong. Finally, I would like to add that what “reflects very poorly” is Ms. ***** herself when she called to inquire about her vehicle... No-one should have to “tolerate” Ms. ***** and the language that she used when she cussed at our operator, called Birmingham a “dumbass” “town” and called our operator an “asshole”. The recording of this conversation is attached as well.
    The fact of the matter is that Ms. ***** knowingly, purposely and of sound conscious and mind, without being forced to do so, parked her vehicle on a private parking lot in the Northside area of Birmingham and admittedly and intentionally failed to pay to park. No one is to blame for any of this, but Ms. *****. We will not and do not give refunds or give any money to anybody for any reason simply because Ms. ***** is the one who parked on someone’s private property, failed to abide by the rules, got caught, and had to suffer the consequences. We did nothing wrong.
